CALIFORNIA, SETTING RULES AND REGULATIONS GOVERNING THE OPERATION FOR SOLID MASTE COLLECTION SERVICE MITHIN THE CITY OF PALM OESERT MHEREAS. ON THE 8TH DAY OF FEBRUARY, 1990 . the City Councii of Palm Desert authorized an excluslve contract to perform solid waste collection services to Waste Management of the Desert ; and wHEREAS, the exclusive contract authorizes the City Councii of the City of Palm Desert to regulate the operationat requirements for soltd waste coliection services; and MHEREAS. THEREFORE. 8E IT RESOLVEO by the City Councii of the City of Paim Desert that effective the l�, day of Januarv, 199 . the rules and regulations governing the operatlon for solid waste collection services shall be �et by a resolution of the City Councll ; and BE IT fURTHER RESOLVED as follows : RULES AND REGULATIONS 1 . Commercial a. Collection during October 1 to April 30 shall be between 6 :00 a.m. and 6:00 p.m. b. Collection during May 1 to September 30 shall be between 5 :30 a.m. and 6: 00 p.m. 2 . Residential a. Collectton duriny October 1 to Ap�ii 30 shali be -:.between 6s30 a.m. and 6:00 p.m. b. Collection during May 1 to September 30 shell be between �t30 a.m. and 6:00 p.m. . 3. Refuse shail be collected from containers at the locatio� of ail residences and dweliings whether a single family or multiple dwelltng unit, not less than once per week. 4. Refuse shall be collected at all places of business as often as shall be necessary to maintatn a sanitary condttion and provlde reasonable convenience to such business establishments . 1 RESOLUTION 90-20 5 . All persons . except business establishments who are furnished containers by the Contractor , shall provide a standard metal or plastic container of not more than thirty three (33 ) galion capacity. each with a tight ffttfng cover , tapered sides , two handles or bales , and shali not exceed fifty ( 50) pounds gross we9ght each when filled. 6 . Business establishments shaii use containers specified by the Contractor Wh i ch sha 1 1 be s i zed to contain al 1 refuse accumulation of the business for four ( 4) days or other period as determined applicabie for said business . 7 . In the event of storm. riot . fire or Act of God, the Contractor shall be granted reasonable variance from his regular schedule to collect the additional refuse. As soon as practical . after a storm or disaster . Contractor shail advise the City and the public of the estimate of time required before he can resume the regular schedule. S . Refuse may be transferred from the container into tubs , can . hamper or other containers used by the Contractor in carrying this matter to collection trucks . This shall be done in a sanitary manner and any matter spilled in transferring shall be picked up by the collector . 9 . Collection of refuse shail be made from the place where containers are freely accessible. are at the ground level or on a platform not more than three ( 3 ) feet above the ground, and are not inside any dwelling , store . office . shelter or other building . 10 . The Contractor shall not be required to coilect from containers of more than thirty three ( 33 ) gallon capacity or fifty ( 50 � pounds gross weight , When filled wholly or partially . unless Contractor shall have provided the containers . I I1 . Containers moved by the Contractor for his convenience , shall be returned to their original location by Contractor w�ithin a reasonable time. 12 . Space about the containers shall be left free from any refuse spilled during the collection. The Contractor shall not be responsible for cleaning up unsanitary conditions about the refuse containers caused by carelessness of the occupant. 13 . Care shall be taken by Contractor ' s employees to prevent damage to containers by unnecessarily rough treatment . 2 RESOLUTION 90_ZO 14. Employees of the Contractor shall not be required to expose them�elves to the danger of being bitten by vicious dogs in order to acccompllsh refuse collection in any case where the occupants have such an animal at large. 15 . Residential refuse will be collected not to exceed stxty (60 ) feet from side, back door � carport , or other area as established by the Contractor with the approval of the Ctty. 16. Refuse collections shali be made with as little noise and as iittle disturbance to the householder or business place as possible , and without creating a nuisance . Containers and receptacles shali be carefully handled by the Contractor and shall be thoroughly emptied and left at the premises Where they are found. 17 . The Contractor shall be free to establish such refuse collectton routes as w111 contrlbute to maximum efflclency of operation. 19. The Contractor shall do every reasonabie act to provide a service of high quality and keep the number of legitlmate complalnts to a mintmum. Z0 . Tree limb� less than five inches ( 5" ) in diameter and vine cutting shall be ptcked up by the Contractor as solid municlpai Naste when they are securely tted tn bundies less than 24 lnche� (24" ) tn dlameter and not over four ( 4) feet in length . Leaves and grass trtmmings, not to excee� fifty (SD) pounds per bundle, pl�ced tn plastic bags at curb or roadslde will be picked up on regular collectton days. Maxtmum wetght per collection to be three hundred (300) pounds con� isting of s1x (6) cans . bags , b�ndles fro� all sources . 21 . Tree ltmbs, plant and vine cuttln9s of larger dimension than he�e�nabove speclfied shall be ptcked up a� a speciai haul and shall be charyed for at the fee then in effect. 22 . Except in cases where a health hazard may exist , the Contractor shail not be required to provide more than once a week collection of special ltems or bulky items to the same customer . 3 � RESOLUTION 90-20 23 . Contractor shall collect trash such as constructton and repa i r pro,�ect debr i s as requ 1 red to meet the needs of said proJect . 24 . In the vent service is missed , the Contractor shall return and pick up same withln twenty four ( 24) hours . . 25 . The C i ty may i nspect the operat i ona i records of Contractor at any reasonable time to insure performance of Contractor provisions . 26. The Contractor shail ablde by all City restrict'ions , regulations , resolutions or ordinances heard and passed by the City Councll relative to protection of the cttizen , including but not limited to noise level on public streets . 4 RESOLUTION 90-20 PASSED, APPROVED and ADOPTED by the City Council of the City of Palm Desert , Caitfornia , on thts 8th day of February, I990 � by the following vote , to w1t : AYES : KELLY , SNYDER, WILSON , CRITES NOES : BENSON ABSENT: NONE ABSTAIN : NONE BUFOR .
