RESOLUTION OF TEE CITY COUNCIL OF THE CITY OF
PALL[ DESERT AMENDING RESOLUTION NO. 94-42
REGARDING COMPLIANCE RITE TEE REQUIREMENTS OF
THE SPECIAL ASSESSMENT INVESTIGATION, To TA-
TION AND MAJORITY PROTEST ACT OF 1931
WHEREAS, on April 14, 1994, the City Council (the "City
Council") of the City of Palm Desert (the "City") adopted
Resolution No. 94-42, the resolution of intention with respect to
the formation of Assessment District No. 94-1 (Bighorn), City of
Palm Desert, County of Riverside, State of California (the
"Assessment District"); and
WHEREAS, in Section 10 of Resolution No. 94-42, the City
Council declared that it intends to comply with the requirements of
the Special Assessment Investigation, limitation and majority
protest act of 1931 Division 4 (commencing with Section 2800) of
the Streets and Highways Code, by proceeding under Part 7.5
(commencing with Section 2960) of said Division 4 and further
determined that pursuant to Sections 2961 and 2980 of the Streets
and Highways Code, the true value of the parcels of land and
improvements within the Assessment District which are proposed to
be assessed shall be the full cash value of such land and
improvements as defined in Article XIIIA of the California
Constitution as shown on the last equalized assessment roll for the
County of Riverside; and
WHEREAS, the City Council is advised that the City has
received an appraisal from MacKenzie & Associates regarding the
market value of the parcels of land and improvements which are
proposed to be assessed, and the City Council has determined that
such appraisal is more reflective of the true value of such
parcels; and
WHEREAS, the City Council has further determined that
Section 10 of Resolution No. 94-42 should therefore be amended to
provide that the total true value of the parcels of property within
the assessment district which are proposed to be assessed shall be
the appraised value or market value of such parcels as determined
by MacKenzie & Associates and as set forth in their appraisal
report, a copy of which is on file with the City Clerk;
NOW, THEREFORE, the City Council of the City of Palm
Desert, California, DOES HEREBY RESOLVE as follows:
Section 1. Pursuant to Sections 2961 and 2980 of the
Streets and Highways Code, the total true value, as near as may be
determined, of the parcels of land and improvements within the

Assessment District which are proposed to be assessed shall be the
market value of such parcels as determined by MacKenzie &
Associates and as set forth in their report regarding their
appraisal of the market value of such parcels.
Section 2. Paragraph (b) of Section 10 of Resolution
No. 94-42 is amended to read as follows:
"(b) The total true value, as near as may be determined,
of the parcels of land and improvements .which are
proposed to be assessed. Pursuant to Sections 2961 and
2980 of the Streets and Highways Code, such total true
value shall be the market value of such land and improve-
ments as determined by MacKenzie & Associates and as set
forth in their report regarding the appraisal of such
parcels."
PASSED, APPROVED AND ADOPTED this 26th day of May, 1994,
by the following vote, to wit:
