The City Council of the City of Palm Desert, California, does hereby DETERMINE, ORDER, and RESOLVE as follows: I That it intends to, and by this resolution does, initiate proceedings under the provisions of Part 3, Division 9, of the Streets and Htghways Code, to vacate a public utlltty easement over a portion of Lot 33, MB 28/18-19, 1n the City of Palm Desert, California, more particularly described 1n Exhibit "A", attached hereto. II That the hour of 7:00 p.m. on the 12th Council Chamber, 73-510 Fred Waring Dr1ve, Palm fixed as the time and place of hearing all persons the proposed vacation of said street. IlI day of October, 1989, in the Oesert. California, is hereby lnterested in or obJecting to That the Clty Clerk is hereby instructed to publish notice of said hearing in the Palm Desert Post once at least ten (10) days before the dete of the hearing, and the City offictals of the City of Palm Desert are hereby instructed to post notice of such vacatlon, as required by law, at least ten (l0) days before the day set for hearing. LECAL DESCRIPT[ON That portion of Lot 33 of Shadow Mountai� Park Estates Unit No. 1. as per Map recorded tn Book 28, Pages 18 and l9 of Maps, in the Office of the County Recorder of Riverside County, State of Californla, more particularly descrtbed as betng 5.0 feet 1n width defined by the following centerllne: Beginning at the Northeast corner of sald Lot 33; Thence, South 89 44'35" West a distance 94.60 feet; Thence, South 0 15'25" East a distance 5.0 feet, to the TRUE POINT OF BEGINNING. Thence, South 0 15'25" East a distance of 90.00 feet, to a point on the Southerly property line of said Lot 33.
