Wf�REAS, the City Ca�uxil of the City of PaLn Desert, California, did on
the 26th day of July, 1990, h41d a duly rx�ticed public heariryg to c��sider a
request by TCJWNSC'�ATE FII�NCIAL, for approval of a negativ�e declaration of
tal impact and precise plan for a 47,000 square foot medtcal office
b�uildirx3 at t,he southeast corr�.r of PY�d Warir�g Drive and San Pablo Avenue; and
WI��REA.S, said application has ca�lied with tt�e require�nents• of tYae "City
of PaLn Dese.rt Procedures to Implement the California �virorYnental Quality
Act, Resolutiori No. 80-89", in that the direct�or of oamunity c�velc�ment has
determined that the pro�ect will r�ot have an advp.,rse impact on the envirorYnent
and a negative d�eclaration has beezz p�epared; and
WHEREAS, at said public hearing, upon hearing and considerir�g all
testimocYy and arg�m�ents, if ariy, of all persaLs desi�� to be heard, said city
oaiu�cil did find the follawir�g facts and re��.s to exist to ,justify ap��val
of said precise plan:
1. The pi-or.�osed use and design of the psoject is oon.sistent with the
goals and ob,jectives of the Office Professional zone, the Palma
Village Specific Plan and Palm Dese.rt Gen�e.ral Plan.
2. The desic� of the p��ed b�uilding and site plan is canpatible with
ex.isting and pi�o�po.sed land uses in the vicinity.
3. Tt�e pr�osed use will rx�t depreciate pmperty values, restrict the
lawful use of ad�acent properties or threaten the public health,
safety or genexal welfare.

9. Applicant agrees to maintain the landsCapi�g required to be installed
pursuant to the.se �itions. Applicant will enter into an agreertient to
ma.intain said lar�d..scapiryg for the life of the pro�ect, which agregnent

s-pecific intent of the parties that this conditi� and agreeme,nt run with

10. Applicant shall �asize drought resistent and water coa�serving plant
materials and irrigatio� tectux�logies into land��cape plan.
11. Trash area shall pravide for oanriercial recycling.
12. Applicant shall make provision for oatmercial recyclirx3 ir�cluding a
program for oollection inside the building and external trash containers
to be appro�ved by Waste Management.
Depart�nait of Public Wo�ks'
1. Drainage fees, in accordance with Sectio�n 26.49 of the Palm Desert
Municipal C,oc1e, shall be paid prior to issuar�ce of a grading permit.
2. Signalizati� fees, in accordance with City of Palm Desext Resoluti� Nos.
79-17 and 79-55, shall be paid prior to issuance of a grading pe=mit.
3. Transportation Uniform Mitigatiaz Fees, in acoorda:xe with ordinanc,e
requirements of the City of Palm De.sei�t, shall be paid prior to the
issuar�ce of bu.ilding permits.
4. Any stonn c�ain aonstructiori shall be ooritir�gent uporz a drainaye study
prepax-ed by a registered civil er�ginee,r that is revietiaed ar�d approv�ed by
the depar�n�+�nt of public works.
5. F�11 public imprwenents, as required by Secti�s 26.40 and 26.44 of the
Pa1m Desert Municipal Code, shall be installed in accordance with
applicable city standards.
6. As required under Palm Desert Municipal C',ode Sectiori 26.28, and in
accordarbce with Sections 26.40 and 26.44, ooRq�lete i�rovement plans and
s�pecifications shall be sutYnitted to the Director of Public Works for
checking and approval before construction of any improvements is
oanne.rbaed. Offsite in�vement plans shall be revieFred and approved by
the Director of Public Works and a surety posted to guarantee the
installatioci of all required offsite i��arements prior to issuaY�ce of a

8. Landscaping maintei��ce on FY�ed Waring Driv�e, San Pablo Avenue and Santa
Rosa Way shall be th�e re,sporLsibility of th�e praperty a�n�er.
9. As Y'equiY'ed �r Secticn 12.16 and 26.44 of the Palm De.sert M�.uzicipal
Qode, all existing utilities shall be placed underground per each
respective utility district's recommendation. If deterntined to be
unfeasible, the applicant shall submit to the city in a form acceptable to
th�e city atton�y, sur�ety in an amamt equal to the estimated coc�structioci
costs for the sub�ect undergrounding.
10. In accordar�ce with Palm De.sert Nhm.icipal C'.oc�e Chapter 27, aai�lete grad�ng
plans and specifications shall be suYmitted to the directar of public
works for checking and approval prior to issuance of any permi.ts
as.�ociated with this pro�ect.
11. ArYy and all off-site i�Ovai�ts shall be p�er.ec3ed by the app�+oval of
plans by the director of public works and the issuance of valid
encroach[nent peitnits by the department of public works. I
12. A complete preliminary soils inv�e.stigation, aax3ucted by a registexed �
soils er�gir�eer, shall be sulinittsd to and appsr�ved by the depar��ent of �

13. Prior to the issuance of any permits associated with this p%ject
applicant shall initiate par�cel map prncessir�g far the oa�.solidati� of
the existir�g parcels. �
14. Landscaping, walls and other site imp�ro�vements within a 40-foot "clear
sight triar�gle" for all intearsections shall be ryo higher than three feet i
abave tap of curb elevation.

15. Traffic safety stripir�g on F�ed Warir�g Drive and San Pablo Avenue shall be
provided to the specificatLons of the directo�r of public wo�k.s. A traffic
' cantxnl plan must be submitt�d to ar�d be appr�ared by the director of

16. Applicant shall p�rnride for t�e design and aaLstruction of Fred Warir�g

1. With respect to the oaxiitions of ap�raval regardirx� the above referenr,ed
plan r,�tler,k thQ fire c�epar�nent reoannetxls the follawir�g fire pmtection
meas�ures be gro�vided in accorriar�ce with city �rn�nicipal coc}e, NFPA, UF�C,
and UBC and/or reaogntzed fire protection starxlairts: The fire departrnent
is required to set a mini�rnan fire flaw for the ren�oc3e1 or oor�structioa� of
all cam�excial buildings per Unifonn Fire Code Sec. 10.301C.
2. Provide, or shaw there exists, a water system capable of providir�g a
p�tential gallcn per minute 1500 for single faanily, 2500 for rnultifamily,
and 3000 for cannercial. The actual fire flaw available from any ane
hydrant ooru�ected to any givpsi water main shall be 1500 c�pm for 2 txxirs
duration at 20 psi residual apesatir�g pressure.
3. A fire flaw of 1500 gpm for a 1 hoKzr c�uration at 20 psi residual operating __
press-�u�e mu.st be available before any arnbu..stible material is placed o�
tr�e job site. �
4. Th�e required fire flaw shall be available fran a Su�pp.r tYyr3rant(s) (5" x 4"
x 2-1/2" x 2-1/2"), located r�at less t.hari 25' rx�r more than 200' single
family, 165' multifacnily, and 150' oannercial from any portion of the
builclir�g(s) as measut'ed along ap�rC7Ved vehiCular travelw3y5. Hydr'ants
inatalled belaw 3000' elevation shall be of the "w�et barrel" type.
5. Fro�vide written certification frcm the app��op�'iate water c�any havir�g
jurisdiction that hydrant(s) will be installed and will produce the
required fire flow or arrar�ge field inspection by th�e fire departt�ent
prior to request foa� final inspection.
6. A cxnibination of on-site and off-site Super fire hyc�ants (6" x 4" x 2-
1/2" x 2-1/2") will be required, located not less than 25' or more t-han
200' sir�gle faattily, 165' multifamily, and 150' ooRmercial fran atYy portion
of the buildisx3(s) as measwced ala�g app�w�ed vehtcular travelways. The
required fire flow shall be available frcm any adjacent hydrant(s) in the
system.
7. The required fire flow may be ad�usted at a later point in the permit
pr�ocess to reflect changes in design, oonstructiori type, area separations,

8. Prior to the application for a buildir�g pe.rndt, the develaper shall
fun�ish tt�e original and two oapies of the water systgn plan to the cauity
fire departrnent for review. No builcling pexmtt shall be issued Lmtil the
water system plan has been app��ov�ed by tt�e oaurty fire chief. Upon
appraval, the original will be returr�ed. Q�e c�o�y will be sent to the
res-pcxLsible ins�pectir�g authority.
