IGAN, DIRECTOR OF COMIVILJdVITY AFFAIRS/ CITY CLERK CITY OF PALM DESERT Recycled Paper 150178 RESOLUTION NO. 96-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, RESCINDING THE INTENTION TO FORM A SPECIAL ASSESSMENT DISTRICT KNOWN AND DESIGNATED AS ASSESSMENT DISTRICT NO. 91-1 WHEREAS, THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA INTENDED TO, PURSUANT TO THE TERMS AND PROVISIONS OF THE "MUNICIPAL IMPROVEMENT ACT OF 1913", BEING DIVISION 12 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, FOR THE CONSTRUCTION OF CERTAIN PUBLIC WORKS IMPROVEMENT, TOGETHER WITH APPURTENANCES AND APPURTENANT WORK, ADOPT A SPECIAL ASSESSMENT DISTRICT TO BE KNOWN AND DESIGNATED AS ASSESSMENT DISTRICT NO. 91-1; AND WHEREAS, ON FEBRUARY 28, 1991, THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA ADOPTED RESOLUTION 91-27 MAKING APPOINTMENTS IN A SPECIAL ASSESSMENT DISTRICT; AND WHEREAS, ON MAY 14, 1992, THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA ADOPTED RESOLUTION 92-35A ADOPTING A MAP SHOWING THE PROPOSED BOUNDARIES OF A SPECIAL ASSESSMENT DISTRICT; AND WHEREAS, ON MAY 14, 1992, THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA ADOPTED RESOLUTION 92-36A COVERING PRELIMINARY DETERMINATION AND ORDERING THE PREPARATION OF A REPORT ON SAID IMPROVEMENT; AND WHEREAS, ON MAY 14, 1992, THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA ADOPTED RESOLUTION 92-37 APPROVING A REPORT UNDER THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1913", AND FIXING A DATE OF HEARING THEREON; AND WHEREAS, ON MAY 14, 1992, THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA ADOPTED RESOLUTION 92-38 APPROVING A PROPOSED RESOLUTION OF INTENTION AND REQUESTING CONSENT AND JURISDICTION FROM THE CITY OF INDIAN WELLS; AND WHEREAS, ON MAY 14, 1992, THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA ADOPTED RESOLUTION 92-39 APPROVING A PROPOSED RESOLUTION OF INTENTION AND REQUESTING CONSENT AND JURISDICTION FROM THE COUNTY OF RIVERSIDE; AND 150178 WHEREAS, THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA HAVE FOUND ALTERNATIVE FUNDING SOURCES TO DEFRAY THE COSTS INTENDED TO BE FUNDED BY ASSESSMENT DISTRICT NO. 91-1. BE IT HEREBY RESOLVED, FOUND, DETERMINED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF PALM DESERT THAT RESOLUTIONS 91-27, 92-35A, 92-36A, 92-37,92-38 AND 92-39 ARE RESCINDED AND NO LONGER VALID. A COPY OF THIS RESOLUTION WILL BE FILED WITH THE COUNTY RECORDER FOR THE PURPOSE OF RESCINDING THE PROPOSED BOUNDARY MAP FOR ASSESSMENT DISTRICT 91-1 WHICH WAS RECORDED ON MAY 21, 1992 BY THE AUTHORITY OF THE CITY OF PALM DESERT RESOLUTION NO. 92-35A.
