A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT, CALIFORNIA,
DETERMINING THE AMOUNT OF PROPERTY TAX
REVENUE TO BE EXCHANGED BETWEEN THE CITY
OF PALM DESERT AND THE CITY OF INDIAN
WELLS RELATING TO THE ANNEXATION OF LA
ROCCA TO THE CITY OF INDIAN WELLS
WHEREAS, the City of Palm Desert and the City of Indian Wells are
the agencies whose area of responsibility for service would be affected
by annexation of La Rocca (the "Project"), to the City of Indian Wells.
The Project (La Rocca), being a 24 acre residential development located
west of Cook Street, south of The Cove, and north of Fairway Drive; and
WHEREAS, representatives of each of the affected agencies have
agreed to the exchange of property tax revenue; and
NOW, THEREFORE,
resolves as follows:
Section 1:
the City Council of the City of Palm Desert
(a) Until the effective date of annexation, the City of Palm
Desert shall provide all general municipal services to the Project
known as "La Rocca".
(b) Commencing at 12:01 a.m. on the date after the effective date
of annexation, the City of Indian Wells shall assume
responsibility for all general municipal services currently
provided to La Rocca by the City of Palm Desert and or as are
required by law or presently provided throughout the City of
Indian Wells, and for such service, the City of Indian Wells shall
receive 100$ of the property tax revenue generated within the
territory annexed under the ad valorem tax rate established by
Article XIII A of the Constitution of the State of California,
that represents the City of Palm Desert's share of such property
tax revenue.
(c) That portion of the property tax revenue generated within the
territory annexed under the ad valorem tax rate established by
California Constitution Article XIII A which represents the share
of the City of Palm Desert of such property tax revenue shall be
allocated to the City of Palm Desert and the City of Indian Wells
in proportion to the number of days that each such city provides
general municipal services to La Rocca during the fiscal year in
which annexation occurs.
Section 2: Upon annexation of the subject territory to the City
of Indian Wells, the County Auditor, in accordance with the provisions
of Section 95 et. seq. of the Revenue and Taxation Code, shall allocate
the city share of property tax revenue generated within such territory
in the fiscal year during which the annexation occurs to the City of
Palm Desert and the City of Indian Wells in the proportions set forth
in Section 1 (c) above.

Section 3: The County Auditor shall upon annexation by the City
of Indian Wells convert the above established percentage figure into
actual dollar figures and thereafter allocate to the City such property
tax revenue in accord with the provisions of Section 95 et. seq. of the
Revenue and Taxation Code.
Section 4: The City Council of the City of Palm Desert does
'�ereby agree to the above recited exchange of property tax revenue.
Section 5: The Clerk shall transmit a certified copy of this
resolution to each affected agency and to the Executive Office of the
Local Agency Formation Commission and to the Auditor of the County of
Riverside pursuant to Section 99 of the Revenue and Taxation Code.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert City Council, held on this 25th , day of March , 1993, by the
following vote, to wit:
