HomeMy WebLinkAboutCC RES 91-055, . U J r. � RESOLUTION N0. 91-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT. CALIFORNIA ESTABLISHING A SEXUAL HARASSMENT POLICY FOR CITY EMPLOYMENT. WHEREAS. it is desirable for Cities to offer equal opportunity in all matters of empioyment, with employment based solely upon the merit and ability of the individual regardless of race. color. ethnic or natural origin, marital status. age. sex. political or religious opinion or affiliation or physical handicap. WHEREAS. all employees are to be treated with respect and dignity and without any form of harassment. WHEREAS. Harassment on the basis of sex is a violation of Sec. 703 of Title VII. NOW. THEREFORE, BE IT RESOLVED. by the City Council of the City of Paim Desert, California. a Policy in Sexual Harassment is hereby established. a copy of said policy being attached hereto, marked "Exhibit A". and by such reference made a part hereof as though herein set out in full. to be effective immediately. All emp!oyees are to be treated with respect and dignity. A�y form of harassment -- racial, religious. sexual, etc. -- by another employee or supervisor will not be tolerated under any circumstarces. SEXUAL HARASSMENT POLICY Harassment on the basis of sex is a violation of Sec. 703 0� Tit�e V[I. Unwelcome sexuai advances, requests for sex;;ai favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when: (1) Submission to such conduct is made either explicit'y or implicit'y a term or condition of an individual's employment; (Z) Submission to or rejection of such conduct by an individual is used as the basis for emplo�.me�t decisions affecting such individual; (3) Such conduct interfering creating an environment. has the purpose or effect of substantial!y with an individual's work performance or intimidating. hostile or offensive working Common sources of charges include offensive or abusive physical contact, joking, lewd language, suggesting sexual favors. displaying sexually suggestive objects. pictures. magazines. etc. [. Ail employees of the City of Palm Desert are expe�ted to avoid any behavior or conduct toward any �Lher employee which could be interpreted as sexual harassment. � f I. Appropriate management and suAervisory personnel shall make prompt. impartial investigation. resolution of complaints and corrective action when they become aware oF sexual harassment. Such action may incluGe discipline up to and including termination of �ne of�ending employee or employees. The affected employee may appeal the disciplinary action taken against him/her pursuant to this section by �ollowing the procedures outlined in Chapter 2.52 of the Palm Desert Municipal Code. �
