TnhIERE'.AS, the City Council of the City of Palm Desert, California, did on
the 28th day of June, 1990, hold a duly noticed public hearing to consider an
appeal by Perry Ashby for the abave noted variance and two lot parcel map
request for property, more particularly described as:
A.P.N. 627-171-001
WI-IERFAS, at said public hearing, upon hearing and considering all
testimony and arg�nnents, if any, of all interested persons desiring to be
heard, said city council did find the follawing facts and reasons to exist to
�ustify the affirmation of the planning carrnission denial of the application:
VARIANCE:
1. That exceptional or extraordinary circumstances or conditions that
apply to this property that do not apply generally to other
properties in the same zone was not established to the satisfaction
of the city council.
2. That the city council was not satisfied that the granting of the
variance wr�uld not be detr�mental to the public health, safety, or
welfare or be materially injurious to properties or impravements in
the vicinity.
PARG�.L MAP:
1. The proposed map ( i.e. lot area) is not consistent with the
established minim�un prescribed by the zoning ordinance and the
findings necessary to approve a variance caruzot be affirmed.
NOW, THEREFORE, BE IT RESOLVID by the City Council of the City of Palm �
Desert, California as follows:
1. That the abave recitations are true and correct and constitute the
findings of the council in this case.
2. That VAR 90-1 and PM 25900 are hereby denied.
