the 14th day of July, 1988 hold a duly r�oticed public hearing to ooc�.sider a
request by Cook Hovley Street Associates for a Negative Declarati� of
�virormental Irt�act for the above proj ect .
Wf��2F'AS, as said application has ocn�lied with the requirements of the'
"City of Palm Desert Procedure for Implementation of the California
Environmental Quality A�ct, Resolution No. 80-89", in that the director of
envirnnmental services has deteYmtned that the project will not have an
adverse inq�act on the t and a ne3ative declaration of tal
inq�act has bee.n prepared.
WHEREAS, at said public hearing, upon hearing and considerir�g all
testimoa�y and an�mients, if any, of all interested person desirirr� to be heard,
said city oour�cil did find that the use of the property as senior citizen
housarig ar�cl the design of the precise plan with required mitigaticai meas-�zres
will not result in significant aclverse in�acts on the environment.
NOW, THg2EFC�RE, BE IT RESOLVm by the City Coiuzcil of the City of Palm
Desert, Califoxnia, as follaas:
1. That the at�we recitations are txue and correct and coa�stitute the
findir�gs of the oau�cil in this case.
2. That the City Q�u�il dae.s hereby appzr�v�e a Negative Declaratian of
tal L�act, E�hibit "A", for Cases GPA 87-6, C/Z 87-13 and
PP 87-37 and related develo{�ient agreement.

PROJDCT DESC�uPTION/LOCATION: 612 apartment units on the south side of
Hovley Lane, approximately 1300 feet east of Portola Avenue.
The Director of the Departinent of Cornrn.uzity Develo�xne.nt, City of Palm Desert,
California, has found that the described project will not have a significant
effect on the environment. A copy of the Initial Study has been attached to
document the reasons in support of this find.ing. Mitigation measures, if any,
included in the project to awid potentially significant effects, may also be
found attached.

3. WATER
b. A portion of the 25 acre parcel exists as a retention basin. The
prcperty directly west is not drainiix� currently. Therefore, it is
unclear at this time what absorption or drainage pattern will occur.
As a mitigation measure a soil percolation calculation and drai.nage
study will be required to shaw the land can, within reason, be
developed as a park or that the developer will provide alternative
drainage facilities.
5. ANIMAL LIFE
'Phe site is in the designated fringe-toed lizard habitat area. � As a
mitigation measure at the t�me of grading or construction, whichever
cames first, $600 per acre mitigation fees will need to be paid.
11. LAND USE
The proposal if appraved would result in a change from the proposed park
site to residential. As a mitigation measure, the city will require by
development agreement the alternate location of 30 acres of land in the
north sphere.
12. OPIN SPACE
The proposal would reduce the proposed sand dunes park by 30 acres.
Mitigation - the same as number 11.
16. TRANSPORTATION/CIRCVLATION
The proposal, if approved, wr�uld result in additional vehicular movetrient.
As part of the conditions of approval the applicant shall be required to
provide full public improvements providing half street .improvernents
including median island, 24 feet of paving and concrete curb and gutters,
as well as contribute to the citywide signalization fund in their
proportionate share.
The project should generate approximately 4300 trips per day. The design
capacity of Portola Avenue is for 24,000 vehicle trips per day and is
currently used for 5,000 vehicle trips per day. The design capacity of
Hovley Lane is for 12,000.

The applicant shall pay fire facilities fees to offset the cost of
increased services.
The applicarzt shall pay fees as deterrnined by Desert Sa�zds Unified
School District.
The applicant shall provide an alternative 30 acres of park land by
develo�ment agreement to mitigate the loss of 30 acres on this site.
