California, did on the 20th day of October, 1987 hold a duly noticed public hearinq wtiicli was continued to December 15. 1987 to consider approval of a neqative declaration of environmental impact and preannexation zoning of 160 acres in the southeast quarter of Section l0 lie: the area south of the Lakes Country Club. north of 42nd Avenue and east of the present city boundaryl. WFiEREAS, the Planninq Corr�nission has recommended approval of the preannex- ation zoning and negative declaration of environmental impact by its Resolution No. 1268. WHEREAS, the City Council of the City of Palm Desert did hold a duly noticed public hearing on January 14, 1988. WHEREAS, at said public hearir�g. upon hearinq and considerinca all testimony and arguments, if �ny. �f all interested persons desirinq to be f►eard. said city council did find t.he followinq facts and reasons to exisfi to just i fy cert i f i cat i on of the r�ev,(�t i ve dec 1�rr�t i on of env i ronment�3 I i rnpac: t: 1. The area sub ject to tiie preannexa� i on change of zone ( 160 acres i n the southeast quarter of sect i on l 0> i s w i tf� i n the C i ty of F'a 1 rn Desert Sphere of Influence as established by LAFCU. 6. The City of Palm Desert is desirous of annexing said area to the city. 7. Prior to filing the necessary application with LAFCO to annex the area to the city tfie citv must prezone the area. 8. The proposed prezoninq protects the public health, safety and generel welfare. NOW. THEREFORE, BE IT RESOLVEU by the City Council of the City of F'alm Desert, Californta, as follows: l. That the above rec i tat i ons are true and correct and const i tute tl�e findings of the council in this case. 2. That a negative declaration of environmental impact, Exhibit "A", is hereby certified. Section 15U83 of the California Administrative Code. CASE N0: C/Z 87-11 APPLICANT/PFtOJECT SPONSOR: CITY UF PALM DESERT PROJECT DESCRIPTION/LOCATION: A negative declaration of environmental impact and preannexation zoninq of 160 acres i n the southeast quarter of Sect i on 10 ( i e: the area south of the Lakes Country Club, north of 42nd Avenue and east of the present city boundary). City zoning shall be similar to the existinq county zoning in that the entire area will be prezoned planned residential five dwellinq units per ecre (PR-5) except for the 20 ar_re Good Samaritan VfllaaP stte which will he zoned planned residenttal ten unit� per acre (Pf�-10) and the 4� acre propertY i n the northeast corner of the sut� iect area wt� i ch i n add i t i on to tiie PR-5 zone will have a Senior Overlay (S.U.) whicl� will permit senior housinq to be constructed at dens i t i es ��t�ove the base zone and the 31 ��cres north of Good Samaritan which will be �rezor�ecl PR�-4 (planned residential four units per acre).
