HomeMy WebLinkAboutCC RES 98-103RESOLUTION NO. 98-103 c� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM �,,, , DESERT, CALIFORNIA, MODIFYING A DECISION OF THE ARCHITECTURAL REVIEW COMMISSION APPROVING PLANS FOR SINGLE FAMILY DWELLINGS AT 74-525 AND 74-515 DAYLILY CIRCLE (LOTS 28 AND 29, TRACT 24287). CASE NO. MISC 98-3 WHEREAS, the Architectural Review Commission of the City of Palm Desert, California, has approved the requested plans subject to conditions; and WHEREAS, a timely appeal has been filed challenging the Architectural Review Commission decision; and WHEREAS, the City Council of the City of Palm Desert did hold on the 14th day of May, 1998, to consider the appeal by Daniel G. Shillito, et. al., challenging the Architectural Review Commission decision; and WHEREAS, said application has complied with the requirements of the "City of Palm .�-� Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 97-18," in that the Director of Community Development has determined that the project � is a Class 5 categorical exemption for the purposes of CEQA and no further documentation is necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts and reasons to exist to justify modification of said decision of the Architectural Review Commission action of April 14, 1998: 1. The proposed dwellings as approved by Architectural Review Commission subject to conditions will be architecturally compatible with other dwellings in the area. 2. The proposed dwellings were substantially smaller than the existing homes on Daylily Circle. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: �-- 1. That the above recitations are true and correct and constitute the findings of the Council in this case. s-. RESOLUTION NO. 98-103 � 1 2. That the action of the City of Palm Desert Architectural Review Commission � dated April 14, 1998 in the matter of Case No. MISC 98-3 in regards to � building architecture is hereby affirmed. 3. While architecturally compatible, unit floor area shall be increased to a minimum of 2,500 square feet to achieve full compatibility with the surrounding neighborhood. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert City Council, held on this 27th day of August, 1998, by the following vote, to wit: AYES: CRITES, KELLY, SNYDER, BENSON NOES: NONE ABSENT: FERGUSON ABSTAIN: NONE ATTEST: � SHEILA R.
