WHERE�S, the City Council of the City of Palm Desert, California, did on tlle 13th da�•
of April, 1989 hold a duly noticed public hearing to consider a request by RAY arld
'vIARGARET LACERTE for approval of the above mentioned project.
WHEREAS, said application has complied with the requirer�ients of the "City of Palm
Desert Procedures for Implementation oP the California Environmental Quality Act,
Resolution IVo. 80-89", in that the director of community development has determined that
the project will not have a significant impact on the environment and a negative
declaration is hereby reconimended for certification.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments oP all interested persons desiring to be heard said council ciid Pind the
Pollowing facts to exist to justify their actions.

The design of the precise plan will not substantially depreciate property values in
the vicinity.
The precise plan will not unreasonably interiere with the use or enjoyment of
property in the vicinity by the occupants thereof for lawful purposes.
The precise plan will not endanger the public peace, health, safety or general
welPare.
NOW, TfiEREEORE, BE IT RESOLVED by ttie City Council oP the City oP Palm Desec•t,
as follows:
1. That the above recitations are true and correct and constitute the findings of the
council in this case.
PASSED, APPROVED and ADOPTED at a regular meeting oP the Pa1m Desert City

Department of Community Development:
1. The development of the property shall conform substantially with exhibits on file
with the department of community development, as modiYied by the following
conditions.
2. Construction of a portion of said project shall commence within one year Prom
the date oP second reading bePore city council, or one year after first reading
unless an extension oP time is granted; otherwise said approval shall become null,
void and oP no efPect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and Pederal statutes now in force, or which hereafter may be
in force.

Prior to issuance oP a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:

Public Works Department
Palm Desert Water and Services District

Evidence oP said permit or clearance from the above agencies shall be presented
to the department of building and safety at the time of issuance of a building
permit for the use contemplated herewith.
All future occupants of the building shall comply with parking requirements of the
ordinance and shall be limited to ofPice professional uses.
Homes shall be demolished by permit prior to lot consolidations.
Lot consolidation shall be recorded prior to second reading of zone change.
Precise plan contingent upon approval of zone change.
Recorded scenic easement shall be required along southerly property line with a
25 foot setback from San Luis Drive.

Final biiilding design to meet O.P. standards for parking, building height, setbacks,
etc., and include vai•iation along San Luis Drive.
Demolition permit shall first be obtained prior to <iernolition of existing homes.
Applicant to pay applicable art in public places and school fees.

east and west shall be recorded prior to building permit issuance.
Department of Public Works:
1. Drainage fees, in accordance with Section 26.49 of the Palm Desert :�funicipal
Code a>>cl f'alm Desert Ordinance No. 507, shall t�e paid prior to issuance of
grading permit.

Storm drain constriiction shall be contingent upon a drainage study prepared by a
civil engineer that is reviewed and approved by the Department of Public w'orks.
Signalization fees, in accordance with City of Palm Desert Resolution �1o's. 79-17
and 79-55, shall be paid prior to issuance of grading permit.
Full public improvements, as required by Sections 26.44 and 26.40 oP the Palm
Desert Municipal Code, shall be installed in accordance with applicable city
standards.
5. As required under Palm Aesert Municipal Code Section 26.28, and in accordance
with Sections 26.40 and 26.�4, complete improvement plans and speciPications shall
be submitted to the Director of Public Works for checking and approval before
construction oP any improvements is commenced. Off—site improvement plans to
be approved by Public Works Department and a surety posted to guarantee the
installation oP required oPf—site improvements prioi• to issuance of grading permit.
Such off—site improvements shall include, but not limited to, curb and gutter,
asphalt paving and concrete sidewalk in an appropriate size atld configui•ation.
"As—built" plans shall be submitted to, and approved by, the Director of Public
Works prior to the acceptance of the improvements by the city.

All private driveways and parking lots shall be inspected by the engineecing
department and a standard inspection fee shall be paid prior to grading permit
issuance.
Landscaping mairitenance on Fred Waring Drive and San Luis Drive shall be
provided by the property owners.
8. As required under Section 12.16 and 26.44 of the Palm Desert Municipal Code, all
existing utilities shall be undergrounded per each respective utility district's
recommendation. If determined to be unfeasible, applicant shall agree to
participate in any future utility undergrounding district.

In accordance with Palm Desert Municipal Code Section 26.-�4, complete grading
plans and specifications shall be submitted to ttte Director oY Public Works for
checking and approval prior to issuance of any permits.

Size, number and location of driveways to public works specifications with only
two driveway approaches to be allowed to serve this property.
Complete parcel map shall be submitted as required by ordinance to the Director
oP Public Works for checking and approval and be recorded before issuance of any
permits.
Any and all off-site improvements shall be preceded by the approval of plans and
the issuance of valid encroachment permits by the Department oP Public Works.
� complete preliminary soils investigation, conducted by a registered soils
engineer, shall be submitted to and approved by the Department of Public Works
prior to issuance of the grading permit.
City Fire Marshal:
1. Provide, or show there exists a water system capable of providing a potential fire
flow of 3,000 gpm and the actual fire flow available Prom any one hydrant
connected to any given water main shall be 1,500 gpm Por two hours duration at
20 psi residual operating pressure.
2. A fire Plow of 3,000 gpm Por a three hour duration at 20 psi residual operating
pressure must be available before any combustible material is placed on the job
site.
3. A combination of on-site and off-site super hydrants (6" x 4", 2 x 2-1/2" x 2-
1/2"), will be required, located not less than 25' nor more than 150' from any
portion oP the building(s) as measured along approved vehicular travelways. The
required Pire flow shall be available from any adjacent hydrant(s) in the system.
4. Prior to the application for a building permit, the developer shall Purnish the
original and two copies of the water system plan to the County Fire Department
for review. No building permit shall be issued until the water system plan has
been approved by the County Flre Chief. Upon approval, the original will be
returned. One copy will be sent to the responsible inspecting authority.
5. Plans shall conform to fire hydrant types, locations and spacing, and the system
shall meet the Pire flow requirements. Plans shall be signed by a registered civil
engineer and may be signed by the local water company with the Pollowing
certification: "I certify that the design of the water system is in accordance with
the requirements prescribed by the Riverside County Fire Department".

Install portable fire extinguishers per NFPA, Pamphlet #10, but not less than

12. All buildings shall be accessible by an all—weather roadway extending to within
150' of all portions of the exterior walls of the first story. The i•oadway shall be
not less than 24' oP unobstructed width and 13'6" oP vertical clearance. Where
parallel parking is allowed, the roadway sl-�all be 36' wide with parking on both
sides, 32' wide with parking on one side. Dead—end roads in excess of 150' shall
be provided with a minimum 45' radius turn—around (55' in industrial
developments).
13. Whenever access into private property is controlled through use oP gates, barriers,
guard houses or similar means, provision shall be made to facilitate access by
emergency vehicles in a manner approved by the fire department. All controlled
access devices that are power operated sha11 have a radio contc•olled override
system capable of opening the gate when activated by a special transmitter
located in emergency vehicles. Devices shall be equipped with backup power
facilities to operate in the event oP power failure. All controlled access devices
that are not power operated shall also be approved by the Pire department.
Minimum opening width shall be 12', with a minimum vertical clearance oP 13'6".

Occupancy separation will be required as per the C;niPorm Building Code, Section
503.
Provide suitable fire department turnaround area at end of parking lot.
Contact the Pire department for a final inspection prior to occupancy.
All questions regarding the meaning of these conditions should be referred to the
fire department Pire protection;'inspection staff.
