Folkers,ACM/Director of Public Works 71 s :� SUBJECT: RELEASE OF LIEN 3 DATE: January 8, 1998 RECOMMENDATION: By minute motion release the lien(assessment) on APN624-230-008. a M BACKGROUND: O In 1989, Palm Desert Gardens, did not execute the agreements for the Ordinance 416 project that affected their property on the northeast corner of Fred Waring Drive and Deep Canyon Road. As a result, a public hearing was held, Resolution No. 89-92 was adopted and a lien was recorded. Recently the City was contacted regarding the sale of the property and settlement of the lien. On December 11, 1997,the City received a check for the payment of the outstanding balance. Public Works staff recommends the City Council release the lien. RICHARD J. KERS,P.E. Folkers, Assistant City Manager/Public Works Director SUBJECT: NORTH SIDE FRED WARING DRIVE ORDINANCE 416 WIDENING FROM DEEP CANYON ROAD TO VALLEY PALMS ESTATES DATE: July 20, 1989 RECOMMENDATION: Waive further reading and adopt Resolution No. 89-92 placing a lien on a property affected by the subject Ordinance 416 widening project. BACKGROUND: The North Side Fred Waring Drive Ordinance 416 street widening project between Deep Canyon Road and Valley Palms Estates has been completed, and Public Works staff has received agreements from three of the four property owners affected by this project. One property owner has not properly executed the agreement between themselves and the City of Palm Desert. In order for the city to insure reimbursement for these improvements installed fronting their property, a lien must be placed on this parcel . The city attorney requested a public hearing be held in order to allow the property owner and others affected by this project a forum to voice their opposition or support. Public Works staff recommends that the City Council adopt this resolution placing a lien on a property affected by the Ordinance 416 improvements. 40101° RICHARI J. FOLKE P.E.
