RESOLUTION NO. 94-51
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNEXING CERTAIN
CONTIGUOUS TERRITORY TO SAID CITY UNDER THE
PROVISIONS OF THE CORTESE/RNOX LOCAL GOVERNMENT
REORGANIZATION ACT OF 1985, WHICH PROCEEDINGS ARE
DESIGNATED AS PALM DESERT ANNEXATION NO. 29.
LAFCO NO. 93-46-4
WHEREAS, on December 9, 1993 the City Council did adopt Resolution
No. 93-106 initiating annexation proceedings for Annexation No. 29; and
WHEREAS, the Local Agency Formation Commission of the County of
Riverside adopted its Resolution No. OS-94 on February 24, 1994, making
determinations and appiovinq the proposed annexation to the City of
Palm Desert of territory described in Exhibit A, attached hereto and by
this reference incorporated herein; and
WHEREAS, the reasons for the annexation are:
1. The proposed territory to be annexed is adjacent to and
substantially surrounded by the City of Palra Deaert, and,
therefore, represents a logical expansion of the city's
boundary.
2. The area is predominately urban in character and required a
hiqher level of urban services than are currently offered by
the County of Riverside. The City of Palm Desert can provide
these services which include hiqher levels of police, fire,
paramedic and qeneral code enforcement and participation in
the local Palm Desert political process.
WHEREAS, the regular county assessment roll is utilized by this
city; and
WHEREAS, the affected territory will not be taxed for existing
qeneral bonded indebtedness of this city; and
WHEREAS, a noticed �ublic hearing on this annexation was called
for and held by this councii on April 28, 1994 and this council finds
and determines that the value of the written protests filed and not
withdrawn is less than 25 percent of the registered voters residing
within the territory proposed to be annexed and less than 25 percent of
the nuraber of owners of land owning less than 25 percent of the
assessed value of Iand within the territory.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Palm Desert, California, hereby orders the territory described as
Annexation 29 to the City of Palm Desert, Exhibit A attached hereto,
annexed subject to the conditions contained in LAFCO Resolution No. 05-
94 attached hereto as Exhibit B, and directs the City Clerk of the City
of Palm Desert to transmit a certified copy of this resolution with
applicable fees required by Section 54902.5 of the Government Code to
the Executive Officer of the Local Agency Formation Commission of
Riverside County.

APPROVING THE PROPOSED REORGANIZATION TO INCLUDE
ANNEXATION NO. 29 TO THE CITY OF PALM DESERT AND
DISSOLLITION OF COUNTY SERVICE AREA NO. 26 AND NO. 131

BE IT RESOLVED AND DETERMINED by the Local Aqency
Formation Commission in reqular session aesembled on February
24, 1994, that the Reorqanization to Include Annexation No. 29
to the City of Palm Desert and Dissolution of County Service
Area No. 26 and No. 131, as more particularly described in
Exhibit "A", attached hereto and made a part hereo�, is approved
subject to the conditions aet forth herein.
BE IT FURTHER RESOLVED, DETERMINED AND FOUND that:
1. Commission proceedinqs were commenced by
resolution of application by the City of Palm Desert.
2. The reorganization ie proposed to provide more
municipal services by the City of Palm Desert.
3. The distinctive short form designation of the
proposed reorganization is LAFCO No. 93-46-4, Reorganization to
Include Annexation No. 29 to City of Palm Desert and Dissolution
of County Service Area No. 26 and No. 131.
4. The City of Palm Desert, as lead agency, haB
adopted a neqative declaration, and complied with the California
Environmental Quality Act and all appropriate State Guidelines,
and the Commission has reviewed and considered the environmenta2

5. The boundaries of the territory as set torth in
Exhibit "A", attached hereto and incorporated herein by this
regerenca, hava baen approved by the County Surveyor, and are
approved.
6. The territory to be annexad is inhabited, there
beinq more than 12 reqistered voters residinq therein.
7. The proposed annexatfon is consistent with the
City of Palm Desert's sphere o! influence and the spheres of
influence ot all other attected local agencies.
8. Prior to the lilinq of a Certificate of
Completfon, the City ot Palm Desart shall:
a. In accordar�ce with Government Code Section
563'75(0), waive automatic detacbment lrom County service Area
152 bas�d on the lollowinq findinqs:
i. detaciiment would deprive the area ot
aervices needed to ensure health and safety oi the City ot Palm
Desert and the County of Riverside in meetinq Federal mandates
under the Clean Water �ict of 1987; and,
ii. the waiver would not alfect the City of
Palm Desert's ability to provide any service; and,
b. Pursuant to Government Code Section
56844(u), authorize the transfer ot authority and responsibility
lrom County Servica �rea No. 26 and No. 131 (County of
Riverside) to the City ot Palm Desert for uninterrupted
administration of qovernment services presently received and its
related tax apportionment revenues qenerated within the affected
boundaries (Tax Rate Areas 075-009, 075-070, 070-101 and 075-

c. In accordance with Government Code Section
56844(t) authorize the extension/continuation of any previously
authorized charqe, lee, asaessment or tax by the local agency or
successor local aqency in the a=fected territory.
9. The City of Palm Desert is designated conducting
authority.
10. The Executive Ofticer is directed to transmit a
certiffed copy of this Resolution to the above-desiqnated
conductinq authority, to the chief petitioners, i! different
