A RESOLUTION OF THE CITY OF PALM DESERT, CALIFORNIA,
CONFIRMING THE AMENDED ASSESSMENTS AND
DIRECTING QCTIONS WITH RESPECT THERETO
NORTH SPHERE ASSESSMENT DISTRICT NO. 84-1R (REFUNDING)
RESOLVED by the City Council of the City of Palm Desert, County of Riverside,
State of California, that:
WHEREAS, this Cour^°' �����;�red Resolution No. 94-5 , A Resolution of the
City of Palm Desert, Califomi�, rJ��de�ir�y the Making of Amended Assessments, and
directing the Superintendent of Streets to cause a report to be filed in writing in
accordance with and pursuant to Part 10 of Division 10 of the Streets and Highways
Code of Califomia;
WHEREAS, said report was duly made and filed, and duly considered by this
Council and found to be sufficient in every particular, whereupon it was determined that
said report should stand as the Engineer's Report for all subsequent proceedings under
and pursuant to the aforesaid resolution, on February 10 , 1994, at the hour of
7: 00 o'clock �.m., in the regular meeting place of this Council, was appointed as the
time and place for hearing protests in relation to amended reassessment of the parcel
of land designated as Diagram and Reassessment Number 57R segregating and
apportioning the unpaid installments of the original reassessment in accordance with
the benefits of the several parts of the original parcel, plus costs and fees of making
such apportionments, notices of which hearing were duly and regularly published; and
WHEREAS, said hearing was duly and regularly held, and al! persons interested
in the original reassessment, or in the lands affected thereby or in the bonds secured
thereby desiring to be heard were given an opportunity to be heard, and all matters and
things pertaining to said amended reassessments were fully heard and considered by
this Council, and all protests, both written and oral, were duly heard and considered;
NOW, THEREFORE IT IS ORDERED, that:
1. All written and oral protests are hereby overruled, and this Council has
thereby acquired jurisdiction to order said amended reassessments and the
confirmation of said amended diagram and reassessment and the costs and
expenses thereof.
2. The amended reassessment and diagram filed with the Superintendent of
Streets pursuant to the resolution ordering same, be, and same is hereby,
ratified, approved, and confirmed.
3. The City Clerk shall forthwith:
a) deliver the amended reassessment to the Superintendent of Streets,
together� with the amended diagram, as approved and confirmed by this
Council, with a certificate of such confirmation and of the date thereof,

executed by the City Clerk thereon. The Superintendent of Streets shall
record the reassessment and diagram in his office in a suitable book to be
kept for that purpose, and append thereto his certificate of the date of
such recording, and such recordation shall be and constitute the amended
assessment roll herein;
b) cause a copy of the amended reassessment diagram and an amended
notice of assessment executed by the City Clerk, to be filed and
recorded, respectively, in the office of the County Recorder of the County
of Riverside, such notice to be in substantially the form provided in
Section 3114 of the Streets and Highways Code of California; and
c) cause to be filed, with the Auditor of the County of Riverside revisions to
the auditor's record pursuant to Section 8682 of the California Streets and
Highways Code, which revisions shall be consistent with the amendments
to the reassessments herein ordered, and the Auditor shall annually
thereafter enter upon the assessment roll the installments becoming due
on each component part of the original parcel opposite the description of
the respective parcel so assessed.
4. The amount charged for fees and costs as shown on the amended
reassessment as to each parcel, unless paid as of the date hereof, shall be
collected along with the first installment of the amended reassessment and
when received by the District shall be deposited in the general fund of the
District.
PASSED, APPROVED, and ADOPTED by the City Council of the City of Palm
Desert, California, this lotn day of February 1994, by the following vote, to
wit:
