HomeMy WebLinkAboutCC RES 95-071SCo-oLf3 COUNTY OF RIVERSIDE RESOLUTION NO. 95-71 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, TO AUTHORIZE AND APPROVE SELF- INSURANCE OF WORKERS' COMPENSATION FOR ITS EMPLOYEES THROUGH THE SELF-INSURANCE AND LOSS POOLING PROGRAM OF SOUTHERN CALIFORNIA JOINT POWERS INSURANCE AUTHORITY. THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, HEREBY DOES FIND AND RESOLVE AS FOLLOWS: WHEREAS, pursuant to the provisions of Section 6500 et seq. And also Section 990.4 and 990.8 of the California Government Code, the Southern California Joint Powers Insurance Authority was created in 1977; and WHEREAS, the City of Palm Desert has become a member of Southern California Joint Powers Insurance Authority, and also of its General Liability Program; and WHEREAS, Southern California Joint Powers Insurance Authority has established and administered a successful Workers' Compensation Self-insurance and Loss Pooling Program for its members since January 1, 1980; and WHEREAS, there are significant financial and administrative advantages for the City of Palm Desert to provide workers' compensation coverage for its employees through the said Self- insurance and Loss Pooling Program of Southem California Joint Powers Insurance Authority. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM DESERT DOES HEREBY RESOLVE, ORDER AND DETERMINE THE FOLLOWING: Section 1. Workers' compensation coverage for employees of the City of Palm Desert through the Workers' Compensation Self-insurance and Loss Pooling Program of Southern California Joint Powers Insurance Authority is hereby authorized and directed effective September 1, 1995, this dependent upon approval of Coachella Valley Joint Powers Insurance Authority that the City withdraw from its present arrangement mid -year 1995/96. Section 2. The Director of Administrative Services of the City of Palm Desert, is authorized and directed to apply to the Department of Industrial Relations for a Certificate of Consent to Self -insure, and to take such other actions as be necessary to effectuate self-insurance of workers' compensation for City employees. 1 Resolution No. 95-71 Section 3. That an Initial Annual Workers' Compensation Deposit of $205,000.00, or such pro-rata part thereof as the Authority might determine for coverage of less than a fiscal period, is approved and the appropriate officers of the City are authorized to pay the same to the Authority. Section 4. all employees. That a Loss Retention level of $25,000.00 per occurrence is approved for Section 5. That the Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Resolution, and thereupon the same shall take effect and be in force. Section 6. That the City Clerk is directed to forward a certified copy of this Resolution to Southern California Joint Powers Insurance -Authority, 4952 La Palma Avenue, La Palma, California 90623.
