HomeMy WebLinkAboutCC RES 91-002 RESOLUTION NO. 91-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT APPROVING PROPOSED AMENDMENT NO. 6 TO THE REDEVELOPMENT PI�AN, AS AMENDED, FOR PROJECT AREA NO. l, AS AMENDED, OF THE PALM DESERT REDEVELOPMENT AGENCY RECITALS: A. The Planninq Commission of the City of Palm Desert has reported to the City Council and to the Aqency that proposed Amendment No. 6 is in conformance with tha General Plan of the City of Palm Desert and has recommended approval of proposed Amendment No. 6. B. In connection with proposed Amendment No. 6, the Staff of the Aqency has prepared the Report to the City Council, which consists of the reports and information required by Health and Safety Code Section 33352 (to the extent warranted by Proposed Amendment No. 6 in accordance with Health and Safety Code Section 33457. 1) . Such Report, together with proposed Amendment No. 6, have been presented to the City Council and copies of proposed Amendment No. 6 and such Report are on file in the office of the City Clerk and have been made available to the public prior to the joint public hearing of the Agency and the City Council on proposed Amendment No. 6. C. The Riverside County Fiscal Review Committee has prepared and submitted to the Aqency its Report concerninq the Committees' conclusions and recommendations in connection with proposed Amendment No. 6 and the Aqency subsequently prepared and submitted to the Chairperson of the Fiscal Review Committee the Agency's response to such report in accordance with Health and Safety Code Section 33353.7. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. The City Council has considered the proposed Negative Declaration prepared in connection with proposed Amendment No. 6 to the Redevelopment Plan, As Amended, for Project Area No. 1, As Amended, of the Palm Desert Redevelopment Agency and the written and oral comments received regarding such Negative Declaration. On the basis of the initial study and the comments received thereon, the City Council finds that there is no substantial evidence that proposed Amendment No. 6 will have a significant impact on the environment. Section 2. A full and fair joint public hearinq regardinq proposed Amendment No. 6 and the Negative Declaration prepared in connection therewith has been duly noticed and held by the City Council and the Aqency pursuant to law and the City Council and the Agency have received written and oral testimony concerninq such proposed Amendment No. 6 and the City Council has duly considered the recommendations of the Project Area Committee and the Agency and has evaluated the Report to the City Council, described in Paragraph B of the Recitals hereof, and all evidence and testimony for and aqainst the adoption of such Amendment No. 6, and has adopted written findinqs in accordance with Health and Safety Code Section 33363 in response to each written objection or suggestion of an affected property owner or taxing entity. The City Council hereby finds and determines that the responses made to each written objection or suqgestion are full and complete and have addressed each written objection or suggestion in detail, qivinq reasons for not acceptinq specified objections and sugqestions and include good faith reasoned analysis which describe the disposition of the issues raised. All objections to such Amendment No. 6 were heard and passed upon by the City Council and the Aqency and are hereby overruled by the City Council. Section 3 . Amendment No. 6 and the Negative Declaration prepared in connection with Amendment No. 6, copies of which have been presented to the City Council and the Aqency and which are on file in the office of the City Clerk, are hereby approved. Section 4. The City may expend funds which may be � necessary or appropriate in connection with the redevelopment of Project Area No. 1, As Amended. The City Council hereby declares its intention to undertake and complete any proceedings necessary to be carried out by the City under the provisions of the Redevelopment Plan, As Amended.
