T CA 2013 SEP 13 PM 2: 30 111111111101111111111111111111111111111111110111 d'°'=a"'4°':- RESOLUTION NO. 02-104 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ABANDONING A PUBLIC SERVICE EASEMENT AFFECTING LOTS 1 — 5 AND LOTS 10 —14, DESCRIBED AS PUBLIC UTILITY EASEMENT AS SHOWN ON THE DESERT PARADISE TRACT SUBDIVISION MAP IN THE CITY OF PALM DESERT UNDER PROVISIONS OF PART 3, DIVISION 9, OF THE STREETS AND HIGHWAYS CODE, OF THE STATE OF CALIFORNIA WHEREAS, the City Council initiated proceedings to abandon a public service easement described as "public utility easement" affecting Lots 1 — 5 and Lots 10 — 14 of the Desert Paradise Tract, as filed in Book 38 of Maps, Page 24, Official Records of Riverside County, and the City Council finds that said notices of such abandonment were published and posted, as required by law; and WHEREAS, the City Council on the 22nd day of August, 2002, held a public hearing as required by law, at which hearing all persons interested in or objection to the proposed abandonment were heard, and said public hearing was duly and regularly closed; and WHEREAS, the City Council of the City of Palm Desert considered such matter and finds from the evidence submitted that the public service easement described as "public utility easement" affecting Lots 1 — 5 and Lots 10 — 14 of the Desert Paradise Tract, Official Records of Riverside County, are unnecessary for present or prospective public purposes. NOW, THEREFORE, the City Council of the City of Palm Desert, Califomia, DOES HEREBY RESOLVE AS FOLLOWS: That the following public service easement known as "public utility easement" affecting Lots 1 — 5 and Lots 10 — 14 of the Desert Paradise Tract, Official Records of Riverside County, be abandoned. II That the City Clerk of the City of Palm Desert, California, shall cause a certified copy of this resolution and order to be recorded in the Office of the County Recorder of Riverside County, California.
