RESOLUTION OF THE C[ TY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA . ACCEPTING A PROPERTY
OWNER PET [ TION , INITIATING PROCEEDINGS ,
DESIGNATING PARTIES , APPROV[NG AN AGREEMENT
REGARDING ADVANCES AND AUTHORIZING AND
DIRECTING CERTAIN ACTIONS IN CONNECTION WITH
THE PROPOSED FORMATION OF THE CITY OF PALM
DESERT COMMUNITY FACILITIES OISTRICT N0. 1
( INDIAN RIDGE PUBLIC IMPROVEMENTS) PURSUANT
TO THE PROVISiONS OF THE ME�LO-ROOS COMMUNITY
FACILITIES DISTRICT ACT OF 1982
WHEREAS, Sunrise Desert Partners . a Celifornla partnership
(the "Developer") , has submitted to this City Councii the form of
a petition requesting the initiatton of proceedings with respect
to the formation of the City of Palm Desert Community Facilities
District No . 1 ( Indian Ridge Public Improvements ) ( the
" Otstrict " ) pursuant to the provisions of the Mello-Roos
Community Facilities District Act of 1982 (California Government
Code Section 53311 et seg. ) (the "Act" ) ; and
WHEREAS, there has been presented to this C1ty Councfl the
form of an agreement regarding advances pursuant to Nhich costs
with respect to the formetion of the Oistrict and the issuance of
spectal tax bonds (the "Agreement Regarding Advances" ) ;
NOW, THEREFORE . the City Council of the City of Palm Desert
does hereby resolve and o�de� as follows :
Section 1 . The City Council hereby accepts the petition of
the Developer and determines that said petition meets the
requirements of the Act .
Section 2 . The City Councii hereby initiates the
proceedings for the proposed formation of the District , and the
map attached to the Developer petition as Exhibit A showing
generaliy the boundartes of the property proposed to be included
within the boundaries of the proposed District is hereby approved
and adopted by this Ctty Council .
Section 3 . 6est , Best 8 Krieger is hereby designated as
counsei f or the Dlstrict; Nossaman. Guthner, Knox 3 Elliott is
hereby appolnted to act as bond counsel to the District 1n
accordance r+ith their letter proposal previousiy submitted to the
City ; a�d Stone a Youngberg is hereby appointed as the
underwriter 1n connection With the issua�ce of the proposed
Mello-Roos special tax bonds in accordance with thei � letter
proposal presented to the City for the purpose of issuing speclal
tax bonds secured by speciel taxes levied on properties within
the proposed Dtstrict . The Cfty Manager, or his designee, 1s

hereby autho� ized and directed to retain the services of a
speciat tax consultant, appraiser , prtnter , fiscal agent/trustee
and any and ail other professional firms necessary and
appropriate in connection with the proposed formation of the
Oistrict and the issuance and sale of special tax bonds .
Section 4 . The City Manager , his designee , end the
professionai firms appointed hereunder and pursuant to the
authoriiatlon contained herein are hereby authortaed and dlrected
to take any and a 1 1 act 1on necessary and appropriate in
connection with the proposed formation of the District and the
issuance of speciai tax bonds.
Section 5 . The form of Agreement Regarding Advances is
hereby approved . The City Maneger and Ctty Clerk are hereby
authorized and directed to execute the Agreement Regarding
Advances tn substantially the form presented to thfs City
Council , with such cha�ges. deletlons , modificatlons or additlons
as approved by the City Manage�.
Section 6 . This resoiution shall take effect immediately
upon its adoption.

of Palm Desert this 24th day of October , 1991 , by the following

The undersiqned is the owner of certain real property
in the City of Palm Desert identified in the map attached
hereto as Exhibit a, and pursuant to California Government Code
Section 53319 hereby requeats that you institute proceedinqa to
establish a communfty facilities district pursuant to the
Mello-Roos Community Facilities act of 1982, and hereby
respectfully petitions and represents as follovrs:
1. We request that certain property owned by us in
the City of Palm Desert be included within the City of Palm
Desert Community Facilities District No. 1 (Indian Ridqe Public
Improvements) (the ~District") and that you take all ateps
neces�ary to complete the formation of the Dietrict and to levy
a special tax therein for the purpose of financinq certain
public improvements qenerally described in Exhibit 8 attached
hereto, all a8 to be more particularly specified in the
proceedinqs for the creation of the District and the levy of
said special tax.
Z . It being our intention to. proceed as quickly as
possible with the fonnation of the District, the levy of said
special tax and the issuance of one or more series of special
tax bonds, and it beinq further understood that, there beinq
fewer that twelve reqistered voters residinq within the
District, the undersiqned beinq the only expected qualified
elector of the District, �e wafve all otherwise applicable
times for and notices of the conduct by you of the election to
order the levy of the apecial taa, to establish an

appropriations limit for the District, and to authorize the
issuance of said special tax bonds of the District, and any
analysis and/or arqument with respect to said election.
3. In furtherance of said waiver, Me aqree that said
election may be conducted by mailed or hand-delivered ballot to
be returned as quickly as possible to the office of the City
Clerk of the City of Palm Desert and that the results of said
election be canvassed and reported to you as soon as possible.
