HomeMy WebLinkAboutCC RES 93-059RESOLUTION NO. 93-59 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT MAKING AN ELECTION PURSUANT TO HEALTH AND SAFETY CODE SECTION 33676 IN CONNECTION WITH THE PROPOSED REDEVELOPMENT PLAN FOR PROJECT AREA NO. 4 OF THE PALM DESERT REDEVELOPMENT AGENCY THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY FINDS, ORDERS, DETERMINES AND RESOLVES AS FOLLOWS: Section 1. The Palm Desert Redevelopment Agency (the "Agency") has prepared a proposed redevelopment plan (the "Redevelopment Plan"} for Project Area No. 4(the "Project Area") of the Palm Desert Redevelopment Agency. Section 2. Health and Safety Code Section 33676 provides that an affected taxing agency may elect to be allocated, in addition to the portion of the taxes allocated to the affected taxing agency pursuant to subdivision (a) of Health and Safety Code Section 33670, all or any portion of the tax revenues allocated to the redevelopment agency pursuant to subdivision (b) of Section 33670 attributable to (i) increases in the rate of tax imposed Lor the benefit of the affected taxing agency which levy occurs after the tax year in which the ordinance adopting the redevelopment plan becomes effective, and (ii) increases in the assessed value of the taxable property in the project area, as the assessed value is established by the assessment roll last equalized prior to the effective date of the ordinance adopting the redevelopment plan pursuant to subdivision (a) of Section 33670, which, are, or otherwise would be, calculated annually pursuant to su�division (f) of Section 110.1 of the Revenue and Taxation Code. Section 3. In connection with the Project Area, the City of Palm Desert is an affected taxinq agency. RESOLUTION NO. 93-59 Section 4. The City Council of the City of Palm Desert, on behalf of the City of Palm Desert, hereby elects to be allocated, in addition to the portion of taxes allocated to the City pursuant to subdivision (a) of Section 33670 of the Health and Safety Code, all of the tax revenues allocated to the Palm Desert Redevelopment Agency pursuant to subdivision (b) of Section 33670 of the Health and Safety Code attributable to (i) increases in the rate of tax imposed for the benefit of the City which levy occurs after the tax year in which the ordinance adopting the Redevelopment Plan becomes effective, and (ii) increases in the assessed value of the taxable property in the Project Area, as the assessed value is established by the assessment roll last equaliz�d prior to the effective date of the ordinance adopting the Redevelopment Plan pursuant to subdivision (a) of Section 33670, which, are, or otherwise would be, calculated annually pursuant to subdivision (f) of Section 110.1 of the Revenue and Taxation Code. Section 5. The City C�erk is hereby authorized and directed to transmit a copy of tnis resolution to this City Council, to the Palm Desert Redevelopment Agency and to the official or officials performinq the functions of levying and collecting taxes for the City prior to the adoption of the Redevelopment Plan by the City Council.
