HomeMy WebLinkAboutCC RES 00-140RESOLUTION NO. 00-140 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, GRANTING AN APPEAL TO A DECISION OF THE PLANNING COMMISSION AND APPROVING A GENERAL PLAN AMENDMENT FROM MEDIUM DENSITY RESIDENTIAL TO OFFICE PROFESSIONAL AND A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AS IT RELATES THERETO FOR 2.74 ACRES ON THE NORTH SIDE OF FRED WARING DRIVE, 330 FEET WEST OF FAIRHAVEN DRIVE, 72-600 FRED WARING DRIVE. CASE NO. GPA 00-04 WHEREAS, the City Council of the City of Palm Desert, Califomia, did on the 14th day of December, 2000, hold a duly noticed public hearing to consider an appeal by Charles Sweet on behalf of Kenneth and Vanessa Katz and William Broz; and WHEREAS, the Planning Commission by its Resolution No. 2027 has denied Case No. GPA 00-04; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the Califomia Environmental Quality Act, Resolution No. 00-24", in that a Negative Declaration of Environmental Impact has been prepared and the Director of Community Development has recommended that it be certified; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to justify its actions, as described below: 1. The site is suitable for the general plan amendment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the City Council in this case. 2. That the City Council does hereby approve GPA 00-04 as shown on Exhibit "A" attached hereto. 3. That the Negative Declaration of Environmental Impact is hereby certified, as shown on Exhibit "B" attached hereto. Sweet 43-708 Virginia Avenue Palm Desert, CA 92211 PROJECT DESCRIPTION/LOCATION: Kenneth and Vanessa Katz William Broz 77-587 Ashberry Court Palm Desert, CA 92211 A general plan amendment from medium density residential to office professional for property on the north side of Fred Waring Drive, 330 feet west of Fairhaven Drive. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
