A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, AMENDING THE RATE SCHEDULE OF FEES FOR THE
COLLECTION, RECYCLING, AND DISPOSAL OF MUNICIPAL SOLID WASTE
AND RESIDENTIAL RECYCLING, RESCINDING RESOLUTION NO. 94-56.
WHEREAS, on the 13th day of July, 1995, the City Council of the City of Palm
Desert, California, authorized an exclusive contract with Waste Management of the Desert to
provide solid waste collection and residential recycling services; and
WHEREAS, the provisions of the franchise agreement allows Waste Management
of the Desert an annual rate increase equal to 50% of the Consumer Price Index (CPI) as
measured in the Los Angeles- Anaheim -Riverside area from March to March; and
WHEREAS, the CPI from March 1995 to March 1996 is 1.7% and Waste
Management of the Desert requested on April 16, 1996, an .85% increase for solid waste
collection and residential recycling services; and
WHEREAS, the Riverside County Waste Resources Management District
(RCWRMD) sets the landfill tipping fees; and
WHEREAS, RCWRMD has reduced the landfill tipping fee from $38.50 to $30.00
per ton, effective July 1, 1996.
NOW, THEREFORE, BE IT RESOLVED as follows:
SECTION 1: That the City Council of the City of Palm Desert, California, rescinds
Resolution No. 94-56 effective July 1, 1996.
SECTION .2: That the City Council of the City of Palm Desert, California,
effective July 1, 1996, ratifies the .85% solid waste collection and residential recycling service
increase requested by Waste Management of the Desert as provided for in our franchise
agreement.
SECTION 3: That the City Council of the City of Palm Desert, California,
effective July 1, 1996, ramifies the RCWRMD's landfill tipping fee surcharge reduction from
$38.50 to $30.00 per ton.
SECTION 4: That the City Council of the City of Palm Desert, California,
effective July 1, 1996, retains the $8.50 per ton tipping fee reduction and directs the funds to
a special account entitled, "Waste and Recycling Fee;" 1 RESCINDED

SECTION 5: .t the City Council of the City Palm Desert, California,
effective July 1, 1996, increases commercial rates by .85 %, and utili7Ps a portion of the $8.50
per ton tipping fee reduction so that residential customers do not receive an .85 percent rate
increase;
SECTION 6: That Waste Management of the Desert shall notify its commercial
customers of the solid waste collection increase of .85% based upon their request for CPI
increase.
SECTION 7: That Waste Management of the Desert shall forward to the City on
a monthly basis an amount equal to $8.50 multiplied by the City's franchised hauler residential
garbage tonnage as reported to the RCWRMD Tonnage Tracking. System.
SECTION 8: That Waste Management of the Desert shall forward to the Ciry on
a monthly basis an amount equal to $8.50 multiplied by the City's franchised hauler
commercial and industrial (roll -off) garbage tonnage as reported to the RCWRMD Tonnage
Tracking System.
SECTION 9: That the schedule of solid waste collection and residential recycling
service rates and landfill tipping fee surcharge shall be in accordance with Exhibit A attached
hereto and made part hereof:

One free service level change per year per resident (with the option of an increase or decrease in capacityl. If a resident requires more than one service level
change per year, the charge is $15. If a resident is reducing their trash capacity, there is no charge for the service level change.
A $15 fee is charged only to the same owner or tenant. If a new resident resides in the dwelling, a fee is not charged.
No Charge - containers picked up by company.
FREE - To quafify for FREE walk-in service, resident must meet the following requirements:
• Department of Motor Vehicles (DMV) requirement for a disabled parking placard
• Placard must be N1-Permanent

Dear Mr. Diaz,
A Waste Management Company
Waste Management of the Desert respectfully requests a review of its service rates per
Section III.X. of the Franchise Agreement.
The March 1996 Consumer Price Index (CPI) from the U.S. Department of Labor,
Bureau of Labor Statistics indicates we experienced an inflation factor of 1.7% during the
past year. The contract allows us to seek 50% of this CPI increase, or .85%. This is the
increase in service rates that we are seeking.
In addition, Riverside County has announced a decrease in landfill fees from S38.50 to
$30.00 per ton for disposal. In order that we may develop a proposed rate structure for
1996-97, we request your direction on whether the landfill fee decrease should be passed
through to the customer or if it will be retained by the city.

ORDINANCE NO. 1
AN ORDINANCE OF THE RIVERSIDE COUNTY WASTE
RESOURCES MANAGEMENT DISTRICT RELATING TO
DISTRICT SOLID WASTE FACILITIES
AND ESTABLISHING FEES
The Board of Directors of the Riverside County Waste Resources Management
District, State of California, ordains as follows:
Section 1. DEFINITIONS. The words used in this ordinance shall have
the definitions provided in Public Resources Code 40100 et. Seq.
Section 2. ESTABLISHMENT OF SITES. Subject to control of the
Board of Directors, the Chief Executive Officer of the Waste Resources
Management District may designate and operate or control by contract County
or District owned or leased or contracted sites to be used for the public transfer,
processing or disposal of solid waste.
Section 3. REFUSE FROM OUTSIDE OF COUNTY. Unless so
authorized in writing by the Chief Executive Officer of the District -or his
designated representative, under general policies adopted by the Board, no person
shall place, deposit, or dump, or cause to be placed, deposited, or dumped, in or
upon any County or District owned, leased, or contracted transfer station or
disposal site, any solid waste originating outside of the County of Riverside.
Section 4. REGULATIONS. All County or District owned, leased, or
contracted transfer stations and disposal sites shall be under the supervision of the
Chief Executive Officer of the Waste Resources Management District who shall
have the power and the duty to prescribe reasonable regulations regulating the use
by the public and the operation of such sites. Such rules shall include, but need
not be limited to, the following subjects:

1 j a. Days and hours of use.
2 I b Charges for use of sites at times other than regular hours, which
3 shall be sufficient to reimburse the District for equipment, personnel
4 and overhead costs.
5 c. Maximum size of articles and objects being dumped.
6 d. Allocation of various types of waste to specific sites and the
7 placement of waste within any site.
a ; e. Prohibition or conditional acceptance of harmful or dangerous
9 materials, including a reasonable charge for their acceptance.
i o f. Prohibition of unauthorized persons from access to areas within a
11 site, including the tmauthorized conducting of salvage operations.
12 Any regulation fixing days or hours of operation shall be submitted to the
13 Board of Directors for approval before taking effect, All regulations prescribed
14 by the Chief Executive Officer of the District shall be filed in his or her office and
15 shall be available for public inspection.
16 Section S. SALVAGE OPERATIONS. Subject to the approval of the
17 Board ofDirectors, salvage operations of reusable waste materials at County or
1s District transfer stations and disposal sites may be conducted only by such
19 persons as are authorized to do so and upon such terms and conditions as are
20 imposed by the Chief Executive Officer of the District.
21 Section 6. FEES. Pursuant to the authority of Health and Safety Code
22 Sections 4741.7 and 5471, fees for the disposal of solid waste and disposal of
23 liquid waste at enumerated lrndfi»s shall be as established by the Board of
24 Directors following a duly noticed public hearing. The fees so established shall
25 1 be in an amount sufficient to cover all costs including but not limited to the
26 following: closurelpostclosure (including past unfunded costs), remadiation,
27 environmental mitigation, state mandated and other pass -through fees, and

general District operations. The Board of Directors may from time to time
2 establish different rates through contractual agreements when the terms of said
3 agreements help stabilize system rates over a long term period. Fees and the
4 j landfills to which they shall apply appear as Appendix A to this Ordinance.
5 section 7. PROHIBITIONS. No person shall violate any regulation
6 prescribed by the Chief Executive Officer of the District regulating the use of a
7 County or District disposal site or transfer station, or fail to obey any sign giving
8 notice of any regulation, maintained at any such site or facility by the Chief
9 Executive Officer of the District. Violation of any such regulation shall be a
10 violation of this Ordinance.
11 ! Section 8. VIOLATIONS AND PENALTIES. It shall be unlawful for
12 any person to violate any provision of this Ordinance. Any person violating any
13 ' provision of this Ordinance shall be deemed guilty of an infraction or
tit misdemeanor as hereinafter specified. Such persons shall be deemed guilty of a
15 separate offense for each and every day or portion thereof during which any
16 violation of any of the provisions of this Ordinance is committed or continued.
17 Any person so convicted shall be: (1) guilty of an infraction offense and
18 punished by a fine not exceeding One Hundred dollars ($100.00) for a first
19 violation; (2) guilty of an infraction offense and punished by a fine not exceeding
20 Two Hundred dollars ($200.00) for a second violation. The third and any
21 additional violations shall constitute a misdemeanor offense and shall be
22 punishable by a fine not exceeding Five Hundred dollars ($500.00).
23 Notwithstanding the above, a first offense may be charged and prosecuted as a
24 misdemeanor. Payment of any penalty herein shall not relieve a person from the
25 responsibility for correcting the violation.
26 Section 9. SEVERABILITY. If any provision, clause, sentence or
27 paragraph of this Ordinance (including its appendix) or the application thereof to

t any person or circumstances shall be held invalid, such invalidity shall not affect
2 ; the other provisions or applications of the provisions of this Ordinance (and its
3 appendix) which can be given effect without the invalid provision or application,
4 and to this end, the provisions of this Ordinance (and its appendix) are hereby
5 declared to be severable.
6 Section 10, EFFECTIVE DATE, This Ordinance shall take effect 30
7 days after the date of adoption.

1) Rate for Transfer Trucks to be determined by individual contracts.
2) Loads of dead sheep and small calves from the Blythe service area separated from other wastes
will be received at no charge at the Blythe Landfill.
'"• 3) Certified loads of (tlegaily dumped nonhazardous municipal solid waste retrieved along open
flowing irrigation canals which are delivered by the agency responsible for maintaining the canals
shall be received at no charge at the Blythe Landfill.
'" 4) Non -Commercial self -haul vehicles hauling, .3 ton or less of municipal solid waste from the
Blythe service area (exclusive of waste requiring special handling) shall be exempt from the
55,00 charge at the Blythe Landfill. Such loads shall also be exempt from fees for 2 or less
tires, but are not exempt from uncovered load charges.
