CALIFORNIA, VACATING A PORTION OF RIGHT-OF-MAY KNOMN AS PALM OfSERT ORIVE SOUTH IN SAID CITY UNDER THE PROVISIONS OF PART 3, DIVISION 9, OF THE STREETS AND HIGF6iAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS, the City Council initiated proceedings to vacate a portion of a street in the City of Palm Desert, more particularly described in Exhibit "A", attached hereto, and the City Councii finds that said notices of such vacation were published and posted, as required by law; and WHEREAS, the City Council on the 8th day of June. 1989, held a public hearing, as required by law, at which hearing all persons interested in or objecting to the proposed vacation were heard, and said public hearing was duly and regularly closed; and WHEREAS, the City Council of the City of Palm Desert considered such matter and finds from the evidence submitted that portions of the right-of-way described as a portion of Palm Desert Drive South in the City of Palm Desert, California, more particularly described in Exhibit "A", attached hereto and made a part of. NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES HEREBY RESOLVE AS FOLLOWS: I That the following described portions of right-of-way known as Palm Desert Drive South in the City of Palm Desert be vacated subject to and retaining all public utility easements existing within said public right-of-way. Said portion of street to be vacated is located in the City of Palm Desert, County of Riverside, State of California, and is described as set forth in Exhibit "A", attached hereto. II That the vacation of this portion of right-of-way is contingent upon the completion of City of Palm Desert Precise Palm Desert Planning Commission Resolution No. 1342. In the project approved as Precise Plan No. 89-03 is not compieted, th street vacation shall become null and void.
