RESOLUTION NO. 94-46

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, INITIATING PROCEEDINGS FOR THE
ANNEXATION AND ANNUAL LEVY OF THE PALM DESERT
CONSOLIDATED LANDSCAPE AND LIGHTING MAINTENANCE
ASSESSMENT DISTRICT PURSUANT TO THE LANDSCAPING AND
LIGHTING ACT OF 1972.
The City Council of the City of Palm Desert, California does
resolves as follows:
WHEREAS, The City Council (the "Council") of the City of
Palm Desert, (the "City") has by previous Resolution formed the
consolidated landscape and lighting maintenance district listed
below pursuant to the provisions of the Landscaping and Liqhting
Act of 1972, beinq Division 15, Part 2 of the Streets and Highways
Code of the state of California which provide for the collection of
assessments by the County of Riverside to pay for the maintenance,
servicing and operation of the landscape improvements that include
planting materials such as turf, qround cover, shrubs and trees,
automatic sprinkler systems, lighting, drainage systems, and all
appurtenant facilities and operations related (thereto including
special services, as well as the servicing and maintenance of
street lights and operations related thereto.
The Consolidated Landscape And Lighting Maintenance Assessment
District.
WHEREAS, the City has retained Muni Financial Services,
Inc. (MFS), for the purpose of assisting the City with the
Annexation and Annual Levy of the District, to prepare and file a
report with the City Clerk in accordance with the Landscaping and
Lighting Act of 1972, Part 2(commencing with Section 22500) of
Division 15 of the California Streets and Highways Code (the Act).
NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED
BY THE CITY OF PALM DESERT, CALIFORNIA, AS FOLLOWS:
Section l. Intention. The City Council hereby declares that it
is its intention to seek the Annexation and Annual Levy of the
District, pursuant to the Landscaping and Lighting Act of 1972,
over and including the land within the district boundaries and to
levy and collect annual assessments on all such land to pay the
costs of the following: maintenance, servicing and operation of the
landscape improvements that include planting materials such as
turf, ground cover, shrubs and trees, automatic sprinkler systems,
lighting and drainage systems, and all appurtenant facilities and
operations related thereto including special services, as well as
the servicing and maintenance of street lights and operations
related thereto.

Section 2. Boundaries and Designation. The boundaries of the
district are described as the boundaries previously defined in the
Consolidation, Annexation, and Annual Levy Report for the fiscal
year 1994/95, within the incorporated City Limits of the City,
within the County of Riverside, State of California. Also
described as:
Palm Desert Consolidated Landscape and Lighting Maintenance
Assessment District.
Section 3. NOTICE OF PUBLIC HEARING.
NOTICE IS HEREBY GIVEN THAT A PUBLIC MEETING AND PUBLIC HEARING ON
THESE MATTERS WILL BE HELD BY THE CITY COUNCIL OF THE CITY OF PALM
DESERT ON THtJRSDAY, MAY 26, 1994, AT 7:00 P.M., AND THURSDAY, JUNE
23, 1994, AT 7:00 P.M., OR AS SOON THEREAFTER AS FEASIBLE IN THE
REGULAR MEETING CHAMBERS LOCATED WITHIN CITY HALL LOCATED AT 73-510
FRED WARING DRIVE, PALM DESERT.
Section 4. Notice. The City Clerk shall give notice of the
time and place of the Public Hearing by causing the publishing of
the Resolution twice in the local newspaper for two consecutive
weeks not less that ten (10) days before the date of the hearings,
and by posting a copy of his resolution on the official bulletin
board customarily used by the City Council for the posting of
notices.
Section 5. Annual Assessment. The City Council hereby declares "
it intention to order the preparation of the Annexation and Annual =
Levy Report and to conduct a public meeting and public hearing
concerning the levy of assessments for the district in accordance
with Act.

PASSED, APPROVED and ADOPTED by the City of Palm Desert,
California, on the 28th day of April , 1994 by the following
vote, to wit:
