WF�RE'AS, the City Council of the City of PaLn Desez-t, California, did on
the 8th day of Septembe.r, 1988, hold a duly mticed public heari.r�g to oalsidex
a request by LEVI H. LEHV, M.D. for appraval of a Negative Declaration of
�virornnental In�act, a precise plan and par�cel map for a 24, OQO square foot
medical office buildirr3 located at the sautl�east aon�er of FY�ed Waring Drive
and San Pablo Avenue; and
VJFIERFAS, said application has ca�lied with the r�equirements of the "City
of PaLn Desert Prncedure for Im�lementation of ti�e California D7virnrn�ental
Quality Act, Resolution No. 80-89," in that the director of cutmunity
develognent has determined that the project will mt have a significant inq�act
on the envir�ment and a negative d�eclaratiori has bee.n prepaz�ed; and

testimony and argt,une.nts of all interested perso��s c3�esiring to be heard, said
city council did firld the following facts to exist to justify their actions:

1. Tt�e design of the precise plan oca�lies with standards of the office
professioa�al z�ne.

1. The parr.el map is coilsistent and implelnents the requirements of the
City of Palm Desert Subdivision Ordinance, State Map Act and
oonditions of approval of the precise plan.
NCJW, Tf�REFORE, BE IT RF,SOLVID by the City Council of the City of Palm
Desert, California, as follows:
1. That the abave recitations are true and correct and oanstitute the
fis�dings of the council in this case.
2. That the Negative Declarati� of �nvirorYnental Impact, �hibit "A",
Precise Plan 88-9 and Pam.el Map 23770 on file in the deparbnent of
community development are hereby apprdved subject to attaciied
conditions.

1. The develognent of the prope.rty shall oaiform substantially with exhibits
on file with the depar-bnent of ocmrnuLity dev�elapnent/plar��g, as modified
by the follawix�g conditiar�s .
2. Constxuction of a porti� of said proj ect shall oo�mieix;e within one y�ear
from ti�e date of final appro�val unless an extensiori of time is granted;
otherwise said approval shall become null, void and of no effect

3. The de�veloprt�ent of the prnperty described herein shall be subject to the

municipal ordinances and state and fed�aral statutes rx7w in force, or which

4. Prior to issuance of a building pe.nnit for oa�stxuction of arYy use
coaztemplated by this app�aval, the applicant shall first obtain permits
and/or cleararyce fran the followir�g agencies:

Et�iderice of said pennit or clearanc.e frcm the abave agencies shall be
presented to the deparbnent of building and safety at the time of issuat�ce
of a building pennit for the use aont�lated hex�with.
5. Trash provisions shall be appr�oved by applicable trash ao�any and city
prior to issuar�ce of building permit.
6. Applicant shall pay sci�ool in�act fees as arranged by the Desert Sar�d.s
Unified Sctyool District.
7. Project shall be subject to Art in Public Places fee per Ordin,ance No.
473.
8. Applicant agrees to maintain the landscapir�g required to be installed
pursuant to these c�r�dttioc�s. Applicant will enter into an agreement to
maintain said lan�ctscaping for the life of the project, which agreecne,nt
shall be mtarized and which agreement sY�all ' be reoorded. It is the

specific intent of the parties that this ooa�d.iticn and agreemerit n�n with
ti�e land aryd bind successors and assigris.
Deparfin�nt of Public Wo�ks:
1. Drainage fees, in accordance with Section 26.49 of tt�e Palm Desext
Ni�u�icipal t',ode and Palm Desert Orciinance No. 507, shall be paid p�ior to
issuan�e of grad.isx,� permit.
2. Signalizati� fees, in acoordaryce with City of Palm Desert Resolution Nos.
79-1? arxi 79-55, shall be installed in aaa�rdan�ae with applicabie city
�.
3. Full public impravements, as required by Secti�s 26.44 and 26.40 of the
Palm Dese.rt Municipal Code, shall be installed in accordance with
applicable city standards.
4. As required under Palm Desert Municipal Cbc�e Sectioci 26.28, and in
accordance with Sectior�,s 26.40 and 26.44, vcn�lete i��ovan�nt pians and
specificatio�s shall be submitted to the director of public wc�rks for
checking and approval before construction of any improvements is
oarme.nc,ed. Off-site i�rovement plans to be app�av�ed by public works
departnent and a surety posted to guarantee the installatirn of required
off-site i�r�avements prior to issuanr,e of grading pexmit. Such off-site �
i�ro�vements shall include, but not limited to, curb an�d guttex, asphalt
paving and oor�crete sidewalk in an appr�apriate size and oonfiguratiori.
"As-built" plans shall be submitted to, arri appro�ved by, the director of
public wc�rks prior to the acceptarx�,e of the im�rwements by the city.
5. Al1 private driveways and parking lots shall be inspected by the
er�gineeri.ng departrnent and a standard inspection fee shall be paid prior
to grading pennit issuance.
6. As required under Sectio� 12.16 and 26.44 of the PaLn Desert Municipal
God�e, all existiryg utilities shall be unde:�grcxu�ded per each respective
utility district's recommendation. If determinsd to be unfeasible,
applicant shall agree to participate in any future utility
ciistxict.
7. In accordance with Palm Desert Municipal Code Section 26.44, ca�lete
graciirx� plans and specifications shall be sutYnitted to the director of
public w�orks for checking and appraval prior to issuance of any pe.rntits.
8. As required by Sections 26.32 and 26.40 of the Palm Desert Municipal Code,
and in acoordance with the Circulation Network of the city's General Plan,
d+edication of half-sta�eet right-of-way at 3Q feet on Santa Rpsa Way shall
be provided prior to recordation of the fin31 map.

10. Canplete parcel map shall be sutmitted as required by ordi.nar�ce to the
di.rector of public works for ctveckir�g and appraval and be recorded before
issuarbce of any pernLits .
11. Any and all off-site impravements shall be preceded by the approval of
plans and the issuance of valid encroarhme.nt pernLit( s) by the departmerit
of public works.
12. A complete prelinunazy soils investigatioaz, oo�icted by a registered
soils erx�irbeer, shall be sutx[titted to and appraved by th�e deparbnent of
public works prior to issuance of th�e grading pezmit.
13. Waiver of access to Fred Waririg Drive, Santa Rosa Way and San Pablo Avenue
except at appxx�aved locati�s shall be granted on the final map.

The fire department recommends the follawir�g fire protectiaz measures be
provided in acaordance with Uniform Fire Cod�e and/or reoognized fire protection
standards:
1. The fire departrnent is req�ired to set a mini�rnun fire flaw for the reR�odel
or ooa�structi� of all oa�x•cial buildings per UnifoYm Fire Qxle Sectiori
10.301C.
2. Provide, or show there exists a water systan capable of pravidirr3 a
potential fire flaw of 3,000 gpm and the actual fire flaw available frcm
any one hydrant aocuiected to arYy given water main shall be 1, 500 gpm for
two haurs duration at 20 psi residual aperating pressure.
3. A fire flaw of 3,000 ggn for a two Yxwr duratian at 20 psi residual
operating pressure must be available before any oanbustible material is
placed ori the j ob site .
4. The required fire flaw shall be available frcm a supe�c hydrant (6" x 4" x
2-1/2" x 2-1/2" ), located r�ot less than 25' ryor mr�re than 165' frcm arYy
portion of the building(s) as measured along approved vehicular
travelways. Hydrants installed belaw 3,000 foot elevation shall be of the
"wet barrel" type.
5. Pr+o�vide written cextification fr�m the Coachella Valley Water District
that hydrant(s) will be installed and will produce the required fire flaw,
or arrange field inspection by the fire deparbnent prior to request for
final inspection. '�

6. Access into parkirig lot and around bv.ildirx�s for fire departrnPnt vehicles
must be checked and appraved by fire marshal's office.
7. Install a cat�lete fire sprinkler system per NFPA 13. Tt�e post indicator
valve and fire departrnent connectioaz shall be located to the front, not
less than 25' fran the buildirig and within 50' of an approved iYydrant.
Must be combined system with stanc�ipes in staiiwells.
8. Install a fire alaim (waterflaw) as required by the Uniform Building C,ode,
3803, for sprinkler system.
9. Install tamper alasm on supply valve for sprinkler systems. Nbust als�
ring bell on buildux,� outside alarm.
10. Certain designated areas will be required to be maintained as fire lanes.
11. Ccmtact the fire departrne�zt for a final inspecti� prior to occupancy.
