A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
_ CALIFORNIA APPROVING THE CONVEYANCE OF CERTAIN REAL PROPERTY
LOCATED ON CATALINA WAY AND KNOWN AS APN 627-052-010-1 TO HABITAT
FOR HUMANITY FOR THE CONSTRUCTION OF A SINGLE FAMILY DWELLING AND
APPROVING A DISPOSITION AND DEVELOPMENT AGREEMENT
RECITALS:
A. Pursuant to Health and Safety Codc §33433, the City Council, is required to hold a public
hearing before any property of the Agency acquired in whole or in part, directly or indirectly, with
tax increment money is sold or leased for development pursuant to the Redevelopment Plan, said
conveyance shall first be approved by the City Council by resolution after public hearing.
B. Pursuant to Health and Safety Code §33013, the City Council hereby determines that the
proposed conveyance ofthe property to Habitat for Humanity constitutes a "Small Housing Project",
and thereby elects not to apply the requirements of Housing Code §33433 (a) and §33433 (b).
C. Pursuant to Health and Safety Code §33433 (c), the City Council hereby directs the Agency
to prepare a report to the City Council on or before 30 days after the end of the Agency's present
fiscal year disclosing the name of the owner of the property, the legal description or street address
— of the property, the date of the conveyance of the property, the restrictions posed by the agreement
on the owner of the property and the date on which the Agency had a public hearing on the
conveyance of the property.
NOW, THEREFORE, the City Council of the City of Palm Desert hereby finds, determines, resolves
and orders as follows:
Section 1. That a duly noted public hearing in conformity with the requirement of Health and Safety
Code §33433 (a) was held on August 24, 2000.
Section 2. The City Council has reviewed and considered all written and oral comments, questions
and concerns regarding the Agency's proposed conveyance of the property to Habitat for Humanity
received prior to and at the public hearing on said conveyance.
Section 3. The City Council hereby authorizes the Agency to convey the property to Habitat for
Humanity in accordance with the terms and conditions of the Disposition and Development
Agreement and pursuant to the requirements of Health and Safety Code §33433.

Section 4. The City hereby directs in accordance with the requirements of Health and Safety Code
§33433 (c), the Agency shall prepare and report to the City Council on or before 30 days after the
end of the Agency's present fiscal year as required.
