HomeMy WebLinkAboutCC RES 96-06��-k�l��7c� RESOLUTION NO. 96-6 A RESOLUTION OF THE CITY OF PALM DESERT APPROVING THE LEASING OF THE PALM DESERT REDEVELOPMENT AGENCY OF APPROXIMATELY 22 ACRES OF REAL PROPERTY LOCATED ON SOUTHEAST CORNER OF COOK STREET AND GERALD FORD DRIVE, PALM DESERT, CALIFORNIA, TO RONALD ODEKIRK AND RICK ODEKIRK THE CITY OF PALM DESERT HEREBY FINDS, DETERMINES, RESOLVES AND • ORDERS AS FOLLOWS: e� 1. Health and Safety Code Section 33433 requires that before the saie or lease of any property acquired by a redevelopment agency, in whole ar in part, directly or indirectly, with tax increment moneys, pursuant to the redevelopment plan, said conveyance shall first be approved by the legislative body by resolution after public hearing. Section 2. On December 14, 1995, the City held a duly noticed public hearing on the approval of the Palm Desert Redevelopment Agency's (the "Agency°) proposed lease of certain real property (the "Property') described in that certain Disposition and Development Agreement (the "DDA" or the 'lease") between the Agency and Ronald Odekirk and Rick Odekirk (collectively, the "Develope�'), at which time all persons desiring to comment on or ask questions conceming the lease of the Property to the Developer were given the opportunity to do so. Prior to the public hearing, information conceming the Agency's proposed lease of the Property to the Developer was available for public inspection in the offices of the City of Palm Desert at 73-510 Fred Waring Drive, Palm Desert Califomia, 92260, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday. Notice of the public hearing was published in the Desert Sun on November 29, 1995 and December 6, 1995. Section 3. The City has reviewed and considered a{I written and oral comments, questions and concems regarding the Agency's proposed lease of the Property to the Developer received prior to and at the public hearing on said lease. ion 4. The environmental impacts of the Agency's proposed lease of the property to the Developer for the development of the improvements thereon was analyzed by the City's Planning Commission on December 6, 1994, and has found that the described project would have no significant effect on the environment. The environmentaf findings with respect to the project are attached hereto as Exhibit "A" to the Agency's Resolution being adopted concurrently herewith, entitled "A Resolution of the Palm Desert Redevelopment Agency Approving the Leasing of Appr�ximately 22 acres of Real Property Located on the Southeast Comer of Cook Street and Gerald Ford Drive, Palm Desert, Califomia, to Ron Odekiric and Rick Odekirk", and the City concurs with such findings. i n . The DDA requires the Developer to construct certain improvements on the Property as therein described, including, among other things, a softball complex containing three softball fields; four sand volleyball courts for league and toumament play; and a multi-purpose covered structure containing three basketbaU courts, convertible to one indoor soccer or hockey field, and a stage area. RESOLUTION NO. 96-6 Secfion 6. The City and Agency have obtained an evaluation of the fair rental value of the Property from Real Estate Analysis Services Co., who has determined that: (1) the consideration ($3.39 per sq. ft.) is not less than the fair market value of $1.69 per sq. ft.; and (2) the consideration ($3.39 per sq. ft.) is not less than the fair reuse value of $3.22 per sq. ft.. Section 7. The City hereby finds that the sale of the Property pursuant to the DDA will assist in the elimination of blight due to the obligation of the Developer to construct thereon the improvements described in the DDA. i n . The City hereby finds that the considera6on to be paid by the Developer is not less than the iair rental value of the Property at its highest and best use in accordance with the Redevelopment Plan for Project Area No. 2 of the Agency. Section 9. The City hereby approves the lease of the Property to the Developer in accordance with the terms and conditions of the DDA pursuant to the requirements of Heatth and Safety Code Section 33433 (b).
