HomeMy WebLinkAboutCC RES 91-0700 RESOLUTION N0. 91-70 A RESOlUTION OF THE CITY OF PALM OESERT, CALIFORNIA, ESTABLISHING AN INJURY PREVENTION PROGRAM POLICY FOR CITY EMPLOYMENT MHEREAS, Title 8, Section 3203 of the California Code of Regulations, requires every employer adopt in writing an Injury Prevention Program. MHEREAS, as a responsible employer, it is the City's policy to maintain an active safety program designed to eliminate occupatlonai related illnesses and injuries among its employees. NHEREAS, the Clty has recognized its responsibility to provide each employee with a safe end healthful work environment. MHEREAS, the Injury Prevention Program will establish safety policies, training and communication processes. NOM, THEREFORE, BE IT RESOLVED, by the City Council of the City of Palm Desert, California, an Injury Prevention Policy is hereby established. A copy of said policy being attached hereto marked "Exh i b i t A" , and by such reference made a part hereof as though herein set out tn full, to be effective immediately. Empioyees are expected to Familiarize themselves with this handbook� and to work together with the City of Palm Oesert's Safety Director to initiate sound safety programs and practices by emp(oyees in their areas of responsibilities. Our efforts must be directed toward preventing losses caused by accidents, rather than straining to recover from them. Altman City Manager 3 RESOL'JTIO� V0. 91-70 CITY OF PALM DESERT INJURY PREVENTION PROGRAM SECTION I - INTRODUCTION 1.0 DEFiNITI0N5 1.0.1 Accident: An untntended. unforeseen event which results in an injury to personnel and/or damage to property or equipment. 1.0.2 Minor or First Aid Injury: Any injury which does ^ot result in lost time from the job. beyond the work s� =t on which the injury occurred. 1.0.3 Disabiing or Lost Time Injury: Any injury Nhich resuits in lost time beyond the shift in which the injury occurred. 1.0.4 Property Damage Accident: Any accident or incident which produces damage or loss to property, facilities or equipment. 1.0.5 City Furnished Motor Vehicle Accident: Any accident resuiting in damage to a City furnished vehicle that requires repair or replacement. 1.0.6 Private Motor Vehicle Accident: Any accident resulting in injury to an empioyee while driving his private vehicie in the scope of employment by the City. 1.0.7 Fire: Any fire. regardless of extent or damage. 1.1 GENERAL 1.1.1 The City of Palm Desert exercises a vital role in providing numerous services for its citizens. This endeavor encompasses many disctplines and diverse activities. These present a broad spectrum of accfdent and inJury potentials. Every effort shall be made to prevent accidents to City employees. resulting in ioss to property and/o� personai injury. 1.1.2 As a responsible employer. it is the policy of the City -- maintain an active Injury Prevention Program 4 'RESOLliTION �0. 91-70 designed to eliminate occupationally related illness and injury among City employees and to assure compllance with requirements of the Californ�a Occupational Safety and Health Act of 1973. �.(.? Prove� safety techniques w•ill be employed in all work 3reas and facilities where hazards exist which are co�mon to industry and government as a whole. Where unique hazards exist. special consideration and study will be exercised to determine the most appropriate safety precautions to be taken, based upon known factors. Nothing must be allowed to compromise sound safety practices in the effective accomplishment of city tasks and services. 1.1.4 In establishing this Injury Prevention Program, the City has recognized its responsibility to provide each employee with a safe and heaithful work environment and encourages each employee to exhibit a positive attitude in developing and implementing safe working habits. The City aiso encourages employees to assist the City in providing a safe environment by making suggestions and reporting unsafe situations. etc. 1.2 SCOPE 1,2.I Provisions of this Injury Prevention Program apply to ail personnel employed by the City, and all activities accomplished by City employees in their regulariy assigned duties. Any deviation from safety requirements outlined in this or other safety publications will be accomplished only by the City Manager, or the Safety Director. This program is published subsidiary to, and complementary with State of California Occupational Safety and Health Act. The pertinent Occupational SaFety and Health Act (OSHA) documents associated with the various subjects and outlined in the safety Program for guidance on'y. Compliance with the Palm Desert Injury Prevention Program is mandatory for City personnel. l.3 GOAL OF THE INJURY PREVENTION PROGRAM 1.3.1 The Injury Prevention Program is established to ensure compliance with the California Occupational Safety and Health Act (CAL OSHA) which requires each employer to: 5 RESOLUTION y0. 91-70 l.� � Establish and maintain a written effective Injury Prevention Program. {.3.3 Provide a safe and healthy working environment for all employees. ;.3.4 Reduce the human and financial losses resulting from injuries and illnesses arising out of employment. 1.3.5 Establish safety policies, training and communicat�ons processes which will contribute to and be a part of the Injury Prevention Program. 1.3.6 Provide periodic safety meetings for emv�oyees based upon the i r exposure and needs as deter- ned by the Safety Committee. 1.3.7 Provide personnel with set standards regarding the consequences of violating safety procedures. SECTION II - AUTHORITY 2. 0 AIJTHOR I TY 2.0.1 The Pa lm Desert [ n jury Prevent i on Program i s established by the City Manager, and incorporates Federal and State Safety Regulations. 2.0.2 As a responsible employer. it is the policy of the City to maintain an active Injury Prevention Program designed to eliminate occupationally related i�lness and inJury among Citj employees and to assure compliance with requ �ements of the California Occupational Safety and �alth Act of 1973. 2.0.3 In establishing the Injury Prevention Program. the City has recognized its responsibility to provide each employee with a safe and heaithfui work environment and encourages eaCh employee to exhibit a positive attitude in developing and implementing safe working habits. 2.0.4 The Safety D i rector sha 1 I be respons ibl e for administering the safety program in a staff capacity, but shali not be authorized to direct the activities of any individual not assigned to the SaFety Department. :� LlF'S�L.�J11�i1 ♦VQ. 7�-7�J Z.0.5 Department Heads, Supervisors� and other individuals exerCising line authority over one or more employees shall be responsible for assuring compliance with ail safety procedures prescribed by the City, with the requirements of CAL OSHA Act of 1973, and with all safety orders prescribed by the Division of Industrial �a`ety. Disciplinary action will be vested in the Department Head. 2.1 POLICY STATEMENT 2.1.1 It is the policy of the City �o provide and maintair, safe and heaithfui working conditions under the Injury Prevention Program. Implementation of these operating practices will safeguard employees and citizens and thereby result in sa�e working conditions and efficient operations at all times. Identification and correction of potentially hazardous operations or conditions shali be reported. and immediate management attention and positive action taken by management. Safety requirements, as contained in the safety documents, will be followed. All levels of training will be used to ensure that the C i ty Nork force i s capabl e of performing its tasks in a safe manner. 2.1.2 Only through an all-encompassing Injury Prevention Program and a positive� constructive attitude toward our safety responsibilities can the City achieve its goal of effective support to employees and citizens. No aspect of the City's task warrants greater attention than human resources. To that end, personnel safety and safety equipment and facilities will never be jeopardized under the guise of operational necessity. 2.1.3 [n establishing the Injury Prevention Program� the City of Palm Desert has recognized its responsibility to provide each employee with a safe and healthful working environment. Below, the following policy items are listed: �. 1.4 The C i ty Manager or the Safety Di rector sha 1 1 be authorized to prescribe those safety policies and procedures necessary to maintain a viable and ongoing Injury Prevention Program. 2.1.5 The City shall establish a Safety Committee, majority of those members shal 1 be employed in a non- supervisory capacity. 7 RESOLUTION N�. 91-70 2.1.6 AIl employees of the City shall be responsible for performing assigned taskS in conformance with the safety procedures prescribed by the City with requirements of the California Occupational Safety and Hea 1 th Act of 1973 and wi th al 1 safety orders prescribed by the Oivision of Industrial Safety. 2.2 �XE"!PTIONS AND WAIVERS 2.2.1 Under certain conditions, precautions that are normally applicable will not permit accomplishment of a particular function. [n such cases, the City Safety Department, with the approval of the City Manager. may aliow a variance by the issuance of an exemption or waiver. A record of all such exemptions or waivers will be mafntained by this office. 2.2.2 EXEMPTIONS From certain safety requirements may be authorized for existing operations or facilities. 2.2.3 WAIVERS are granted for specific situations� are limited as indicated in the authortzation. and do not apply to other locations or to similar operations or conditions. 2.2.4 Requests for variances wi{I be sent to the City Safety Department and will include a determination of the variance clas5. i.e., exemptlon or waiver. The Department will process requests and forward them to the City Manager who wili recommend action for approvai/disapProval. The requesting �epartment wi11 be advised by letter of the variance c' =s and approval or disapproval. 2.2.5 In the event of a major disaster or serious occurrence and where emergency actions are taken to preserve life. limb, or property which normally would require exemption or waivers. the variations will be reported to the City Safety Department as soon as possibie. but not later than twenty-four (24) hours after these eme�gency actions have been taken. SECTION III - OBJECT[VES 3.0 FUNCTIONAL ELEMENTS �'-� RESOL'JTION '_'10. 91-7� 3.0.1 Many of the City of Palm Desert's major departments are involved in work requirements of basically administra- tive and oFfice routines. [n these functions, primary safety considerations involve routine, well-established safety principles. normally experienced in such environments. Safety requirements are more critical in departments such as Public Works. Building 8 Safety and Code Enforcement. Job activities in these departments comprise numerous standard functions, but.due to the environmental elements in which they maY be performed. such functions may become unique in their local appiications. Therefore, in addition to normal safeguards which may be applicable to these activities, special safety consideratlon may be necessary. 3.l MINIMUM REQU[REMENTS 3.1.1 Provisions of this lnjury Prevention Prograrn include the minimum safety requirements and functional responsibilities necessary to meet the City's safety standards and CAL OSHA Safety Act of 1973. Stated in general terms. these are: 3.1.2 , Adherence to all safety directions uniess waiver is obtained. 3.1.3 Surveying alt work areas and operations to determine potentially hazardous work elements or operations functions. 3.1.4 Preparation and use of proper safety procedures in all hazardous operations. 3.1.5 Utilizing proper personal protective equipment and clothing. 3.1.6 Investigating and reporting all accidents. injuries. and property damage. 3. 1.7 I n jur i es occurr i ng at work sha 1 1 be reported for consideration under the Worker's Compensation Act. 3.1.8 Proper pre-operational inspection. operation. and control of rolling stock including vehicles, cranes. hoists and forklifts. 3.1.9 Providing necessary tratning, including initial orientations� on-the-job instructions� and qualifications as necessary. �] R�'SOLUTION ^10. 91-70 3.1.10 Ensuring proper �:ois and equipment are used in all operat i ons and :.hat they are ma i nta i ned i n an acceptabie manner. 3.2 USE OF PROVEN TECHNIQUES 3.2.1 Human oehavior is the only unknown in many day-to-day rout i nes, and that may wel 1 be the primary factor to accidents. Each individual must be constantly aware that routine tasks tend to decrease normal alertness and may result in personal injury or equipment damage if ��mplacency is permitted. Supervisors shouid give constant attention to this factor and frequently monitor aii functions and operations to preclude "short cutting" of proven and establisr � safety principles. SECTION IV - RESPONSIBII.�IES 4.0 INTRODUCTION 4.0.1 As a staff function, the Safety Department shall be responsible for administering the City's Injury Prevention Program. Normally. the Safety Director sha11 not direct the activities or any individual not assigned to the Safety Department. However, as the City's designated Safety Oirector, the Director shai� have the authority to discontinue any activity representing a potential liability to the City of Palm Desert. 4.0.2 Under normal circumstances, however� the r�sponsibiiity for implementing safety policies and prc �ures by the City and for assuring compliance with the ,�AL OSHA Act of 1973. shall be vested in Department Heads, Supervisors. and other individuals exercising line authority over one or more employees. 4.l d.l.l 4.1.2 4.1.3 C(TY COUNCIL Support employee training, education and other safety initiatives and activities. Periodicaliy evaluate the City's loss experiences, exposures and protection and provide policy guidance. Consider the risk management consequences of agenda items of policy changes. � !0 RESOLUTION N0. 91-70 4.2 4.2.1 4.2.2 4.2.3 4.2.4 4.2.3 4.3 4.3.1 CITY MANAGER Establish upper management support and accountability for safety awareness and accident prevention. Review reports of the Safety Committee and designate resoonsibilities to insure effective implementation of Committee recommendations. Monitor safety and loss prevention activities. Periodically evaluate the City's loss experience and liability exposures and alter policies and practices to further limit losses and exposures. The City Manager or Safety Director shall be authorized to prescribe safety policies necessary to maintain a viable and ongoing Injury Prevention Program. SAFETY DIRECTOR INTRODUCTION 4.3.2 Staff direction and managememt of this program wiii be accomplished by the Safety Oirector with authority delegated from the City Manager. This responsibility includes the promotlon and monitorshlp of the Injury Prevention Program, and to recomrnend measures to reduce or eliminate accidents and health hazards. In addition: 4.3.3 4.3.4 4.3.5 4.3.6 The Director shall administer the City's Injury Prevention Program and its components. The Director shall serve as permanent Secretary of the Safety Committee. The Oirector will assist the Safety Committee in formulating safety policy recommendations for submission to the City Manager. The Oirector wili review all Safety Committee recommendations and shall submit such documents to the City Manager for evaluation and appropriate action. 4.3.7 The Director will report to the Safety Committee on final disposition of all recommendations submitted to the City Manager for consideration. � RESOL'JTIO� v0. 91-7� 4.3.8 The Director or a designated representative sha � conduct safety inspections of City facilities o� a quarterly basis in the cornpany of the appropriate department head or a representative thereof. 4.3.9 The Qirector or a representative shall produce an inspection report detailing the condition of each site ar�d shall forward such report to the City Manager and to the department head for corrective action if warranted. 4.3.10 The Director or a designated representative shall secure assistance from federal or state labor departments, insurance carriers, safety councils� or other recognized safety authorities on matters pertafning to occupational safety and health. 4.3.11 The Director or a designated representative sha maintain those files and records necessary f�:r administering the City's Injury Prevention Program and for conforming with record-keeping requ;rements of the California Occupationai Safety and Health Act of 1973. 4.3.12 The Director will provide technical guidance and direction to City personnei and all levels of management in the lmplementation of the Injury Prevention Program. 4.3.13 The Director wiil consult With departments on the use oF equipment and safety standards. 4.3.14 The Director shall inspect C'ty fac��ities to detect existing or potentiai accident and he�'th hazards and recommend corrective or preventive measures where necessary. 4.3.15 The Director wili participate� as necessary, in t�e investigation of accidents and injuries and coopera-e in preparation of material and evidence for City use. 4.3.i6 The Oirector shall assist in developing city-wide training programs. 4.4 DEPARTMENT policy and procedure at the aporopriate functional level. a.a.3 To accomplish this objective. the City has designated �`_� department heads, supervisors. and other �^di�iduals exercising line authority over one or more employees as being responsible for assuring compliance with the safety policies and procedures of the City, with requirements of the California Occupational Safety and Health Act of 1973 and with applicable safety orders prescribed by the Division of lndustrial Safety. 4.4.4 Moreover, these individuais are vested aith the direct authority and responsibility for the safety practices of all employees under their direction and for the sa�e performance of machines, equipment and operations under their control. 4.4.5 However� no supervisory employees shall be responsible for the safety performance of empioyees or equipment not subject to their direct line of authority. 4.4.6 DEPARTMENT NEAO RESPONSIB[LITY 4.4.7 Each department head shall enforce ail safety polic�es and procedures prescribed by the City and shall assure departmental compliance with the Ca}ifornia Occupational Safety and Health Act of 1973 and with applicable orders of the Divison of Industrial Safety. 4.4.8 The Safety Director in conjunction with each department head shall develop a comprehensive plan whereby the City's Injury Prevention Program wili reach and affect every employee in every job and wi I 1 encourage a Positive attitude in developing and implementing safeworking habits and elimination of occupationaily related illness or injury. a.a.9 Each department head shall {nsure that line supervisors under his dtrection execute their safety responsibilities at all times. 4.4.10 Each department head shail review with Safety Director and the appropriate line equiprnent. facilities. materials. and working conditions are sat'sfactory from an accident/inJury prevention standpoint. 4.4.13 Each department head wi 1 1 confe� with the Safety Department when assistance is neeaed in implementin= the Injury Prevention Program. 4.4.14 Each deRartment head will initiate necessary action t_ ensure compliance with safety requirements establishea for hazardous conditions� locations or operations. 4.4.15 Each department head wili make certain that all injured persons� regardless of how minor the injury. receive prompt medical treatment. investigate circumstances causing the injury. and submit required accident reports. 4.4.16 Each department head wiil use the Safety Committee for continuing the safety training programs. 4.4.17 Each department head will maintain on-the-job training and saf ety tra i n i ng when such tra i n i ng i s offered by the City and also provide re-training as needed. 4.4.18 Each deRartment head will continuously and regularly motivate employees to support safety effort through personal example, interview with employees, safety meetings, display of safety promotional posters, signs and when applicable exhibits on safety builetin boards. etc. 4.5 SUPERV[SORS AND CREW LEADERS 4.S.1 (NTROOUCTION 4.5.2 While safety is everyone's responsibility, the most essential elements needed to provide an ?ffective� (4 RESOL•'JTION N0. 91- 70 responsive safety program are the supervisors and crew leaders because they are responsible for ensuring that the tasks are done and they have the resources by which to perform these tasks. It is by their attitude� ideas, and thoughtful actions that the tasks are accomplished without per5onal injury or equipment �amaqe. 4.5.3 Administrative and supervisory personnel are responsibie for the safety of all employees under their supervision, direction or control and for the safety of equipment and property in their area of accountability. 4.5.4 Failure to observe City and departmental health and safety rules or for allowing violation of such rules to go unreported shall result in disciplinary action in accordance with the Policies and Procedures of the City of Palm Desert. 4.5.5 Because of the importance of these positions to the safety objectives of Palm Desert, well-trained� weli- informed, and safety-mativated individuals should be assigned these duties. Supervisors and crew leaders are to ensure that: 4.5.6 RESPONSIBILITIES 4.5.7 "Each line supervisor" shall ensure employees are taught the importance of maintaining a safe attitude and that action will be taken if a mishap occurs per Section 7.3.1. 4.5.8 "Each line supervlsor" shall ensure employees working hazardous operattons are instructed to report promptly to their supervisor ail malfunctions of equipment, absence of safety devices, or improper procedures. 4.5.9 "Each line supervisor" sha11 ensure that periodic safety training classes are conducted for all employees. 4.5.10 "Each line supervisor" shall ensure all tools and equipment in use are inspected at frequent intervals and kept in a safe and serviceable condition. l5 RESOL'JTION N0. 91-70 4.S.11 "Each line supervisor �hall ensure untrained employees are not permitted � operate any mechanical or electrical equipment volved in hazardous operations. 4.S.I2 "Each lir�e supervisor" shall ensure employees are instructed in the reporting of aIl accidents and the necAssiryo uf receiving first aid or medical treatment ?ven in the case of a minor inju�y. 4.5.13 "Each line supervisor" shall ensure that there is a continuous program of on-the-job training and supervision of all potentially hazardous activities. 4.5.14 "Each line supervisor" shall ensure that all protective devices and safety equipment provided are properly ma��tained and in use. 4.5.15 "E_=h line supervisor" shall ensure employees are physically qualified to perform their work. 4.5.16 "Each line supervisor" shall ensure an individual with a medical history or organic disorder will not be assigned to duties which may aggravate their condition. 4.5.17 "Each line supervisor" shall ensure areas prescribed as dangerous are conspicuously marked. 4.5.18 "Each line supervisor" shall only ailow as few persons as possible to enter hazardous duty and Nork areas. 4.5.19 "Each line supervisor" shail be responsible for assuring safe working habits among their employees and for safe performance of the machines, equipment and operations under their control. To indicate thi: concern and to eliminate the possibility of an accident. injury or health hazards on City premises, the City has delegated a health and safety responsibility to each employee. 4.6.3 Indivtdual employees are responsible for their own health and safety and for that of those with whom they work. In performing assigned tasks, each employee +s responsible for observing City and departmental health and safety procedures and for assuring compliance with such regulations by all fellow employees. d.6.4 Each employee sha11 be alert to unsafe conditions and shall report such c:nditions -o his/her immediate supervisor. 4.6.5 Failure to observe City and departmental health and safety rules or for aliowing violation of such rules to go unreported shall result in disciplinary action in accordance with the Policies and Procedures of the City of Palm Desert. 4.6.6 The Occupational Safety and Health Act of 1970 and the California Occupational Safety and Health Act of 1973 are federai and state laws designed to assure safe and healthful working conditions for all employees. These acts establish occupational health and safety standards in accordance with American National Standards �3 RESOL'�TIOP1 �10. 91-70 Institute and National Fire Protection Associatio� recommendations. Such standards became effective August 27, 1971, and shall rernain effective unti� revised by the California Occupational Safety and Health Administration. 4.6.7 Sa�ety o�ders issued by the State of California s�ai! remain efFective until revised or until superceded by California Occupational Safety and Heaith Standard�s. 4,6.8 CaliFornia Workman's Compensation shall be the governing law in relation to occupational injury ur illness or in relation to the death of employees �ising out of or in the course of employment. 4.6.9 Each employee shail operate only that equipment which he/she has been authorized to operate and on which he/she has received appropriate safety instructions, and has appropriate license, certification� etc. 4.6.10 Each employee shall wear personal protective equipment as assigned. 4.6.11 Each employee shall avoid distracting his/her fellaw employee and in engaging in activities that may cause inattention and resuit in an accident or injury. 4.6.12 Each employee shall be familiar with and observe ai' safety policies and procedures prescribed by the City and shall take an active part in the City's Injury Prevention Program. 4.6.13 Each employee shall implement all safety instructions provided by hts immediate supervisor. Moreover, it is desirable to secure employee recommendations in formulating safety policy and in generating an attitude conducive to safe working habits. 4.7.4 To assure significant employee participation in the Injury Prevention Program, the City has created an eight member Safety Committee, the majority of whose members are employed in a non-supervisory capacity. 4.7.5 4,7.6 The Safety Committee meets on a regularly scheduied basis and may convene a special meeting at the direction of the Committee Chairman. RESPONSIBILITIES 4.7.7 The Safety Committee shall receive, investigate and respond to all employee suggestions and to all complaints concerning alleged safety hazards. Supervisors, crew leaders and crew members • will be responsible to ensure that all newly assigned individuals receive adequate orientation training to quickly prepare them to exercise their responsibilities in a safe and efficient manner. Formal training will be provided for all em�loyees engaged in hazardous operations such as che�icals, pesticides, en*ering confined spaces. and �ther functions des :nated hazardous by the City Safety Director or afety Department. S.l TRAIN(NG PROGRAM 5.1.1 The training of empioyees is an ongoing operation within the City. An important element of this training is safety which will be incorporated into all training sessions whenever appropriate. Training wiil involve three areas: 5.1.2 Generalized training relating to the overall activities of the employee as it relates to the City. 5.1.3 Specific training relating to the job assignments �f the employee. 5.1.4 Hazard training relating to those portions of tne employee's job assignments which are deemed to be hazardous. Those employees exposed to hazardous materials will be trained in accordance with the CTty's Hazardous Materials Program. This training is offered at City expense in recognition that employees with this training are more safety conscious and less likely to become injured either on or off the job. This training is subject to scheduling by the Safety Director. or a designated representative, to insure proper training class size and that City work schedule is not unduly impaired. 5.4 5.4.; FIRST AIO SUPPLIES INTROOUCTION S.a.2 1t �s the policy of the City to provide approved first aid kits to each work area to insure that in the event of injury. basic first aid supplies are available for use. These inspections are a part of a cont i nu i ng effort to i nsure a safe working environment for City employees and for the protection of City property. 6.l 6.1.1 6.1.2 6.1.3 6.1.4 SAFETY INSPECTIONS Insaections conduct_ by the City Safety Departrnent will consist of: Spot Inspections, an unannounced walk-in quick look. at specific areas or functions. Formai safety surveys, a thorough inspection of all activities. Special survey, a one time inspection of various work areas to determine conditions or status of items of special emphasis. Z6 RESOLUTION N0. 91-70 6.2 GENERAL INSPECTIONS 6.2.1 A generai inspection of all areas wiii be made semi- annually by the Safety Director or his designee. 6.2.2 This inspection shall be announced in advance and will be made in the company of the department head or his designee. 6.2.3 A written report of the inspection will be submitted to the City Manager� the department head� and the supervisor, with safety hazards or violations noted. if any. 6.2.4 The report will specify the length of time in which the hazards or violations shali be corrected, and corrective action will be the responsibility of the department head. 6.2.5 When corrective action cannat be accompiished within the specified time, the department heed shall make a written report to the Safety Department stating if the reason is lack of time� materials or budgetary. 6.3 FIRE EXTINGUISHERS 6.3.1 Al1 fire extinguishers, excepting those in vehicles. shall be inspected monthly by a City Employee assigned the responsibility by the supervisors or the department. Names of employees so assigned shall be supplied to the Safety Department. 6.3.2 Inspection will be to insure that extinguishers are in their designated places, to insure they have not been activated or tampered with� and to detect any obvious physical damage. corrosion or other impairments. 6.3.3 The date of i nspect i on sha I 1 be recorded. w i th inspecting employee's initiais on the tag attached to the extinguisher. 6.4 1NJURY/ACCIDENT INVESTIGATION 6.4.1 Accident investigations within Palm Desert wili be conducted in accordance with City Auto Accident policies. Unit Supervisor - bi-monthly Inspections will be conducted in accordance with written Hazard Inspection checklists. 7.1.5 Operational and Training checklists will be utilized involving equipment/operations deemed hazardous. 7.1.6 Workers Compensation accident/injury reports will be reviewed by the Safety Otrector. 7.1.7 Hazardous safety procedures will be conducted as specified in the written Right to Know Act, Sara Titie III. 7.1.8 Supervisors will complete an Emplovee In�ury [nvestiaation Report invoiving any employee under their supervision within 24 hours of the accident to the Safety Director. 7.2 METH005 ANO PROCEDURES FOR CORRECTING UNSAFE AND UNHEALTHY CONDITIONS AND WORK PRACTICES 7.2.1 [NTRODUCTION 7.2.2 It is the objective of the City to correct unsafe or unhealthy conditions and work practices as expeditiously as practicable. To see that corrective actions are taken in a timely manner. the foliowing policies and procedures have been adopted: 29 RESOLUTION v0. 91-70 7.2.3 Accident reporting has criority handling. When such work has been completed� a copy of the form verifying completion of such repair work will be sent to the Safety Director. 7.2.6 Engineering controls will be implemented when necessary to remove noxious fumes. reduce excessive noise. etc. 7.2.7 Administrative controls will be implemented when necessary (i.e. rotating employees at stressful work>. 7.2.8 Personal Protective Equipment wil �e utilized by employees in all appropriate cases. 7.2.9 A suggestion box is in place to receive complaints and suggestions. 7.2.10 Posters will be installed in appropriate areas to remind employees of safety habits. 7.2.11 Training films will be used in safety meetings when appropriate. 7.3 OISCIPLINARY POLICY ANO RECORD KEEPING 7.3.1 Failure of management personnel to support and comply with the safety objectives of the City as expressed in this and other safety manuals wili be viewed as the 30 RESOLU�ION N�, 91-70 7.3.2 7.3.3 inability or unwillingness of the individual to perform a necessary and vital part of their job assignment. In such a case progressive disciplinary measures which are included in the personnel ordinance will be initiated to assure future compliance. RecorCs of training, safety meetings and other documentation as prescribed in this and other manuals shall be maintained for a period of five years. Empioyees incurring an occupational injury or iliness shall immediately report such injury or iilness to their supervisor. 7.3.4 The employee's immediate supervisor shall ensure that the employee receives proper first aid and� when advisable� shall refer the employee to the City physician for examination/evaluation and possi'ble emergency treatment or referral. 7.3.5 [n the case of serious or life threatening accidents or accidents which occur outside the normal office hours, the employee may be taken directly to the Eisenhowever Hospital Emergency Room. 7.3.6 Employees reporting to the Eisenhowever Hospital Emergency Room for examination/evaluation shall bring the bottom portion (Industrial Medical Service Order) of the Supervisor's Report of Employee Injury (Form O1001) which has been prepared and signed by their immediate supervisor. 7.3.7 The employee's immediate supervisor shall immediately submit the original of the Supervisor's Report of Employee Injury to the Personnel department for transfer to the Occupational Safety and Health Log and for inclusion in the individual's file. (copy of form attached) 7.3.8 In the event of ocupational injury or illness, the Personnel Department shali complete the Employer's Report of Occupational [njury or Illness (Form 5020) for submission to the City's Worker's Compensation Administrator within five working days. 31 RESOLUTI0IV V0. 91-70 7.3.9 The Personnel Department shal 1 �tain a_og of Occupational Injuries and Illness� required by the California Occupational 5afety and Nealth Act of 1973 and shall enter required information in such log within 5ix working days of receiving information that a �-ecordable incident has occyrred (CAL OSHA No. 200). 7.3.;0 Occupational injuries or illnesses resulting in death or in-patient hospitalization shall be reported immediately to the City Manager, the Human Resources Department, and Safety Department. Additionally. occupational injuries resulting in death or in-patient hospitalization� for a period in excess of 24 hours for other than medical observation or in which an employee suffers loss of any member oF the -�dy or any serious degree of permanent disfigurerne- shall be reported immediately by telephone or rac to the District Office of the California Division o Industrial Safety. San Diego� California� by the City Manager or an authorized representative. 7.3.11 Within one month following the end of each calendar year, the Human Resources Department shall complete a Summary oF Occupational Injuries and ilinesses req��ired by the California Occupational Safety and Health Act of 1973 (CAL OSHA No. 200). Such summary shall include all reportable injurtes occurring during the calendar year and shall be displayed on the Personnei Department Bulletin Board for employee inspection for a minimum of thirty days beginning no later than February lst. In all instances� however. the Summary of Occupational Injuries and [linesses shall remain posted until March 15t. 7.3.12 All records relating to occupational injury and iliness shall be retained by the Personnel Department for a minimum of five years. SECTION VIII - COMMITTEE. If not, meetings wi 11 be held as regularly as possible under existing circumstances. Minutes of the meeting will be distributed to all appropriate personnel and maintained by the SaFety Director for a period of five years. 8.1.2 In maintaining a viable Injury Prevention Program. it is important to encourage employee participation in isolating potential safety hazards and in reducing or eliminating such hazards. 8.1.3 Moreover, i t recommendations generating an habits. is desirable to secure employee in formulating safety policy and in attitude conducive to safe working 8.1.4 To assure significant employee participation in the Injury Prevention Program. the City has created an eight member Safety Committee. the majority of whose members are employed in a non-supervisory capacity. 8.I.5 The Safety Committee meets on a regularly scheduled basis and may convene a special meeting at the direction of the Committee Chairman. 8. 1.6 Safety and Acc i dent Revi ew Commi ttees wi 1 1 be established and used by Department Heads to assist management in promoting safety awareness among employees. Safety Awards Programs will be conducted by City Departments. The Safety Department will assist Department Heads in the promotion of safety activities and safety awareness among empioyees when requested. 8.1.11 Ea�h department he_: will select a repr ,tative from their department to serve as a Safety Co: �tee member. 8.1.12 Each Safety Committee member will serve a twelve month term on the Committee. 8.1.13 The Safety Director or a designated representative shall serve as a Secretary of the Safety Committee on a continuing basis. 8•2 ORGANIZATION 8.2.1 The Chairman of the Safety Committee shal l be responsible for conducting the Committee's business meetings� for convening special meetings as necessary and for assigning required projects to Committee members or to a duly constituted sub-committee. 8.2.2 The Secretary shall be responsible for maintaining ac�urate proceedings of the business of the Safety Committee. 8.3 SAFETY SUGGESTIONS 8.3.1 Safety suggestions by individual empioyees wiil be processed through Safety Department to the City Manage� for consideration and adoption. Those accepted wil! receive awards and/or letters of appreciation or commendation. 8.4 REPORTS 34 ;;ESOLUTION rJO. 91-7� 8.4.1 A quarterly safety summary report will be prepared bv the Safety Department and sent to the City Manager. 8.4.Z The appropriate Workmen's Compensation report will be forwarded to the Safety Department for use by the Safety Director in carryi'ng out his duties and for �r�paring his summary report to the City Manager. 8.5 COMMUNICATION OF SAFETY AND HEALTH MATTERS 8.5.1 The City encourages all employees to offer suggestions regarding safety at anytime. Suggestions may be made verbally or in writing. "Safety Suggestion" forms are available in all departments and the Safety Oepartment. The originator retains one copy and submits two copies to the supervisor who retains one copy and forwards the other copy to the Safety Department. Supervisory personnel are to emphasize to employees that ali suggest i ons are va 1 ued and apprec i ated and i n no way will any suggestion reflect poorly on the employee or jeopardize the employee's position. Safety Committee will review all safety suggestions. Employees making suggestions will be notified of the results. If rejected, the employee will receive an explanation as to the reason(s) for the rejection. [f accepted, recognition and an expression of thanks will be extended to the employee. Since effective communication directly relates to prompt communication. the person making the suggestion will receive an appropriate response no later than fourteen days from the date of the suggestion. At the completion, a copy of the "Safety Suggestions" form will be kept in the employee's personnel file and that of the Safety Department. 8.5.2 Effective communications of safety and health matters will also consist of ineetings, seminars. bulletins, posters. field training and workshops. Care will be taken to see that all forms of training will be communicated in a language the trainee understands. It is the responsibility of each empioyee to maintain safety shoes. 9.1.6 Replacement of safety shoes shall be at the City's expense. 9.2 PROCEDURE 9.2.1 All empioYees required to wear safety shoes must present themselves in safety shoes on the first day of active employment. �I5 RESOLUTIO:d N0. 91-70 9.2.2 Employees failing to wear safety shoes as required shall not be permitted to work and shall be sent home without pay. 9.2.3 Employees failing to wear safety shoes on a continuing basis shall be subject to disciplinary action in accordance with the Palm Desert personnel policies of the City. 9.2.4 Employees not presently required to wear safety shoes but who, through change of work assignment or change in the Safety Shoe Policy. become required to wear safety shoes shall obtain approved safety shoes within fourteen working days of the change. 9.3 HARD HATS 9.3.1 INTRODUCT[ON 9.3.2 It is the policy of the City to require aii empioyees of the Bu(iding and Safety Inspectors/Code Inspectors/Publfc Works Maintenance and fieid engineering departments to wear CA� OSHA approved hard hats whenever exposed to hazards of flying or falling objects. 9.4 PROCEDURES 9.4.1 Hard hats will be supplied by the City to all employees affected by this policy. 9.4.2 !t is the responsibility of each employee, however, to prevent loss or damage� through carelessness or improper use. of this protective equipment. 9.4.3 Hard hats lost by the employee will be replaced at the employee's expense. 9.4.4 Hard hats damaged, on the job� to the extent that they no longer �urnish adequate protection wifl be repiaced at City's expense. 9.4.5 Hard hats shall be worn on all of, but not lirnited to the following job assignments: 9.5 HARD HATS MANDATORY 37 ?�FSOLTJTION N0, 91-70 9.S.1 Builcfing and Safety [nspectors personnel whenever inSPecting a job where overhead construction work is �n progress. 9.5.Z St�eet Maintenance Department personnel whenever in an Anv�ronment in which overhead construction work is in �rG��ess or whenever risk of head injury is present. 9.5.3 Vi;itors. and other employees, whenever entering areas posted as hard hat area. 9.6 EXCEPTIONS 9.6.1 Hard hats need not be worn while in the enclosed cab o* a truck, or in a City automobile, rest room. or office areas. 9.6.2 Hard hats need not be worn by mec�3nics when performing maintenance or repair work o� City vehicles. 9.6.3 Hard hats need not be worn when made optional at the discretion of the Safety Committee. Siae shields are optional unless deemed mandatory by the employee's supervisor. Any of the above wi11 be supplied at City expense. Lens prescription must be from any eye examination within six months prior to employee's request for prescription lens. 9.7.5 Safety glasses become the property of. and the responsibility of, the emp!oyee. In case of loss, replacement will be at the employee's expense. 9.7.6 Safety glasses damaged. on the job� to the extent that they no longer furnish'adequate protection� will be replaced at City expense. if the glasse5 had prescription lens. the added cost for this replacement will be at City expense. Replacement needs will be determined by the employee's supervisor. � � MANDATORY WEARING OF FACE PROTECTORS, GOGGLES, OR SAFETY G�ASSES Approved face protection welding helmets must be worn by all employees when engaged in electric - arc or oxy- acetylene welding or cutting. 9.8.2 Approved face shields must be wor when pouring, mixing, pressurizing, caustics, solvents. �esticides� or (other than when fuel�ng vehicles). n by all employees or applying acids, petroleum products 9.8.3 Approved goggles� safety glasses. or face shieids must be worn by all employees when chipping, chiseling, hammering. or when operating air or electrically driven tools such as drills, table saws. chain saws. circular saws, etc. 9.8.4 Approved goggles or safety gtiasses shall be worn on any job assignment deemed hazardous by employee's supervisor - such as during wind or blowing sand environment. SECTION X- PURCHASING/CONTRACTS FOR SAFETY EQUIPMENT l0.0 INTRODUCTION 10.0.1 ]t is the policy of the City to conform to the safety regulations of the California Occupational Safety and Health Administration (CAL OSHA). 39 RESOL'JTION �10. 91-70 10.0.2 To ensure that materials or equipment purchasea or made by C i ty emp i oyees are i n conformance w i th CAL OSHA requirements, the following procedures will ee followed: 10.1 PROCE�URES 10.1.1 Purchase orders, purchase contracts� or requests for bids shall contain the following statement: "The articles covered by this (Purchase Order, Contract. or Request for Bid) must equal or exceed OSHA or CAL OSNA requirements, whichever are more stringent. and must conform with the safety orders of the State of California, Division of Industrial Safety." 10.1.2 [t is recommended that the facilities of the Off' � of the Safety Director be used whenever there is do�_ : as to whether a contemplated purchase� design� or wo�k order conforms to CAL OSHA safety regulations and requirements. This wi11 not include the enforcement procedure�. 11.0.3 State of California Fire Marshall Rules 8 Regulations 11.0.4 Uniform Building Code the latest edition. il.l PROCEDURES 11.1.2 Procedures concerning work related injury to employee are as specified in Section 11.4. 11.1.3 Procedures regarding vehicle accidents involving City personnei as specified in Section 11.8. 40 RESOL'_LTION id0. 91-70 11.1.4 11.1.5 11.2 Procedures regarding property damage, vandalisms, etc., are as specified in Section 11.2.1. Procedures concerning safety and loss prevention as specified in Section V1I. SArETY OFFICE 11.2.1 Independently investigate accidents involving serious injury or major property damage, theft. vandalisms and inc�dents which indicate a potential for serious injury or property damage. 11.2.2 Provide assistance to Department Heads and Supervisors in their accident investigations when requested. 11.2.3 Assist the insurance carrier in its investigations when requested. Such investigation shall not interfere with the insurance adjuster, or result in his being unable to obtain necessary information for his reports. 11.2.4 Review accident reports received from Department Heads and Supervisors for proper classification of causes and appropriate corrective measures as may be necessary in coordination with applicable Oepartment Head or Supervisor. 11.2.5 11.2.6 11.3 Compile statistical data from reports and provide such data to the City Manager on a quarterly basis. The Safety Department will set up files as appropriate. EMERGENCY PROCEDURES (1.3.1 The injured employee's responsibie supervisor. through the City's Communications System. will immediately notify the Safety Department when an accident invotiving serious personal injury or extensive property damage occurs. The supervisor will follow Sections 7.3.10. 11.4 REPORT[NG REQU[REMENTS FOR INJURIES l;.a.l GENERAL ll.a.2 Records of all accidents are essential to efficient and successful loss prevention work. Records supply the 41 RESOLUTION N0. 91-70 information necessary �o transform haphazard. costly, inef�ective loss prevention work into a planned program that controls the specific conditions and act that cause accidents. The Safety Department wiil enforce the completing and forwarding of various accident and i�ss rorms as required•in the appropriate APDR ;A��i�ent Property Oamage Report). ll•5 POLICY 11.5.1 POLICY: In every case, all employees must immediately report any on-the-job injuries or accidents to their supervisor and complete an "Empioyee's Statement of Injury" Form (see Exhibit I attached.) 11.5.2 Supervisor's shall complete and file with Personnel, their "Supervisor's Report of Accident" within 24 hours of ocurrence (see Exhibit [1 attached). 11.5.3 Should an employee be injured while working on a weekend or a holiday. both reports will be submitted on the next working day. 11.6 PHYSICIAN'S REPORT OF MEDICAL VISiT: Eisenhower Immediate Care Centers� in La Quinta and Cathedrai City iyou may use either facility) will complete a Physician's Report of Medicai Visit (see Exhibit fII attached), for every employee treated. The supervisor should forward the report copy to Personnel and the Safety Department. 11.6.2 The Eisenhower Irnmediate Care Center wi11 fiie a written report with the City of their findings and medical treatment. If the employee is to remain "ofF work", the Center wiil notify the City by telephone as well. The employee's supervisor and Personnel should be notified as soon as possible and a copy of the Emergency Room Report should be given to Personnel. 11.8 REPORTING VEHICLE ACCIDENTS 11.8.1 Operation of vehicles is usually indispensable in conducting some City business. Vehicular coliisions cou I d be the most cost 1 y 1 oss Nhen we add prOperty damage, bodily injury, fatalities and liable suits. 11.8.2 Each employee us��g City or personal vehicles on City business under the Motor Vehicle Collision Control Policy shall report in writing using the "Vehicle Accident Incident Report". 11.9 PROCEDURES 11.9.1 Any injury, as a result of a vehicle accident, shall Ce reported using the "Employee Report of [njury and Supervisor's Review" form. 11.9.2 Accidents involving a fatality shall be reported immediately to the City Manager. Safety Director. and Department Head. 11.9.3 The Supervisor will complete the "Supervisor's Report of Accident" form and indicate what steps have been taken to prevent similar accidents. 11.9.4 A"Sheriff's Accident Report" will be required for ali auto accidents. 11.9.5 The "Supervisor's Report of Accident," the "Vehicle Accident Report/Incident Report�" the "Sheriff's Report�" the "Employee Report of Injury" (if applicable) shail be submitted to the Safety Department within three working days of a vehicle accident. 43
