CERTIFYING AN ENVIRONMENTAL 1MPACT REPORT AND APPROVING AN AMENDMENT TO THE GENERAL PLAN AND COMMERCIAL CORE AREA SPECIFIC PLAN CASE N0. GPA 89-1 THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY FINOS. DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: Section 1: The City Council hereby certifies that the Final Environmental Impact Report for the Ahmanson Commercial Development Plan (the "Finai EiR") anatyzes al1 potential environmental impacts with respect to the Project (as defined therein) and was completed pursuant to and in compiiance with the existing procedures of the City for the implementation of the California Environmental Quality Act and guidelines promulgated with respect thereto and that the City Council has reviewed and considered the contents of the Final EIR prior to deciding whether to approve such Project including. but not limited to� the amendment of the General Plan and the Commercial Core Area Specific Plan as hereinafter referenced. With respect to each of the potentially significant environmental impacts of the Project identified in the Final EIR. the City Council has independently reviewed and hereby adopts the findings (attached hereto as Exhibit "A"} and on the basis thereof hereby finds that changes or alterations have been required in or been incorporated into the Project which avoid or substantially lessen those impacts. Ail mitigation measures recommended by the EIR as conditions of Project approval are hereby adopted and made conditi�ons of Project approvai, including, but not limited to, the amendment of the General Plan and Commercial Core Area Specific Plan as hereinafter referenced. Section 2: The City Council hereby adopts a mitigation monitoring program for the changes or aiterations to the Project which have been incorporated into the Project or made a condition of Project approval in Section 1 of this resolution. The Director of Community Development shall ensure that all mitigation measures adopted in Section 1 of this resolution shall be fully implemented and completed. In addition, approval of subsequent development proposals pertaining to the Project shall include, as a condition of Project approval. all applicable mitigation measures required by Section 1 of this resolution. RESOLUTION N0. 89-120 Section 3: The Pianning Commission of the City of Palm Desert has recommended approval of proposed General Plan and Commercial Core Area Specific Plan amendments as hereinafter referenced. Section 4: Pursuant to notice duly given, the City Council has held a fu)1 and fair joint public hearing pursuant to law on the proposed General Plan and Commercial Core Area Specific Plan amendments hereinafter referenced and the City Council has duly considered the recommendations of the Planning Commission and all evidence for and against such proposed amendments. All objections to the proposed General Plan and Commerciai Core Area Specific Plan amendments hereinafter referenced were heard and passed upon by the City Council and are hereby overruled by the City Council. Section 5: General Plan and hereto as Exhibit Council and which hereby approved.
