RESOLUTION NO. 98-48
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
,,,, PALM DESERT, CALIFORNIA, REQUESTING THE COUNTYAUDITOR TO
ASSESS PROPERTY FOR COST OF NUISANCE ABATEMENT PURSUANT TO
SECTION 2.20.140 OF THE PALM DESERT MUNICIPAL CODE.
The City Council of the City of Palm Desert hereby Resolves and Orders as follows:
WHEREAS, A complaint from neighbors was filed with the City on May 13,1997, that there was
a larrge amount of weeds and overgrown grass on property located at 73321 Catalina Way, in the
City of Palm Desert, and
WHEREAS, after mcmy unsuccessful attempts to obtain voluntruy compliance, the City did, ort June
23, 1997, issued a Notice to Abate and posted the property in a conspicuous location and notified
the property owner by certified mail describing the violation, and
WHEREA.S', the rruisance was not abated as prescribed in said "Order of Abatement "; and as a
conseque rce, the City incurred costs to proceed with the abatement, and
,.-.. WHEREA.S, the City billed the property ow ler November 12, 1997 in the same manner as posting
of the "Order ofAbatement, "and

WHEREAS, said bill, after sixty (60) days, was not paid, and
WHEREAS, on Apri123, 1998, the City Council authorized staff to notify the county auditor of the
delinquent bill, and
WHEREA.S, The City has contractr al agreement with the County of Riverside, for such collection
SC'/'VICCS.
NOW THEREFORE, The City Council of the City of Palm Desert hereby RESOLVES and
ORDERS as follows:
Section 1. That the above recitatiorls are true and eorreet.

Section 2. That the City staff is hereby direeted to request that the County Auditor, pursuartt
to section 2.20.140 of the Palm Desert Municipal Code, plaee a lien on the tax brll for the
uncollected payment of the eost of abatement of a public nuisance situation on the following
property:

Section 3. That the amount owed to the City is as follows:
$400.00 For administrative cost irrvolving correspondence with property owner,
reinspection, and preparing reports and filing property lien.
$25. 00 Film use for evidence, copy machine use and postage.
$495.00 Contract clecmup, removal and landitll costs
$920.00 TOTAL
