HomeMy WebLinkAboutCC RES 95-058� 2 �-�-�j�� RESOLUTION NO. 95-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DFSERT, CALIFORNIA, DESIGNATING THE COUNTY OF RIVERSIDE DEPARTMENT OF ENVIRONMENTAL HEALTH AS THE UNIFIED PROGRAM AGENCY FOR HAZARDOUS WASTE AND HAZARDOUS MATERIAIS MANAGEMENT. WI�REAS, California Health and Safety Code, Division 20, Chapter 6.11 requires that administration of six (6) specific hazardous waste and hazardous materials management regulatory programs shall be consolidated as a Unified Program; and, WI�REAS, California Health and Safety Code, Division 20, Chapter 6.11 requires that an agency which administers any of the specified six (6) unified program components shall be certified under a Unified Program Age�y by the Secretazy of the California Environmental Protection Agency; and, WHEREAS, those unified program components include the requirements of Health and Safety Code Chapter 6.5, commencing with Section 25100, related to hazardous waste generators and on-site waste treatment; Healthy and Safety Code Chapter 6.7, commencing with Secdon 25280, related to construction, operation, and removal of underground storage tanlcs; Health and Safety Code Chapter 6.95, Article 1, related to hazardous material release response plans and inventories; Health and Safety Code Chapter 6.95, Article 2, related to the management of acutely hazardous materials; Health and Safety Caie, Section 25270.5 (c), related to aboveground storage tank spill prevention control and countermeasure plans; and Uniform Fire Code, Section 80.103 (b) and (c), related to hazardou.s materials management plans and inventories; and, WAEREAS, Health and Safety Code, Section 25509.2, elnninates duplicadve reporting requirements by deeming reports filed pursuant to Health and Safety Code, Chapter 6.95, Articles 1 and 2, shall have met the requirements of Uniform Fire Code Section 80.103 (b) and (c); and, WHEREAS, the County of Riverside Department of Environmental Health currently adcninisters regulatory compliance for five of the six unified program components in the City of Palm Desert; and, Wi�REAS, the County of Riverside Department of Environmental Health, serving as a Unified Pmgram Agency, will coordinate administration of the sixth unified program component, the aboveground storage tank spill prevention control and countermeasure plans, with the San Diego, Santa Ana, and Colorado River Regional Water Quality Control Boards; � RESOLUTION NO. 95-58 NOW, TI�REFORE, BE I'T RESOLVED that the City Council of the City of Palm Desert, California, hereby designates the County of Riverside Deparanent of Environmental Health as the Unified Program Agency for hazardous waste and hazardous materials regulation in the City of Palm Desert.
