HomeMy WebLinkAboutCC RES 98-106RESOLUTION NO. 98-106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, REQUESTING THE COUNTY AUDITOR TO ASSESS PROPERTY FOR COST OF NUISANCE ABATEMENT PURSUANT TO SECTION 2.20.140 OF THE PALM DESERT MUNICIPAL CODE WHEREAS, a complaint from neighbors was filed with the City on May 14, 1998, that there was a large amount of junk, trash and a stagnant pool on property located at 74-095 Goleta Avenue, in the City of Palm Desert; and WHEREAS, after many unsuccessful attempts to obtain voluntary compliance, the City did, on May 21, 1998, issue a Notice to Abate and posted the property in a conspicuous location and notified the property owner by certified mail describing the violation; and WHEREAS, the nuisance was not abated as prescribed in said "Order of Abatement" and as a consequence, the City incurred costs to proceed with the abatement; and WHEREAS, the City billed the property owner June 22, 1998 in the same manner as posting of the "Order of Abatement"; and WHEREAS, said bill, after sixty (60) days, was not paid; and WHEREAS, on September 10, 1998, the City Council authorized staff to notify the County Auditor of the delinquent bill; and WHEREAS, the City has contractual agreement with the County of Riverside for such collection services. NOW THEREFORE, the City Council of the City of Palm Desert hereby RESOLVES and ORDERS as follows: Section 1. That the above recitations are true and correct. Section 2. That City staff is hereby directed to request the County Auditor, pursuant to Section 2.20.140 of the Palm Desert Municipal Code, to place a lien on the tax bill for the uncollected payment of the cost of abatement of a public nuisance situation -1- Resolution No. 98-106 on the following property: APN 0625-022-008, 74-095 Goleta Avenue, Palm Desert, California 92260; owner of record: Bea A. Avila. Section 3. That the amount owed to the City is as follows: $275.00 For administrative cost involving correspondence with property owner, reinspection, and preparing reports and filing property lien. $ 25.00 Film use for evidence, copy machine use and postage. $190.00 Contract cleanup, removal and landfill costs $490.00 Total PASSED, APPROVED AND ADOPTED at its regular meeting of the Palm Desert City Council held on this 10 thday of September , 1998, by the following vote, to wit: AYES: Crites, Ferguson, Kelly, Spiegel, Benson NOES: None ABSENT: None ABSTAIN: None ATTEST: SHEILA R.
