A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT
AUTHORIZING CHANGES IN CONNECTION WITH ASSESSMENT
DISTRICT NO. 94-1 (BIGHORN)
THE CITY COUNCIL OF THE CITY OF PALM DESERT HEREBY FINDS,
DETERMINES, RESOLVES AND ORDERS AS FOLLOWS:
Section I. Pursuant to its Resolution No. 94-74, adopted on July 14, 1994, the City
Council confirmed an assessment for Assessment District No. 94-1 (Bighorn) (the "Assessment
District") and ordered the acquisition and construction of the Series A Improvements and Series B
Improvements described in the City Council's Resolution No. 94-42, adopted on April 14, 1994 (as
amended by Resolution No. 94-57, adopted on May 26, 1994) and the final engineer's report approved
for the Assessment District entitled, "Final Engineer's Report, Assessment District No. 94-1 (Bighorn),
City of Palm Desert, Municipal Improvement Act of 1913" dated July 14, 1994 (the "Engineer's
Report").
Section 2. The City Council hereby authorizes the City Manager or City Treasurer, at
any time prior to the completion of improvement proceedings, to make changes in connection with the
Assessment District, including but not limited to approving changes to the Engineer's Report (including
cost estimates and line items therein), the improvements ordered in Resolution No. 94-74, and the
assessments (including the amount of any of the individual assessments) confirmed thereby, provided
this Section shall not be deemed to authorize the City Manager or City Treasurer to approve any increase
in the amount of any of the individual assessments without the consent of the affected property owner.
