WE�2EAS, said application has ocnQlied with the requirements of the "City
of Palm Desert Pro�cedure fo� L�lgnentation of the Califo�nia �nri.raYnental
Quality Act, Resolution No. 80-89," in that the director of aatnauLity
c]�velognent has deteYmis�ed that th�e p�c�ject will rx7t hav�e a significant i�act
and a negative declaration is hex�eby adoQt,ed.
WE�REAS, at said public hearing,'� upon hearing and considering all
testimaYy and argunents, if any, of all interest,ed pe,rsaLs desiriz�g to be
heard, said city oau�cil did find the follawir�g facts and reason,s to exist to
justify granting app�aral of said p�+ecise plan:

l. Drainage fees, in accordance with Secticn 26.49 of the Palm DesPxt
Municipal C,ode and Palm Desert Ordinance Number 507, shall be paid
prior to issuaric,e of grading permit.
2. Storm drain construction shall be contingea�t upai a�ainage study
prepaz�ed by a civil ez�gineer that is reviewed and approved by the
Depar-bnent of Public W�o�its.
3. Signalization fees, in acoord�nce with City of Palm DesP.rt Resoluti�
Nos. 79-17 and 79-55, shall be paid p�ior to issuancs of grading pezmit.
4. F�11 public i�vements, as required by Sectia�s 26.44 and 26.40 of the
Palm Desert Municipal Code, shall be installed in accordance with
a.pplicable City starxiaz�cis.
5. As required under Palm Desert Municipal Cbc3e Section 26.28, ar�d in
acoordarx� with Sectia�s 26.40 and 26.44, a�Qlete impravement plans
and specifications shall be submitt�d to the Direcbor of Public Wo�k.s f�
checking and approval before construction of any improvements is
cornnenced. Offsite i�mov��ent plans to be app��ared by Public Wo�ks
Deparbnea�t and a su=�ety posted to guarantee the installation of required
offsite i�av��ts p�ior to issuar�ce of grading permit. Such offsite
i�v�zts shall inClude, but t�at limited to, Ctu�b and gutter, asp�halt '�'
paving arxi ca�cs�ete sidewalk in an ap��iate size and configuration.
"As-built" plans shall be sutmitted to, arxi ap�a�oved by, the Dir�ector of
Public Works prior to the accegtar�oe of the imp�ro�vpments by the City.
6. All private driveways and parking lots shall be inspected by the
engir�_rirr� depaz-tment ar�d a star�d�ard inspection fee shall be paid prior
t�o gradtx�g peimit issuar�ce.

8. As required ia�der Section 12.16 and 26.44 of the Palm De�azt M�icipal

utility district's recanmendation. If dete=mined to be imfeasible,
applicant stsall ag=�ee to participate in any fut�u�e utility ur�dergro�diix�
district .
9. In accoacda��oe with Pa]m De�eYt Maiicigal Cbcle Section 26.44, oar�lete
gradir�g plans and s�ecificatians shall be sutxnitted to the Director
of Public Wozks for checking and app�oval p�ior to issuance of any
permits .

10. As required by Sectioc�.s 26.32 and 26.40 of the Palm Desert M�u�icipal
God+e, dedtcation of right-of-way at fiv�e feet on San Pascual, Alessandrn,
and San Juan, (30' Half St.) shall be pravided prior to recordation of the
final map.

13. Any and all off-site improvecnents shall be p�er.ec�ed by the appraval
of plans and the issuance of valid encroachment permit(s) by the
DepaYtnent of Public Works.
14. A complete prelimirx�y soils investigaticn, caxhicted by a registered
soils er�gir�eer, shall be submitted to and appz�o�v�ed by the Department
�of Public Works prior to issliaryce of +the gradir�g peYmit.
15. Pad elevatior�s, as str�►m cn the preliminary site plan are subject to
review and modification in a000rdai�oe wi� Section 27 of the Palm Desert

16. Applicant shall remvve and reooc�u,�t the curb return and/or curb and

Fire r�*'sr�
1. The Fire Department is requix�ed to set a mir�irrnun fire flaa for the
r�model of caLstruction of all oa�m�ez�cial buildir�gs per Unifonn Fire Code
Sectiai 10.301C.
2. Provide, or show there exists a water system capable of pz�aviding a
potential fire flaw of 3500 gpn arYi the actual fire flaw available frcm
arYy a�e i�3rant ooc�eCted to atzy givea� water main shall be 1500 gpm for 2
hou=s duration at 20 psi resic�ual operatir�g p�+ess�u�e.
3. A fire flow of 3500 gpm for a 3 haur c�uration at 20 psi residual aperating
p�essure must be available before any oanbustible material is placed o�n
the job site.
4. A aanbination of on-site and off-site Super fire hydrants, (6" x 4" x 2
1/2" x 2 1/2" ), will be requ.ired, located r�ot less than 25' or more t.han
150' from any portion of the buildts�g( s) as measured alcng apprwed
vehicular trav�elways. The required fire flaa shall be available frcm ariy
2 adjacent hydrant(s) in the system.

WHEREAS, the City of Palm Desert, California. has completed the
installation of certain street improvements fronting a certain parcel of property
within the City of Palm Desert. California, under the p�ovlsions of Section l of
Ordinance 416.
NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert. California:
SECTION 1: That assessment against the subject parcel of land to
pay the cost of said improvements is hereby assessed in the amounts and against
the parcel of land as indicated in Exhibit "A" attached hereto and made a part
thereof .
