HomeMy WebLinkAboutCC RES 98-065RESOLUTION NO. 98-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, INITIATING PROCEEDINGS FOR THE LEVY AND COLLECTION OF ASSESSMENTS FOR CONSOLIDATED PALM DESERT LANDSCAPE AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT, FISCAL YEAR 1998/99, PURSUANT TO THE PROVISIONS OF PART 2 OF DIVISION 15 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE The City Council of the City of Palm Desert (hereafter refened to as the "City Council") does resolve as follows: WHEREAS, The Ciry Council through previous resolutions has formed and levied annual assessments for the Consolidated Palm Desert Landscape and Lighting Maintenance Assessment District (hereafter referred to as the "District"), pursuant to the provisions of the Landscape and Lighting Act of 1972, Part 2, Division IS of the California Streets and Highways Code �commencing urith section 22500� (hereafter referred to as the "Act") that provides for the collection of assessmenu by the County of Riverside for the Ciry of Palm Desert to pay the maintenance and services of all improvemenu and facilities related thereto; and, WHERF.AS, the City Council has retained MBIA MuniFinancial for the purpose of assisting with the Annual Levy of the District, to prepare and %le an Engineer's Annual Levy Report (hereafter referred to as the "Report") with the City Clerk in accordance with the Act; and, NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL FOR THE DISTRICT, PURSUANT TO CHAI'TER 3, � SECTION22624 OF THE ACT, AS FOLLOWS: Section 1 En�ineer's Report: The City Council hereby orders MBIA MuniFinancial to prepare and file with the City Clerk the Engineer's Report concerning the levy of assessments for the District for the fiscal year commencing July 1, 1998 and ending June 30, 1999 in accordance with Chapter 3, Section 22622 of the Act. Section 2 PrQposc:d improvements and any substantial changes in existin� improvemenu: The improvements wit;un the District include: turf, ground cover, shrubs and trees, irrigation systems, street lighting, water fea*ures, entry monumenu, drainage systems and all appurtenant facilities and operations related thereto.
