HomeMy WebLinkAboutCC RES 94-111RESOLUTION NO. 94-111 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING AN APPEAL OF A PLANNING COMMISSION DECISION TO APPROVE AN AMENDMENT TO CONDITIONAL USE PERMIT 91-13 PERMITTING SATURDAY HOURS OF OPERATION TO BE EXTENDED TO 2:00 P.M. FOR THE COLLEGE OF THE DESERT STREET FAIR. CASE NO. CUP 91-13 Amendment #1 WHEREAS, the City Council of the City of Palm Desert, California, did on the 13th day of October, 1994, hold a duly noticed public hearing to consider an appeal by SONIA M. CAMPBELL to a decision of the planning commission to approve a request by THE COLLEGE OF THE DESERT ALUMNI ASSOCIATION to amend Conditional Use Permit 91-13 to extend Saturday hours of operation to 2:00 p.m.; and WHEREAS, the planning commission adopted Planning Commission Resolution No. 1660 approving the request; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is categorically exempt because of previous certification of a negative declaration therefore; and WHEREAS, at said public hearing, upon hearing and�considering all testimony and arguments, if any, of all interested persons desiring to be heard, said city council did find the following facts and reasons to exist to justify the granting of said amendment: l. The proposed amendment of the conditional use permit is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed amendment of the conditional use permit and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use permit amendment will continue to comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use permit amendment continues to comply with the goals, objectives, and policies of the city's adopted general plan. RESOLUTION NO. 94-lli NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the city council in this case. 2. That the appeal is hereby denied.
