A RESOlUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, INITIATING PROCEEDINGS TO VACATE A PORTION OF
RIGHT-OF-WAY KNOMN AS SAN NICHOLAS AVENUE UNDER THE PROVISIONS
OF PART 3, DIVISION 9, OF THE STREETS AND HIGMWAYS CODE, AND
FIXING A T1ME AND PLACE FOR HEARiNG ALL PERSONS INTERESTED IN
OR OBJECTING TO THE PROPOSED VACATION.
The City Council of the City of Palm Desert, California, does hereby
DETERMINE, ORDER. and RESOLVE as follows:
I
That it intends to� and by this resolution does, initiate proceedings
under the provisions of Part 3, Division 9, of the Streets and Highways Code, to
vacate a portion of public right-of-way described as a portion of San Nicholas
Avenue in the City of Palm Desert, California, more particularly described in
Exhibits "A" and "B", attached hereto, subject to and retaining any and all
public utility easements existing upon or under said public right-of-way.

That the hour of 7:00 p.m. on the llth day of May. 1989, in the Council
Chamber, 73-510 Fred Waring Drive, Palm Desert, California, is hereby fixed as
the time and place of hearing all persons interested in or objecting to the
proposed vacation of said street.

That the City Clerk is hereby instructed to publish notice of said
hear 1 ng i n the Pa 1 m Desert Post once at 1 east ten ( 10 ) days before the date of
the hearing, and the city officials of the City of Palm Desert are hereby
instructed to post notice of such vacation, as required by law, at least ten (10)
days before the day set for hearing.
PASSED, APPROVED, and ADOPTED by the City Council of the City of Palm

RESOLUTION NO. 89-54
C12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
co CALIFORNIA, VACATING A P3RTION OF RIGHT -OF -NAY KNOWN AS SAN
NICHOLAS AVENUE IN SAID CITY UNDER THE PROVISIONS OF PART 3,
DIVISION 9, OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF
CALIFORNIA.
WHEREAS, the City Council initiated proceedings to vacate a portion of
a street In the City of Palm Desert, more particularly described in Exhibits "A"
and "B", attached hereto, and the City Council finds that said notices of such
vacation were published and posted, as required by law; and
WHEREAS, the City Council on the llth day of May, 1989, held a public
hearing, as required by law, at which hearing all persons Interested In or
objecting to the proposed vacation were heard, and said public hearing was duly
and regularly closed; and
WHEREAS, the City Council of the City of Palm Desert considered such
matter and finds from the evidence submitted that portions of the street
described in Exhibits "A" and "B" are unnecessary for present or prospective
public purposes.
NOW, THEREFORE, the City Council of the .City of Palm Desert,
California, DOES HEREBY RESOLVE AS FOLLOWS:
That the following described portions of right-of-way known as San
Nicholas Avenue in the City of Palm Desert be vacated subject to and retaining
all public utility easements existing within said public right-of-way. Said
portion of street to be vacated Is located in the City of Palm Desert, County of
Riverside, State of California, and is described as set forth In Exhibits "A" and
"B", attached hereto.
That the vacation of this portion of right-of-way Is.subject to and
contingent upon the completion of City of Palm Desert Precise Plan No. 89-02,
Palm Desert City Council Resolution No. 89-32. In the event that the project
approved as Precise Plan No. 89-02 Is not completed, the effect of this street
vacation shall become null and void.

The City Clerk of the City of Palm Desert, California; shall cause a
certified copy of this resolution and order to be recorded in the Office of the
County Recorder of Riverside County, California.
