WI�REAS, the City Council of the City of PaLn Desert, California, did
on the 12th day of April, 1990, hold a duly noticed public hearing to
consider a request by Keru�eth Cokeley for approval of a negative declaratian
of environmental i�act, precise plan and canditional use permit for a
10,000 square foot office/retail build.ing, associated parkiu�g lot and
greenUelt located an a C-1 lot at 73-330 Highway 111 and an R-1 lot at 44-
885 San BerLito Circle; and
WHERF,AS, said application has carq�lied with the require�r�lts of the
"City of Palm Desert Procedure for Implementation of the California
Envirar�nental Quality Act, Resolutian No. 80-89", in that the director of
camnanity develo��ent has detennined that the pro�ect will not have an
adverse impact on the enviro�nment and a negative declaration has bee.n
prepared; and
WHEREAS, at said public hearir�g, upo� hearing and cansidering all
testimony and arguntients, if any, of all interested persorLs desiring to be
heard, said plaru�ir�g catmissian did find the follawir�g facts and rea_�orLs to
exist to justify approval of said precise plan and condttional use pern�it:
l. The proposed use and design of the project is aoa�sistent with the
goals and objectives of the Gezleral Cannercial Zone, the Palma
Village Camiercial Core Area Specific Plan and Pa]m Desert Ge.neral
Plan.
2. Tt�e proposed pro,ject represents a substantial im�rovement for the
area and will e.rx�ourage a general upgrading of existing lxiildings
in the vicinity.
3. The developer of the proposed rear parkis�g area specifically
ic�lecn�nts a program described by the Pa]ma Village and Ca��cial
Core Area Specific Plan and will create a 32 foot wide greenbelt
ad�acent to tt�e residential zane.
4. The project will therefore not degreciate values, restrict the
lawful use of adj acent properties or threaten the public health,
safety or general welfare.

NOW, Tf�REF�ORE, BE IT RESOLVF� by the City Council of the City of Palm
Desert, California, as follaws:
1. That the abave recitations are true and oorrect and aonstitute the
findings of the coiuicil in this case. �
2. That a negative declaration of envir�arynental i�act, �chibit "A",
and Precise Plan/Canditional Use Permit 90-1 on file in the
departnent of aoRm�uiity development/plaruiing is hereby appraved,
subject to conditions.

1. Drairzage fees, in a000�dar�ce with Section 26.49 of the PaLn Desert
Municipal docle and Palm Dese.rt O�dir�aryce N�anber 507, shall be paid
prior to the issuanoe of any pezmits as�9ociated with this p�o�ect.

by the Depaztnez�t of Public Works.
3. Signalizaticn fees, in a�danoe with City of PaLn Desert Resolution
Nos. 79-17 and 79-55, shall be paid p�ior to the issuance of any
pennits a.s.sociated wi� this p�o�ect.
4. As required ur�der Palm Desext Nhmicipal C,oc;e Section 26.28, and in
acaordance with Sections 26.40 and 26.44, ooR�lete i�ven�t plans
and specifications s�hall be sut=nitted to the Director of Public Works
for rhec}cing and apprvval befo�+e oor�.stiuction of any i�mv��ents is
oo�m�oed. Offsite impa�nement plans shall be rev�etiaed ar�d aPP�'�'� bY
the Directar of Public Wo�ics and a sur�ety posted t� guarantee the
installatiai of all requiY�ed offsite ��ts prio� to issuai�oe of
a gradir�g pexmtt. Such i�o�v��ts shall include, but r�ot be limited
to, remaval of existi,ryg drive app�+oach, on of curt� ar�d
gutter and sidewalk and oonstiv�ctiai of fully alley t�rav�ients. "As-
built" plan.s shall be submitt,ed to, and app��oved by, the Director of

5. All private driveways and par�kir�g lots shall be inspected by �e
crx,�i.r�ee�c`iryg de�arbne��t and a star�rd irLspection fee paid p�ior to the
issuance of a grading permit.
6. Applicant shall provic3e for landscapir�g within the existir�g public
parkway on San Benito Circle as well as a�iate site larriscapir�g.
All landscaping maintex�yce shall be the respaLsibility of the p�oQerty
aur�ex.

7. In acco�da�c�e with Palm Desert M�uzicipal C,ode Chapter 27, oa�lete
grad.ir�g plaa�s and s�ecifications shall be submitted to the Director of
Public Work.s for checking and appiro�val prior to the iss�.�r,e of any
permits associated with this pro,ject.
8. Applicant shall pmvide for the of all existing overhead
utility lines in accordance with the respective utility owners
reoarm�.nc�ation. If such is fau�d to be tuifeasible by
the city and th�e utility, applicant shall sutmit to the city, in a form
acceptable to the city attorney, svrety in an aam�,uit equal to the

9. Size, manber and location of c�iveways shall be to the specifications
of the Departrnent of Public Works with two driveway ap���oac,hes (one per
Pai'ce1) to be allc�aed to serve this pr�o�perty. The entries as st�osan on
the pro,ject site plan shall be redesigr�ed to the satisfaction of the
Director of Public Works and Fire Marshal.
10. Pr�.�osed building pad elevatia�s are sub,ject to review ar�d modification
in acaordance with Sectiaz 27 of the PaLn Desert NAmicipal C'.ode.
11. Arry ar�d all off-site i�v�iecits shall be pr+eceded by the ap�val of
plans and the i.� of valid erx��oachment pexmits by the Deparbne�t
of Public Wo�ks.
12. A vanplete prelimina=y soils investigation, va�cted by a registe,red
soils engineex�, shall be submitted to and app��av�ed by the Depaz-trne�t of
Public Works prio� to the issuanoe of a gradir�g peimtt.
13. Pazitir�g stalls, as st�awii on the p�ro�ect site are sub-standard. Prio�
to the issuaryce of arYy perndts a��sociated with the p�oject, applicant
shall take oorrective measures to mitigate the park.ir�g deficie.ncies.

1. Tt�e Fire Deparbnent is requ.ired to set a miniman fire flow for the

2. Provide, oac str�w there exists, a water systen capable of p�avidir�g a

required fire flow, ar arrar�ge field inspection by the Fire Deparbtient

1/2" x 2-1/2"), will be r�equired, located mt less than 25' or mox'e
than 200' sir�gle family, 165' multifaanily, and 150' oanner�cial fran any
portiaz of the building(s) as measured along approved vehicular
travelways. The required fire flow shall be available from arry
adj acent hy�ant(s) in the systen.
7, The requis�ed fire flaa may be ad�ust,ed at a later point in the peimit
process to reflect changes in design, construction type, area
separatirns, or built-in fire protectiaz m�easures.
8. Prior to the application fo� a buildir�g peimit, the c3avelc�er shall
furnish the original an�d two oapies of the water systen plan to the
Gauity fire Depaitnent for review. No building pezmit shall be issued
imtil the water systen plan has beeri ap��oved by the Ctixuity Fire Chief.
U�on approval, the original will be retutned. One oopy will be sent to
the resporLsible i.uLspectiryg authority.

the systsn shall meet the fire flow requir+encnts. Plans shall be

desi� of the water systen is in acoox��ce with the requirements
prescribed by the Riverside Cbtmty Fire Departr�ent".
9. Znstall a complete fire sprinkler system per NFPA 13. The post
indicato�' vdlv�e and fire deparbnent aonnection sY1a11 be located to the
front, not less than 25' from the buildir�g and within 50' of an
appxr�v�ed hydrant.
10. Ir�.stall a fire alazm (waterflow) as req�.iired by the ihzifo�m Building
Oocle 3803 for sp�rinkler system.

to within 150' of all portions of the exterior walls of the first

the roadway shall be 36' wide with paxitir�g on both sides, 32' wide with

16. Whenever access into private p�ope=-t,y is oontrolled t3�+ough use of
gates, bazriers, guaY�d hou.ses o� similar means, pswlsion shall be made
to facilitate access by emargec�c,y vehicles in a marmes a�p�nrved by the
Fire Depart�nent. Al l oontrol led aooess devioes that are po�w�er o�pe�rated
shall have a radio-oontrolled over-ride systsn capable of opes�it�g the
gate wheiz activated by a special transnttter located in emergency
wehicles. Devic�s shall be equipped with bacla�p po�w�ar facilities to

that are not pawer operated shall also be apFur�ved by the Fire
Departnent. Minimim o�pentng width shall be 12' , with a minimum
vertical clearat�oe of 13'6".
