4V��FtEAS, the City Council of the City of Palm Desert, California, did on
the 13th day of April, 1989, hr�ld a duly noticed public hearing to consider
approval of a Negative Declaration of Environn�ntal Impact and a Precise Plan
of Design for a 48,000 square foot office complex on four acres at the
northeast corner of Country Club Drive and Portola Avenue; and
LVF�RFAS, said application has canplied with the requirements of the "City
' of Palm Desert Procedures to Implement the California �viu�oc�mental Quality
. Act, Resolution No. 80-89", in that the director of canrnuLity developnent has
� deteimined that the proj ect will . not haue an. adve�se• ir�act , on_ the �nvi:ronment ,�.: .�

WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said city
council did find the follawing facts and reasons to justify approval:
1. The design of the proposed site.plan and buildings meet or exceed the
standards contained in the Office Professional zone, the General Plan
and the pendicx� North Sphere Specific Plan.
2. The proposed project is designed to be ca�atible with adjacent
residential and future office professional use, will not depreciate
adjacent property values, restrict the lawful use thereof, nQr will
it present a threat to the public health, safety or general welfare.
NC7W, TI-iEF2EFORE, BE IT RESOLVID by the City Council of the City of Palm
Desert, California, as follaws:
l. That the abave recitations are true and correct and constitute the
findirx�s of the council in this case.
2. That a Negative Declaration of �virorunental Impact, E�zibit "A" , and
PP 89-1 are hereby approved.

1. The develo��ent of the property shall aonform substantially with exhibits
on file with the departrne.nt of camnuiity develognent/planning, as modified
by the follawing conditions.
2. Prior to the issuance of a buildirx� permit for oon.stxuction of any uses
contemplated by this approval, the applicant shall first ocmplete all the
procech�ral requirements of the city which include, but are r�t limited to,
architectural cannission and building permit procedures.
3. Construction of a portion of said project shall oaRnence within one year
frcm the date of final appraval unless an extensian of time is granted;
otherwise said approval shall become null, void and of no effect
whatsoever.

contemplated by this approval, the applicant shall first obtain pe�Lits

Riverside County Departznent of Health
6. That prior to issuance of building permit the owner (developer) pravide
the city with evidence that he has paid the req�.Lired sctx�ol mitigation
fee.
7. Applicant shall ea�ecute and record mutual access agregnP.nts with awners of
ad j acent properties .
8. The roof hatch areas shall be equip�ed with steel hatches and inside
locking devices to prevent forcible entxy.
9. Builduzgs shall be setback a mirii.m�un of 35 feet fran curb lines. Entire
setbacks shall be landscaped.

14. Builcling height shall rnt exceed 25 feet.

1. Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code and PaLn Desert Ordinance No. 507, shall be paid prior to

3. Signalization fees, in acaordance with City of Palm Desert Resolution Nos.

Palm Desert Municipal Code, shall be installed in accordance with
applicable city standard.s.
5. As required under Palm Desert Municipal �e Section 26.28, arxl in

specifications shall be subm.itted to the director of public w�rks for
checking and approval before construction of any improvements is
commenced. Offsite i�rovemP..nt plans to be approved by public wc�rks

offsite improvements prior to gradir�g permit issuarx�e. Such offsite
i�rwemer�ts shall include aor�crete sid�walk in an appx�apriate size and

6. All private driveways and parking lots shall be inspected by the

1. The fire departrnent is required to set a mi.r�itrn.an fire flow for the remodel
or oonstruction of all �mercial buildings per Uniform Fire Qode Section
10.301C.
2. Provide, or show there exists a water system capable of praviding a
potential fire flaw of 3000 gpn arid the actual fire flow available from
any oc-�e hydrant c�nected to ariy given water main shall be 1500 gpn for 3
hours duratiori at 20 psi residual operating pressure.
3. A fire flaw of 3000 gpm for a 3 hour durati� at 20 psi residual operatir�g
pressure must be available before any cani7ustible material is placed on
the job site.

4. A oca�binatia� of ocz-site and offsite Super fire hydrants (6" x 4" x 2 1/2"
x 2 1/2"), will be required, located mt less th,an 25' or more than 150'
from arry portion of the building( s) as measured along apprn�ved vehicular
travelways. The required fire flaw shall be available f�c�crn any adjacent
hydrant( s) in the systesn.
5. Tt�e requ�.red fire flaw may be adjusted at a later point in the permit
process to reflect cha�ges in design, ooa�stxuctio� type, area separatio�s,
or built-in fire protectio� measures.
6. Prior to the application for a bu.ildir�g pennit, the develaper shall
furnish the original and two oopies of the water system plan to the Caulty
Fire Depar�t for review. No building pPxnu.t shall be issued until the
water system plan has beP_n ap�x�oved by the CYxinty Fire Chief . Upon
apprwal, the original will be returned. One oopy will be sent to the
responsible inspecting authQrity.
7. Plans shall voriform to fire hydrant types, locati� ar�d spacing, ar�d the

9. Install a fire alaYm (waterflaw) as required by the Uniform Building Code,

10. Install a tacriper alanm on supply valve for sprinkler systems. Must also
ri.rr3 building waterflaw alarm bell.
11. Certain designated areas will be required to be maintained as fire lane.s.
12. Install panic hardw�re and exit signs per Uniform Buildirig �de, Criapter
33, and/or Unifonr► Fire Code.
13. Install portable fire extinguishers per NFPA, Pamphlet #10, bt�t r�t less
than 2AlOBC in rating.
14. All buildii�gs shall be accessible by an all-w�eather roadway extending to
within 150' of all portions of the exterior walls of the first story. The
roadway shall be mt less than 24' of umbstructed. width and 13' 6" of
vertical ciearance.

15. OcCi�pancy sepax'atioaz will be required as per the Uniform Buildirig Code,
Sec. 503.
16. Provide alternate �ency access along Countxy Club Drive at eastern
most edge of property. A�ccess may be turf-blocked and c�elineated with
