RESOLUTION NO. 89-71
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, ORDERING THE FORMATION OF A LANDSCAPING AND
LIGHTING DISTRICT PURSUANT TO THE LANDSCAPING AND LIGHTING ACT
OF 1972 AND CONFIRMING THE DIAGRAM AND ASSESSMENT FOR ASSESSMENT
FOR ASSESSMENT DISTRICT 89-6 (MONTEREY MEADOWS) .
WHEREAS, the City Council of the City of Palm Desert, California, has
heretofore declared its intention, by Resolution No. 89-64, to create a
landscaping and lighting district in a portion of said City; and
WHEREAS, the City Engineer has filed a report to the City Council of
the City of Palm Desert and said report was approved by the City Council; and
WHEREAS, a Public Hearing as required by Section 22590 of the Streets
and Highways Code was held on this date, June 8, 1989.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert, California, as follows:
(1) Written and oral protests against the formation or extent of the
district or the work to be performed are hereby determined to be less
than fifty percent (50%) and all protests are hereby overruled.
(2) That said improvements to be part of said district as described as
follows:
Maintenance of existing landscape strip along northside of
Hovley Lane including all landscape materials, irrigation
system and street lighting system.
(3) The diagram and assessments, as originally proposed and as on file
with the City Clerk, are hereby confirmed.
The first levy of assessments shall be for the fiscal year 1989-90.
(4) That the City Council does hereby order the formation of a
landscaping and lighting district pursuant to Part 2 of Division 15
of the California Streets and Highways Code, within the City of Palm
Desert, which is located within the boundaries reflected on the
assessment diagram approved by the City Council on May 25, 1989.

INTRODUCTION
The City Council of the City of Palm Desert has established standards for
Street Lighting and Landscaping throughout the City of Palm Desert.
The requirement for the construction and installation of landscaping, lighting
and appurtenant facilities is a condition of development provided for in
City's Subdivision Ordinance and is a requirement of issuance of a permit for
construction of any commercial, industrial, and planned unit development.
Landscaping and appurtenant facilities generally include trees, shrubs,
plants, turf, and irrigation systems located in medians, parkways, and/or
easements adjacent to public right-of-ways, in and along major thoroughfares
and certain designated primary and secondary arterials as defined in the
General Plan's Circulation Element.
Lighting and appurtenant facilities includes poles, lighting fixtures,
conduits and the necessary equipment to maintain, operate and replace a
lighting system at designated intersections, in medians, parkways and adjacent
to certain public facilities in and along certain streets, right-of-ways and
The installation of landscaping and lighting systems and the construction of
the necessary appurtenant facilities is the responsibility of the property
owner/applicant, triggered by the approval of a development application.
The City may require the installation by property owners directly , or accept
financial arrangements for installation of these facilities as provided for by
the City 's ordinances and regulations.
The servicing, operation, maintenance, repair and replacement of the
landscaping, lighting and appurtenant facilities in turn becomes the
responsibility of the benefiting properties.
The City now has several Landscaping and Lighting Assessment Districts and is
accepting additional facilities with each subdivision and/or each development.
Additional applications for parcels of land are being processed and the
property owners/applicants petitioned for inclusion in the Landscaping and
Lighting Assessment District. These applications are in various stages of
processing, and when completed, will increase the City's obligation for
maintenance and servicing. Further subdivisions and development is expected
to add to this load.
The City of Palm Desert is administering a lighting system for the benefit of
all parcels of land within the City.

The lighting benefit is directly related to public safety and property
protection. These benefits have been studied widely, locally, regionally and
nationally, and are further referenced in the various reports listed at the
end of this introduction.
To insure a flow of funds for the ongoing maintenance and servicing to the
landscaping and lighting, the City is considering the formation of Assessment
District 89-6 for Landscaping and Lighting Assessment District. The formation
of this District will ensure a fair and equitable levying of the necessary
costs of servicing and maintenance of the respective facilities, which in turn
will enhance the value of each and every parcel in the District directly and
collectively.
The Proposed District boundaries of the Landscaping and Lighting Assessment
District are the boundaries shown on the maps consisting of Tracts 21791 and
22741.
Servicing and administration of the City's landscape maintenance program will
be administrated according to the provisions of the Landscaping and Lighting
Act of 1972, Part 2, Division 15 of the'Streets and Highways Code of the State.

ENGINEER'S REPORT PREPARED PURSUANT TO THE PROVISIONS
LANDSCAPING AND LIGHTING ACT OF 1972
SECTION 22500 THROUGH 22679
OF THE CALIFORNIA STREETS AND HIGHWAYS CODE
Pursuant to Part 2 of Division 15 of the Streets and Highways Code of the
State of California, in connection with the proceedings for:
PALM DESERT LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT NO. 89-6
Herein after referred to as the "Assessment District", I, Joseph Kicak, the
duly appointed ENGINEER OF WORK, submit herewith the "Report" consisting of
six (6) parts as follows:
PART A
Plans and specifications for the. propised improvements are filed .herewith arid
made a part hereof. Said plans and specifications are on file in the offices
of the Superintendent of Streets and City Clerk.
PART B
An estimate of the cost of the proposed improvements, including incidental
costs and expenses in connection herewith, is as set forth on the lists
thereof, attached hereto, and are on file in the Office of the Clerk of the
City.
PART C
An assessment of the estimated cost of the improvements on each benefited lot
or parcel of land within the Assessment District.
PART D
- A proposed assessment of the total amount of the costs and expenses of the
improvements upon the several lots and parcels of land within the Assessment
District, in proportion to the estimated benefits to be received by such lots
and parcels, is set forth upon the assessment roll filed herewith and made a
part hereof.

PART E
A list of the names and addresses of the owners of real property within this
Assessment District, as shown on the last equalized roll of the Assessor of
the County of Riverside, or as known to• the Clerk.
PART F
The Diagram of the Assessment District Boundaries showing the exterior
boundaries of the Assessment District, lines dimensions of each lot or parcel
of land within the Assessment District has been submitted to the Clerk. The
lines and dimensions of each lot or parcel within the Assessment District are
those lines and dimensions shown on the maps of the Assessor of the County of
Riverside, as they now exist.

The maintenance of planting, landscaping, irrigation systems and lighting and
of appurtenant facilities to be operated, serviced and maintained, is more
specifically described herein whereas, the landscaping and lighting facilities
have been provided by developers as a condition of subdivision of land. The
facilities to be maintained and services are more generally described as

Standard Number not attached, appeared to have been removed.
