PER�On OF J":YLY 1, 1992 THROUGH JUNE 30, 1993. THIS RESOLUTIOAI RESCINDS AND REPLACES RESOLUTION NO. 91-83. WHEREAS, the City of Palm Desert has met and conferred in good faith with the Palm Desert E:mplo�ees Orqanization (PDEO) in accordance with the Meyers-Milias-Brown Ac� and the City employer- employee relations Resolution No. 81-89; and WHEREAS, the City of Palm Desert has reached agreement with the employees represented by the Palm Desert Employees Orqanization, for the period of July 1, 1992 through June 30, 1993. P10W, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PALM DESERT AS FOLLOWS: SECTION I-- SALARY SCHEDULE, RANGES & ALLOCATED CLASSIFICATIONS All employees shall be classified and shall receive compensation for services performed. This compensation shall be in accordance with the established salary schedule as attached and salary ranges for their respective classification as shown below and on the attached Memorandum of Agreement related to salary setting. 5pecific terms for appointment and tenure of all City employees are prescribed in the "City of Palm Desert Personnel System" as found in Section 2.52 of the Palm Desert Municipal Code. Unless referenced otherwise, all benefits in place on July 1, 1992, will continue as constituted. 4 SECTION III -- EXEMPT PERSONNEL The following positions that require spendinq numerous extra hours at meetings, conferences and work are exempt from overtime provisions as set forth in the Personnel Rules and Regulations, Section 2.52.250. City Manager/Director, Economic Development Director, Finance/City Treasurer Director, Human Resources Director, Buildinq & Safety Director, Code Comp�iance City Clerk & Public Information Officer SECTION VI -- VACATION BUY-BACK ""--� Development All regular full'time personnel, both exempt and non-exempt, instead of taking leave time off, may, at their option, be compensated for vacation time earned by receiving pay at the hourly rate of their salary, up to a m3ximum of forty hours per calendar year, with the added requirement, for both exempt and non-exempt personnel, that after the buy-back, eighty (80) hours credits must be left available on the books for vacation leave. SECTION VII -- RETIREE HEALTH CARE PROGRAM The specifics of this plan are included by reference and attached under the title of "City of Palm Desert -- Retiree Health Care Proqram -- 6/12/92." The City Council is approving the Statement of Purpose, Section 1. Eligibility, Section 2. General Provisions, and Section 4. Annual Recertification Update, at this time, with an effective date of July 1, 1992. Additionally, the City Council has not approved Section 3-- Costs, at this time. Staff is directed to further study cost impacts and related issues and report this information back to the City Council within three months. .Until further notice, retirinq employees will be allowed to buy into the group medical plan at their full expense provided they meet the qualifyinq eligibility criteria as outlined. SECTION VIII --SICK LEAVE INCENTIVE PROGRAM STATEMENT OF PURPOSE: The City of Palm Desert has paid sick leave for full-time employees. If employees need to use this benefit for legitimate purposes, they are encouraged to do so. The purpose of this program is to reward employees who do not over use the sick leave benefit. C� �'ESOLL`TION ti0. 92-5� A. Effective July 1, 1992, upon termination, employees can be compensated at their current hourly rate for a percentaqe of their unused sick leave provided they meet certain minimum qualifying criteria as follows: 1. The employee must have at least 192 hours of accrued sick leave on the books on the date of termination. 2. All service time must be full-time paid city service in order to qualify. B. The percentage cashout assuming the above criteria are met is based on the following payout schedule: Less than four years of service = p Over four but less than seven years of service = 25$ Over seven but less than ten years of service = 35$ Over ten but less than thirteen years of service = 45$ Over thirteen but less than sixteen years of service = 55$ Over sixteen years of service = 65$ C. Since the City has a PERS Sick Leave Credit Conversion option, the employee may choose, upon retirement only, not to cash out any percentaqe of sick leave and instead have his or her entire unused sick leave balance converted to service credit for retirement calculations. SECTION IX -- INCREASING DENTAL BENEFITS Staff will amend the current dental benefit, effective August 1, 1992, to increase the maximum dollar limit for services from �1,500 to $2,000 and addinq orthodontia coverage ($1,000 lifetime benefit at a 50$ co-pay). This change will be for both the covered employee and covered dependents. 5ECTION X-- REMOVAL OF AUTO ALLOWANCE IN SUPPORT OF RIDESHARE 5ince auto allowance was paid to both management and represented employees, it was necessary to enter into a supplemental MOU with those affected. The specifics of this program are included by reference and attached as "Exhibit A". SECTION XI -- OFFICE HOUR CHANGE & PILOT PROGRAM Effective Auqust 1, 1992, city hall will be open from 8:00 A.M. to 5:00 P.M. Affected employees will work with their respective department heads in making sure coverage is maintained under the existing 37.5 hour workweek sc�:edule. This will necessitate using flexible schedulinq of employees. The intent of this change is to provide better customer service to the gublic. In December of 7 �ESOLliTION �0. 92-5� 1992, a joint labor and management committee will provide an "evaluative report" to the City Council on this pilot program. Evaluative criteria will be established and used in the report to determine whether this pilot program should continue beyond February 1, 1993. If, in the report, it is identified that such a flexible schedule is not working, a forty hour workweek schedule with coverage from 8:00 A.M. to 5:00 P.M. will begin on February 1, 1993 with those positions which are affected to be specified at that time. SECTION XII -- MEMORANDUM OF AGREEMENT BETWEEN THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA AND THE PALM DESERT EMPLOYEES ORGANIZATION RELATED TO SALARY SETTING A program and criteria for employee compensation studies is continued for the future, as set forth in the memorandum of agreement, attached hereto as "EXHIBIT B". SECTION XIII This resolution is effective upon adoption. The provisions relatinq to salary and other compensation shall be effective and where applicable, accrue on, and from July 1, 1992. This program is not meant to be to the sole source of health care coverage should other coverage be available to the retiree. This program rewards via the cost structure long term city employees who have given diligent service to the City durinq their working years . 1. ELIGIBILITY: All full-time or part-time employees receiving health care insurance coverage throuqh the City of Palm Desert are eligible to participate in the "Retiree Health Care Program" provided the following minimum criteria are met: A. Employee must have at least ten years of continuous service with the City of Palm Desert. . B. During said employment, the employee must continually be_ . covered by health care insurance provided by the City. C. The employee must retire from the City of Palm Desert and the Public Employees Retirement System (PERS). D. The employee must be at least aqe 55 at the time of retirement. E. If, for any reason, the employee is precluded or partially restricted from participating in the City's health care insurance plan as an active employee, those same preclusions and restrictions will be in effect as they relate to retiree health care eligibility. F. Only individuals employed by the City of Palm Desert on ' or after the effective date of adoption are eligible to participate in this program. This program does not cover employees who retired prior to the effective date of adoption. 2. GENERAL PROVISIONS: A. Coveraqe. The retiree health plan components will remain the same, to the extent possible, with the City's primary health care insurance plan. The primary health care plan is determined solely by the City. B. Single Plan Proqram. The retiree health care program is intended to have only one option, that beinq the City's primary health care insurance plan. 'SOL�TIO� �0. 92-55 C. Chanqe in Coverage. If, for any reason, the City elects to change the primary health care coverage in the future, retirees will also be placed under the new health plan. This is to insure that there is no disparity in coverage between active and retired employees. Please note this means if you retire, the City could change the medical plan in the future for both active and retired employees if it was deemed necessary. D. Continuation Plan. This plan is intended to be a continuation plan of the City's primary health insurance plan so that there will be no interruption in coverage. In order for this plan to be properly administered, active employees who are not covered by the primary health insurance plan prior to retirement, will be required to switch coverage to the primary plan during any open enrollment period prior to the effective date of retirement. Failure to be enrolled in the primary health care plan prior to retirement will result in the employee not being eligible for coverage. 3. COSTS: Once the eligibility criteria are met and upon retirement, an employee would receive the following premium payment contribution percentage: A. Age 55 -- Fifty (50$) percent of premium as a base _. contribution, provided the employee has completed the ten year base service requirement. B. After age 55 and assuminq the employee has satisfied the ten year base service requirement, the retired employee would receive the base contribution amount (50$) plus five (5$) percent for each full'year of paid city service completed above the ten year base service requirement, up to a maximum of seventy-five (75$) percent of the premium contribution. C. All service must be continuous. Retired employees qualifying for this program would have to complete 15 years of continuous city service in order to receive the maximum of 75$ of the premium payment at retirement. D. An employee who does not complete the ten year base service requirement prior to age 55 OR who is hired after age 55 MUST first complete this ten year base service requirement before being able to receive this benefit. They may receive the additional five (5�) percent premium contribution for each full year of paid city service completed after the ten year service requirement is completed. E �ESOLliTIO\ ti0, 92-» EXAMPLE: An employee who comes to work for the City at age 49 and retires at age 61 after twelve years of service would receive a sixty (60$) percent premium contribution. This would be 50$ from the ten year service base plus 10� from the additional two years of service. 4. ANNUAL RECERTIFICATION UPDATE: All retirees who avail themselves of this benefit must provide in December of each year the City with annual recertification information. A. The City will have sole authority to determine the relevant information needed to administer this program. Such information shall include, but not be limited to: 1. Retired employees current mailing address and phone number. 2. Current dependant coverage status and their relation to the insured. 3. Other insurance plans which may cover the retired ' employee or their dependents in any form. B. At the time of retirement and as part of this annual recertification process, the retired employee must sign a statement that failure to supply this information OR providing false information will result in the termination of their insurance coverage under this program. 5. The purpose of this MOU is to document and describe the parties' understanding of and responsibilities for the transition of the City Auto Allowance system to the City of Palm Desert Rideshare Program. BACKGROUND The City of Palm Desert will comply with South Coast Air Quality Management District Regulation XV by preparing and initiating a City of Palm Desert Rideshare proqram. Requlation XV requires all businesses with 100 or more employees at the same site, public and private, to develop and carry-out a Rideshare proqram. The City of Palm Desert is desirous of develaping a program before the SCAQMD mandate. The City of Palm Desert Rideshare program will have as the primary qoal to increase employee use of alternate methods of transporta� �n to and from work, ie., walking, bicyclinq, public - transit, c -oolinq, use of clean fuels, so as to increase average vehicle r_ .=ship from a current level of approximately 1.1 employees per vehicle to 1.3 employees per vehicle. The City Rideshare program encourages participation throuqh the creation of an aggressive incentive program. Creating and maintaining participation hinges on a positive program. To date, the number of employees receiving auto allowances has grown to twenty-eight employees. The auto allowance system discourages Ridesharing of employees because of the employees requirement to have and utilize a personal vehicle durinq City working hours. PROCEDURE This supplemental MOU has been established as the procedure to describe the responsibilities of both the City and the employees receiving City Auto Allowances. Since both manaqement and represented employees receive a City auto allowance as part of their compensation, this MOU was created to clearly outline this program to those affected. This aqreement will terminate the auto allowance system and place fifty (50$) percent of the positions auto allowance compensation into the monthly salary compensation by amending the salary resolution as of July 1, 1992. � RESOLliTIOti �0. 92- » The "rolling" of the positions auto allowance into salary is an act of "good faith" on behalf of the City of Palm Desert. The City desires the compensated employees to act in "good faith" to support and/or participate in the City Rideshare program. In addition, this act is viewed as a fair and equitable transition for both parties from the auto allowance system to the Rideshare program. Approximately two and half years ago, monthly auto allowance was calculated as taxable income, therefore, the net effect of "rolling" auto allowance into salary has the same effect on taxable income in 1992. FURTHER DISCUSSION Any cost of living ad justment pravided to employees on July 1, 1992, will be calculated prior to the above mentioned transition. The City will continue to compensate employees at a rate $.31 a mile for the use of personal vehicles on City business. INTRODUCTION Staff has met with representatives of the City Council and the Palm Desert Employees' Organization to agree on a program and criteria for an employee compensation study. This will establish for the future a solid base on which to make decisions on employee compensation levels. B. The City will, on the whole, attempt an adjustment on an "across the board" basis. 7. Any labor market inequities of 10$ or more will be looked at separately. Where a large percentage increase is warranted, the classification will be adjusted to the proper range, but the incumbent will be assigned a step in the higher ranqe as will grant such employee a salary increase of not more than 10$ increase, over and above any "across the board" increase. Where a large percentage decrease is warranted, the City will not adjust the classification downward to the proper ranqe, but will "freeze" the classification in its current salary range until such time as the salary ranqe rate is in line with the average salary range rate of the labor market. If a benchmark classification has a labor market inequity af 7$ or more two consecutive years, starting with the 1991-92 fiscal year and three consecutive years, startinq with the 1992-93 fiscal year, a separate adjustment will be made to the salary range of that class to bring the inequity below 7$ (i.e. a maximum of 6.9$ inequity will remain). 8. The average salary range rate for other than benchmark positions will be computed from the benchmark averages using the City of Palm Desert's established internal and career ladder relationships. D. ANNUAL SURVEY AND REVIEW Each year Human Resources will conduct a salary survey of the selected statewide and Coachella Valley cities and City management and the Palm Desert Employees' Organization will review the survey comparing the formula results to the basic philosophy declared herein.
