HomeMy WebLinkAboutCC RES 02-128RESOLUTION NO. 02-128 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR APPROVAL OF A GENERAL PLAN AMENDMENT AND CHANGE OF ZONE FROM LOW DENSITY RESIDENTIAL (PR-5) TO (O.P.) OFFICE PROFESSIONAL AND A PRECISE PLAN OF DESIGN ALLOWING UP TO 33,310 SQUARE FEET OF OFFICE PROFESSIONAL USE FOR 3.90 ACRES AT THE NORTHWEST CORNER OF FRANK SINATRA DRIVE AND PORTOLA AVENUE. CASE NOS. GPA 02-02. C/Z 02-02 AND PP 02-06 WHEREAS, the City Council of the City of Palm Desert did on the 12th day of September, 2002, hold a duly noticed public hearing to consider the request of NBNA Unique Properties LLC for approval of the project and cases as described above; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts and reasons to exist to justify denial of the request, as described below: 1. The proposed general plan amendment is premature considering that GPAC (General Plan Advisory Committee) will be recommending an updated general plan land use element in the near future. 2. Approving a general plan amendment on this site is inappropriate without knowing what surrounding land uses will be. 3. The vacant 12-acre site to the south is zoned to permit office uses and additional office zoning is not necessary in this area at this time. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the City Council in this case. 2. That the City Council does hereby deny the requested GPA 02-02, C/Z 02-02 and PP 02-06. RESOLUTION NO. 02-128 PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert City Council, held on this loth day of October , 2002, by the following vote, to wit: AYES: BENSON, CRITES, FERGUSON, SPIEGEL, KELLY NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: C RICHARD S.
