HomeMy WebLinkAboutCC RES 98-077RESOLUTION NO. 98-77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, CLOSING PORTIONS OF FAIRHAVEN DRIVE AND PORTIONS OF ADONIS DRIVE TO VEHICULAR TRAFFIC. WHEREAS, California Vehicle Code section 21101 authorizes local authorities to adopt rules and regulations closing any highway to vehicular traffic when, in the opinion of the legislative body having jurisdiction, the highway is no longer needed for vehicular traffic; and WHEREAS, Fairhaven Drive and Adonis Drive were temporarily closed, to the North of Fred Waring, for a 90 day trial period; and WHEREAS, residents of the Palm Dell Estates and other interested citizens have expressed their views to the City Council pertaining to the closure of Fairhaven Drive and Adonis Drive to through traffic; met with staff including the City Manager, Director of Public Works and the Transportation Engineer at a public meeting held May 13, 1998; and WHEREAS, a public hearing was held on May 28, 1998, before the City Council on the issue of the Palm Dell Estates Traffic Control Plan and, specifically, the closure of Fairhaven Drive and Adonis Drive to through traffic; and WHEREAS, the City Council considered the oral and written evidence presented at said hearing, including consideration of the transcript of the public meeting held May 13, 1998, the oral public comments received at the hearing, written statements submitted by citizens prior to the hearing, and the reports of staff concerning the temporary trial closure of said streets and the vehicular traffic flow, safety and related impacts relevant to this portion of the 1985 Palma Village Plan. NOW, THEREFORE, BE IT RESOLVED as follows: SECTION 1: The City Council of the City of Palm Desert does hereby find that considerations of public health and safety warrant the closure of that portion of Fairhaven Drive located to the north of Fred Waring Drive, which currently provides vehicular access to Fred Waring Drive and through traffic access along Fairhaven Drive through the Palm Dell Estates, and further finds that adequate alternative access routes exist such that vehicular access at Fairhaven Drive and Fred Waring Drive is no longer needed. SECTION 2: The City Council of the City of Palm Desert does hereby find that considerations of public health and safety warrant the closure of that portion of Adonis Drive located to the north of Fred Waring Drive, which currently provides vehicular access to Fred Waring Drive and through traffic access along Adonis Drive through the Palm Dell Estates, and further finds that adequate alternative access routes exist such that vehicular access at Adonis Drive and Fred Waring Drive is no longer needed. RMPUB\HPD\2883 SECTION 3: That portion of Fairhaven Drive located to the north of Fred Waring Drive is hereby closed to through traffic, commencing immediately to the south of the northernmost entrance to the parking facility currently located on Lot APN No. 640-074-003 to the east, and immediately to the north of the southernmost entrance to the parking facility currently located on Lot APN No. 640-040-011 to the west; and the Director of Public Works is hereby directed to erect thereupon traffic barriers constructed of steel, with gates for emergency access, preventing cross, through or other access traffic from entering or exiting the Palm Dell Estates via this section of highway. SECTION 4. That portion of Adonis Drive located to the north of Fred Waring Drive is hereby closed to through traffic, commencing at the prolongation of the property line between Lot APN No. 640-072-012 and Lot APN No. 640-072-006 to the east, and immediately to the north of the southernmost entrance to the parking facility currently located on Lot APN No. 640-074- 003 to the west; and the Director of Public Works is hereby directed to erect thereupon traffic barriers constructed of steel, with gates for emergency access, preventing cross, through or other access traffic from entering or exiting the Palm Dell Estates via this section of highway.
