WI�EAS, the City Ca�mcil ori the City of Palm Desext, California, did oaz
the 24th day of May, 1990, hold a duly noticed public heari.ng to oa�sider a
request by FELIDAE INC. , for approval of a Negative Declaration of
Enviror�cnental In�act, Precise Plan and Cocu3itiocial Use Pe�mit for a 35,859
square foot professior�al office buildirx�, associated parkirx,� lot and greenbelt
located o�n the east side of Monterey Avenue between Highway 111 and San
Gorgc�rLto Way; and
WI�REA.S, said application has oanplied with the requirements of the "City
of Palm Desert Proc�dur� for Impleme�ztation of the California Ernvirocmental
Quality Act, Resolution No. 80-89, " in that the director of c�nuiity
develapment has determined that the pro�ect will r�t have an adverse i�act on
the erivirn�nent and a negative declaration has bee,n prepared; and
Wf�REA.S, at said public hearing, upon hearing and considering all
testimaly and arg�mients, if any, of all interested persals desiring to be
heard, said city oa.u�cil did find the follawing facts and reasons to exist to
justify appraval of said precise plan and �itional use pe�Lit:
1. The pr��osed use and design of the p%ject is oa�.sistent with the
goals and ob�ectives of the Genexal Commercial Zone, the Palma
Village Canne,rcial Core Area Specific Plan and Palm Desert General
Plan.
2. The pY�sed pro�ect repres�nts a substantial impr�av�anent for the
area and will erx�irage a general upgrading of existiryg tuildirx�s in
tt�e vicinity.
3. The developer of the proposed rear parking area specifically
it�leme�lts a p�ogram described by The Palma Village and Catmercial
Core Area Specific Plan and will create an average 36 foot wide
greer�belt ad�acent to the residential zone.
4. The project will therefore not depreciate values, restrict the lawful
use of ad j acent praperties or threaten the public health, safety or
genexal welfare.

2. Prior to the issuarx•,e of a buildiixJ pezndt for aa�iction of any uses
co�te�lated by this ap�ttr�val, the applicant shall first ocR�lete all the
pror.edtizral requirements of the city which include, but are not limited to,
architectural oatmissioaz and buildirx� permtt pr�ocedures.
3. Con.structions of a portion of said p%ject shall oanner�ce within one year
from the date of final apprvval unless a time e.xtension is granted,
otherwise said approval shall become null, void and of no effect
whatsoevpx.
4. The de�velo�pment of the p�oQerty de.scxibed h�.rein shal.l be sub,j ect to the
restrictions and limitatia�s set forth herein which are in addition to all
municipal ordinances and stated and fedesal statutes rx�w in force, or
which hez'eafter may be in force.

oontelnplated by the app�oval, the applicant shall first obtain permits

11. All approvals shall be oontingent on aoquisition of Lot No. 137 PaLn
Village Unit No. 7, APN 627-071-010.
Deparbnerrt of Public Wo�i�s-
1. Drainage fees, in accordance with Section 26.49 of the Palm Desert
M�uzicipal Code and PaLn Desert Ordinance N�miber 507, shall be paid prior
to the issuance of any permits associated with this pro�ect and
reoordatioai of the required par�cel map.
2. Any storm drain �nstruction shall be oontingent upoK� a drainage study
prepaz�ed by a registered civil engineer that is revie�wed and appraved by
the Departnent of Public Works.
3. Signalization fees, in acoordance with City of Palm Desert Resolution Nos.
79-17 and 79-55, shall be paid prior to the issuarice of any permits
associated with this pro�ect.
4. F�11 public improvements, as required by SectiocLs 26.40 and 26.44 of tt�e
Palm Desert Municipal Code, shall be installed in accordance with
applicable city standards. Public i�rovements shall include, but r�ot be
limited to, remaval of existing drive approaches, reconstruction and
installation of curb and gutter and meandering sidewalk, oo�n.structicai of
full alley irr�rovements and a mirunn.un 8 foot widening of Nbnterey Avenue,
east side, between Highway 111 and San Gorgonio Way incluciuzg oanstructiaz
of a dedicated right-turn lane on Monterey Avenue at San Gorganio Way.
5. As required under Palm Desert Municipal Code Section 26.28, and in
acoordance with Sections 26.40 and 26.44, crniplete jmpr�ne.nt plans and
specificatians shall be sutrnitted to the Director of Public Works for
checking and approval before construction of any improvements is
oaMienced. Offsite imprvvement plans shall be reviewed and approved by
the Director of Public Works and a surety posted to guarantee the
installation of all requtred offsite impravements prior to issuance of a
grad.irx� pezmit. "As-built" plans shall be submitted to, and apprwed by,

the Directar of Public Works prior to the acceptance of the i��nts
by tl�e City.
6. All private driveways and parking lots shall be inspected by the
er�gineering department and a star�dard in.spectiaz fee paid p�rior to the
issu�nc,e of a gradir�g peYmit. Parkir�g lot design shall incluc�e pr�visions
for oontinuaus landscaped barrier islands abuttir�g the parkir�g staffs to
exihanc•,e vehicle safety and pro�vic�e parkir�g lot landscapir�g. In additiocz,
parking lot stripir�g plan shall include pmvisions for handicap parkirx�.
7. Applicant shall prvvic3e for landscapi.r�g within the existir�g public parkway
on San Antonio Circle as w�ell as app�iate site landscaping. All
landscaping maintenanc,e shall be the respazsibility of the gropert.y aar�x.
8. In accordar�c.e with Palm Dpsert Nhuzicipal Cbcie CY�apter 27, oatq�lete gradirx3
plans and s�pecificatia�s shall be sutrnitted to the Director of Public
Works for checkirx,� and ap��oval prior to the is,suar�ae of arry permits
associated with this project.
9. Applicant shall provic3e for the of all existir�g avex�ead
utility lines in accordance with the respective utility owners
r�ecamietxiaticn. If such is fauxi to be tmfeasible by the
city and the utility, applicant shall suUmit to the city, in a form
acceptable to the city attorney, surety in an amauit equal to the
estimated oa�struction oo�t of swrrh
10. Size, n�anber and location of c�iveways shall be to the specifications of
the Departznent of Public Wark.s with a maxim�an thr�ee c�riveway apprnacY�e.s
pezmttted to sp,sv�e this p�aperty. Tt�e alley �tries as shawiz cn the
p�o�ect site plan shall be rede.sigr�ed to provide for tw� acce.ss points.
The red�e.sign shall be sub�ect to the approval of the Dir+ector of Public
Works and Fire Marshal. The San Gor�onto Way entcy shall be a mininaIIn
width of thirty (30) feet.
11. P�ed build3s�g pad elevatior�s are sub�ect to review and modtficatiaz in
acoordanc•;e with Sectiaz 27 of the PaLn Desert Nh.azicipal Cbcle.
12. Ariy and all off-site ii��ents shall be �,eded by the app�ro�val of
plans ar�d the issuance of valid e,ncz�oachment pennits by the Departne�t of
Public Wo��ks.
13. A complete prel�ni.nary soils investigation, ooc�cted by a registered
soils e�gineer, shall be submitted to and approved by the Departneazt of
Public Wo�ks p�io� to the issuance of a gradir�g permit.
14. Ccn�lete par�cel map shall be submitted to the diti�ctor of public wc�rks for
c.hecltir�g and appr�oval and be reoorded p�ior to the is_�uanoe of any pennits
associated with this pro�ect. As part of the paz�cel map pmooess the

appiicant shall p�avide for eithex the pay-off or reapportiorn►er�t of any
city assesst►ents existing against the subject praperties.
15. Waiver of access to all public streets except at app�wed locations shall
be granted on the par�cel map.
16. That area indicated as "SERVIC�" oci the pro�ect site plan shall be
relocated so as r�t to in�act the praposed San Gorgazio aooess thrnat.
17. Site dra3r�ge shall be controlled so that no additia�al surface flays are
dir�ected easterly of the pro�ect along the alley roadway. Surface
drainage fran the prnj ect which may drain to the alley easterly of the
site shall be ooritained oci-site by means of dry wells or altesnate syste�ns
as may be appmved by the director of public wr�rks.
18. Traffic safety striping oci Monterey Avenue, San Go�to Way and the alley
shall be provided to the specificatio�s of the director of public vrorks.
A traffic oantrol plan must be sutrnitted to and appmved by the director
of public works prior to the placement of ariy pavecne,nt markings.
City Fire Ma.sst�:
1. The fire departrne.nt reoannends the following fire protectian measures be
px�vided in acaordance with City Municipal Cbde, NFPA, UFC, and UBC and/or
reoognized Fire Protectian Standards:
The Fire Departrnent is required to set a miriicrnan fire flow for the remodel
or oanstruction of all oamiercial buildings per Unifonn Fire Cbde Sec.
10.301C.
2. Provide, or shaw there exists, a water system capable of providing a
potential gallon per minute 1500 for single family, 2500 for multi-
family, and 3000 for camiercial. The actual fire flvw available fran any
one hydrant ooruzected to any given water main shall be 1500 GPM for twc�
haurs duration at 20 PSI residual operatirig pressure.
3. A fire flaw of 1500 gpm for a 1 haur duratian at 20 psi residual operating
pressure must be available before any oanbustible material is placed an
the �ob site.
4. The required fire flaw shall be available fnxn a Super hydrant(s) (6" x 4"
x 2-1/2" x 2-1/2" )< located not less than 25' nor more than 200' single
family, 165' multifamily, and 150' carrnercial from any porticn of the
buildirx3(s) as measured along approved vehicular travelways. Hydrants
installed belaw 3000' elevation shall be of the "wet barrel" type.
5. Provide written certification fran the appropriate water oorr�ariy having
�urisdiction that hydrant(s) will be installed and will produce the

required fire flow, ar arrange field inspection by the Fire Depar-trrent
prios to r�equest for final inspection.
6. A c�iUinatiaz of on-site and off-site Super fire riydrants (6" x 4" x 2-
1/2" x 2-1/2"), will be required, located �t less than 25' or more than
• 200' sir�gle family, 165' multifa[nily, and 150' camnexcial frc[n atYy partion
of the buildir�g(s) as measured alcx�g apFroved vehicular travelways. The
required fir�e flaw shall be available fran any ad�acent hydrant(s) in the
system.
7. 'I�e required fire flaw may be adjusted at a lates point in the permit
process to reflect charyges in c3esign, �uction type, az�ea separatioc�s,
or b�uilt-in fire p�rotectiori measures.
8. Prior to the application for a builclir�g pexmtt, the c3gv�elape.r shall
fuYntsh the original and two c�ies of tY�e water systgn plan to the Co�uity
fire Deparbnent for review. No building permit shall be issued turtil the
water system plan has been ap�p�r�ved by the Oauity Fire Chief. Upon
app�aval, the original will be returi�ed. One c�opy will be sent to the
respaLsible inspecting auth�rity.
Plans shall ooriform to fire h�ydrant types, location ar�d spacir�g, and the
system shall meet the fire flaw requirements. Plar�s shall be signed by a
Registe.red Civil Enginee,r and may be signed by th�e local water oa�any
with the follawing certificatiai: "I certify that the desi�n of the water
systgn is in accordan�ce with the requirem�.nts p�scribed, by the Rivexside
Coiulty Fire Depat`tm�_nt".
9. CXx�ly with Title 19 of the California Administrativ�e Cbde.
10. Ir�stall a canplete fir�e sprinkler system per NFPA 13. �e post indicator
valve and fire depar�ne,nt c�r�ectirn shall be located to tl�e front, not
less than 25' from the building and within 50' of an a�p�+av�ed hyr3rant.
11. Install a fire alann (waterflow) as required by the Unifo�m Building C,oc1e
3803 for �nkl er system.
12. ZrLstall tat�er alarm on supply valve for sprinkler systgns.
13. Cert3in c]eBignated areas will be z'equired to be maintained as fire larye.s.
14. Install a fire alazm as required by the Uniform Building C.od�e and/or
Unifoim Fire Cbc3e.
15. Install parLtc hardware and exit signs per Unifoxm Building Cbcle, and/or
Uniform Fire Cod�e.

18. All buildir�gs shall be acoessible by an all-w�eather roadway exterxii��g to
within 150' of all portia�s of the exterior walls of the first story. 'I'he
roadway shall be mt less than 24' of unobstructed widtl-i and 13'6" of
ve.rtical clearar�e. Where parallel parkirx,� is allc�wed, the roadway shall
be 36' wide with parkirx,� on both sides, 32' wide with par�kir�g on aze side.
Dead-end roads in excess of 150' shali be pro�vided with a mj.nirrn�n 45'
radius turn-arair�d (55' in ir�dustrial develo�nents). Faurtains or garden
islaryds plac�d in the middle of these turn-arotiu�ds shall not exr.eed a 5'
radius or 10' diametex.

19. If gated, whenever access into private pro�erty is contrnlied through use
of gates, barriers, guard houses or similar means, provisian shall be made
to facilitate access by emergericy vehicles in a manner approved by the
Fire Department. All cantrolled access devices that are pawer operated
shall have a radio-oontrolled aver-ride system capable of opening the gate
when activated by a special tran.smitter located in emergency vehicles.
Devices shall be equip�ed with backup power facilities to aperate in the
event of power failure. All controlled access devices that are ryot pawer
operated shal l also be approved by the Fire Depart�nent. Miniirn,un operiing
width shall be 12' , with a mini�man vertical clearance of 13'6".
20. Occupancy separatian will be required as per the Uniform Building Code,
Sec. 503. Building plan chec,k review.
21. Install Panic Hardware and �cist signs as per Chapter 33, Sectians of the
Uniform Buildir�g Code.
22. Contact the Fire Departme.nt for a final inspection prior to occupancy.
23. An apprrnred NFPA 13 sprinkler system is required for all buildings over
5000 square feet in size. Area separation will r�t exempt the building
fmn this r�equirement. EXII�TION: One and two family residences.
