HomeMy WebLinkAboutCC RES 94-116� ��,. - � � RESOLUTION NO. 94-116 ASSESSMEN't DISTRICT NO. 942 (SUNTERRACE) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT DETERMI1vING AMOUNT OF UNPAID ASSESSMENTS WHEREAS, the City Council of the City of Palm Desert (the "City Council"), has confirmed the assessment for Assessment District No. 942 (Sunterrace) (the "Assessment District"); and WHEREAS, the City Council has received a signed written waiver from the owner of all of the property within the Assessment District upon which assessments have been levied waiving the 30-day period for payment of the assessments prescribed by Sections 10403 and 10404 of the Streets and Highways Code of the State of California, and requesting that the City Council proceed with the issuance and sale of the bonds for the Assessment District prior to the expiration of said 30-day period; and WHEREAS, the owner of all parcels within the Assessment District upon which assessments have been levied has advised the City Council in the aforementioned signed written waiver, which he has filed with the City, that he does not intend to and will not make any payment on the assessments against its parcels; and VVF�REAS, the City Council has received from the City Treasurer a list of paid and unpaid assessments showing the assessments which remain unpaid and the unpaid amounts thereof; NOW, TT�REFORE, the City Council of the City of Palm Desert, California, DOES HEREBY RESOLVE as follows: i n 1. Said list of unpaid assessments is correct, and the amount of unpaid assessments on the assessment and upon the security for which bonds are to be issued is $0. Section 2. The City Clerk shall file a certified copy of this resolution together with a copy of the list of unpaid assessments with the Auditor of the County of Riverside pursuant to Section 8682 of the Streets and Highways Code of the State of California. CRITES, MAYOR City of Pa1m,Desert, California ' A,��;sT:,! ��D/�' - Sheila R. � CSty of Palm � 0 3J5235929 �2_ RESOLUTION NO. 94-llb ASSFSSMENT DISTRIGT NO. 94-2 (SUNTERRACE) � City of Palm Desert • ' � 1� : �I� 1►!' �I� _- ��► WHEREAS, the City Council of the City of Palm Desert has adopted it resolution confirming the assessment for the acquisition of the improvements within and for Assessment District No. 94-2 (Sunterrace), City of Palm Desert, County of Riverside, State of California (the "Assessment District"), reference being hereby made to the Resoludon of Intention, the Report of the Assessment Engineer and the proceedings on file in the office of the City Clerk of the City of Palm Desert; and WHEREAS, the Ciry Council has received a signed written waiver from Bob Varner, who is the owner of all af the parceLs of property within the Assessment District upon which assessments have been levied waiving the 30-day period for payment of the assessments prescribed by Sections 10403 and 10404 of the Streets and Highways Code of the State of Califoraia, and requesting that the Ciry Council proceed with the issuance and sale of the Bonds for the Assessment District prior to the expiration of said 30-day period; and WHEREAS, Bob Varner has advised the City in the aforementioned signed written waiver that he does not intend to and will not make any payments on the assessments against its parcels; and WHEREAS, it is required that a statement of all paymenis received upon the assessment and a statement of the unpaid assessments be made; BJS235927 0 RESOLUTIOI3 N0. 94-116 NOW, THERFFORE, .the undersig�ned, City Treasurer of the City of Palm Desert, hereby certifies: (1) Attached hereto is a list showing the asses�ment on each parcel of property in Assessment District No. 94-2 (Sunterrace), the assessments which have been paid, in wtrol'e or in part, the assessments which aze unpaid and the amount unpaid on each unpaid assessment; (2) 50.00 has been paid on the assessment; and (3) The total amount of unpaid assessment is S 1, a 3 z, o00 DATED: November io , 1994.
