HomeMy WebLinkAboutCC RES 91-027 RESOLUTION NO. 9� -2� RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, MJIKING APPOINTMENTS IN A SPECIAL ASSESSMENT DISTRICT WHEREAS, the CITY COUNCIL of the CITY OF PALM DESERT, CALIFORNIA, ie coneidering the formation of a special aesesement dietrict, pureuant to the terma and provisions of �he "Municipal Improvement Act of 1913", being Divieion 12 of the Streets and Ilighways Code of the State of California, for the conetruction of certain public worka of improvement, together with appurtenancee and appurtenant work, eaid epecial assesement dietrict to be known and designated as ASS�SSMENT DISTRICT NO. 91-1 (here- inafter referred to as the "Asaeeement District") ; and, WHEREAS, at this time, thie legielative body is desirous of making the required appointmenta and designating pereone to perform certain dutiee, in order to allow the proceedings to go forward to completion in accordance with the provisions of law. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That the PUBLIC WORKS DIRECTOR ie hereby appointed to perform all of the duties and functione of the Superintendent of Streete ae eaid duties are epecified and deeignated in ttie "Municipal Improvement Act of 1913", being Diviaion 12 of the Streete and Highways Code of the State of California, for the above-referenced Asseesment Diatrict. SECTION 3. Tl�at the place for recordation of the asseeement roll and diagram shall be in the Office of the Superintendent of Streete, and eaid aesesoment roll and diagram, upon recordation, sha11 be kept ae a permanent record. SECTION 4. That the DESERT POST ia hereby deaignated as the newspaper for all publicatione ae required by law and as neceseary for completion of thie Assessment District. SECTION 5. That J. F. DAVIDSON ASSOCIATES, INC. is hereby appointed the Assessment Enyii�eer for eaid proceedinge, and Aaid Aseeesment Engineer sliall perform all of the duties and responeibilitiea ae aet forth by law ae tliey relate to said Asseeament Dietrict. SECTION 6. That BROWN, HARPER, BURNS & HENTSCHKE, Attorneys at Law, ie hereby appointed to act ae Bond Couneel for the purposee of preparing proceedinge and iesuing an approving opinion attesting to the valldity of the proceedings and the enforceability of the bonde. SECTION 7. Ttiat WHIPPLE, KINSELL & CO. , INC is hereby appointed as Financial Consultant to obtain a proposal or bid for the sale of bonde to be issued in order to finance eaid proceedings, and eaid bonde are to be issued pursuant to the terma and proviaiona of the "Improvement eond Act of 1915", being Divieion 10 of the Streets and Highways Code of the State of California. SECTION 8. That this legielative body hereby establishea a apecial IMFROVEMENT FUND � designated by the name and number of the Aasesement piatrict, and into said fund ehall be placed all proceeda from the eale of bonde and cash collectiona. In order to expedite the improvemente or acquieition under these proceedinga and ae •authorized by law, funds from any available source may be transferred into said special fund. Any funds transferred are a loan to the fund and ehall be repaid out of the proceede of the eale of bonde, including authorized incidental expensea, as well as costs for the conatruction of the authorized public improvements, all ae required and authorized by law, and apecifically Section 10210 of the Streete and Highwaye Code of the State of California.
