HomeMy WebLinkAboutCC RES 94-006RESOLUTION NO. 94-6 A RESOLUTION OF THE CITY OF PALM DESERT, CALIFORNIA, ORDERING THE MAKING OF AMENDED ASSESSMENTS UNDER PART 10 OF DIVISION 10 OF THE STREET AND HIGHWAYS CODE AND DIRECTING ACTIONS WITH RESPECT THERETO ASSESSMENT DISTRICT NO. 83-1 RESOLVED by the City Council of the City of Palm Desert, County of Riverside, State of California, that: WHEREAS, pursuant to the Municipal Improvement Act of 1915 and Resolution of Intention No. 85-52 adopted by this Council on June 13, 1985, special assessments were confirmed to pay the costs of the acquisitions and improvements as more particularly described in the said resolution. Said assessments are set forth on an Assessment and a Diagram, heretofore confirmed by this Council and filed and recorded with the Superintendent of Streets of the City of Palm Desert and the County of Riverside, and WHEREAS, a certain parcel of land designated as Diagram and Assessment Number 26.079M upon which there is an unpaid assessment against which bonds have been issued under the Improvement Bond Act of 1915, has been divided so that it no longer conforms to the original parcel boundaries as shown on said assessment diagram; NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows: 1. The Superintendent of Streets of the City of Palm Desert shall cause to be filed with the City Clerk a report and an amended assessment and diagram of Diagram and Assessment Number 26.079M segregating and apportioning the unpaid installments of the original assessment in accordance with the benefits to the several parts of the original parcel plus costs and fees of making such apportionments. 2. The costs and fees for preparing the amended assessment, notices, diagram and auditor's records are hereby fixed at $575.00. 3. The Superintendent of Streets is hereby directed to notify the owner of the original (undivided parcel) of land that such owner may within fifteen (15) days after the date of the notification pay all costs and fees of the apportionment to the Superintendent of Streets and that if such payment is not made within the fifteen days, the costs and fees, separately stated, shall be assessed to the amended assessment for each divided parcel. Such Notification shall be by first class mail and failure of the assessed owner to receive such notice shall t,�,' � in no way invalidate further proceedings hereunder.
