Wf�RFAS, the Palm Desert City Council did on the 28th day of April, 1988 hold a duly advertised public hearing to consider said amenc�nent; and WIHERF�S, after extensive discussions between the City of Palm Desert, Salt Cedar l�aneowners, and Lewis Hanes this amenc�nen� was forniulated. to alleviate the ooncerns expressed by the residents on Salt Cedar; and WHERF�.S, all required �indirlgs for apprc7val can be made affirrnatively and supported as setforth in a staff report dated April 28, 1988 arid attached hereto a.s Exiitbit A. NC7W, THEREFt�RE, BE IT RESOLVF� that the City Council of the City of Palm Desert, cbes hereby adopt Resolution No. 88-42 appravir�g said amenc�nent to Tract Map 11636 by approving Map 23485, subject to ttie follawing condition: 1. That agresnent stipulates that all litigation involving the parties will terminate upon approval of this ameru�nent . ` - ^ The amer�.nt acca�lishes the follawing: 6`� 1. Rem�v�es the lots fonnerly abuttir�g the Salt Cedar HaneawnP.rs. 2. Relocates Desert Holly Drive rx�rthexly to abut the rear of the Salt Cedar parcels. 3. Lawers the street and paz�cel elevatior�s in tt�e area. 4. CYeates six additioa�al residential lots to mitigate the oosts of items 1 through 3. The lots in questioai are all above 10,000 square feet in area and all will side on to Desert H�olly. As aouncil will recall Lewis Fianes was prohibited fr�cm constructing hanes on eleven lots abutting properties o� Salt Cedar. The prohibitio�n was generated because of objections raised by proper�ty awneis avex the lot elevations. Lewis Homes subsequently filed suit for release of aonstruction peim.its. After an extensive series of negotiatio[�.s between Palm Desert, Salt Cedar l�wners, and Lewis Hanes this amendment to the map was agreed upon. The city attorney d+eteYmined that a public hearing should be conducted by the cauncil to formalize the proposed agreement. The map as ame,rx3ed meets all code requirements and continues to meet the findirx�s nec.essary for approval of Tract Map 11636. 1. It is con.sistent with the city's adopted general plan in that the density remairLs belaw that identified in the city's gen�eral plan. 2. The impraysnents and density pmposed are cansistent with Palm Desert adapted general and s�pecific plans and zoning ordinance in that no variances are required for apprr�val and development. The proposed amended map is in the interest of furthering the health, safety and general welfare of the area in that it has been accepted by adjacent residents and alleviates the ooricern voiced by those residents to map 11636-5. Because of th,e abave staff reoanne.nds app�r�val of said amenc�nent subject to the executi� of acceptable agreements by the city attorney.
