CONTRACT NO. C21080 RESOLUTION NO. 03-37 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ADOPTING A CONTRACT TO PROVIDE FAIR HOUSING (ANTI- DISCRIMINATION) AND TENANT/LANDLORD COMPLAINT RESOLUTION AN EDUCATION SERVICES WITH THE FAIR HOUSING COUNCIL AS PART OF THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM. This contract ("CONTRACT") is made and entered into this 24th day of Anril , 2003 by and between the City of Palm Desert, hereinafter called the "City," and Fair Housing Council of Riverside County, hereinafter called the "Operating Agency." The City and Operating Agency are sometimes hereinafter referred to individually as "Party" and collectively as the "Parties." RECITALS WHEREAS, the City has entered into a contract with the United States of America, through its Department of Housing and Urban Development (HUD), to execute the City's Community Development Block Grant ("CDBG") Program, under Title I of the Housing and Community Development Act of 1974 (42 U.S.C. 5301 et sea.), as amended (hereinafter called the "Act"); and WHEREAS, pursuant to 24 CFR 200 (f)(1)(ii), 24 CFR 570.500© and 24 CFR 570.501(b), the City may provide CDBG funds to public or private nonprofit agencies, authorities or organizations, or for -profit entities authorized under 570.201(o) (referred to collectively and individually as "subrecipients") to be used by the subrecipients to provide certain eligible services in connection with the City's desire to develop viable urban communities, through community development activities; and WHEREAS, the Operating Agency desires to participate in the CDBG Program as a subrecipient by providing necessary services to enhance the quality of life for low and moderate -income citizens in the City; and WHEREAS, the City has approved the provision of CDBG Program funds to be used by the Operating Agency to provide certain services (the"Project Services") as more particularly described in the Project Description and Activity Budget attached hereto as Exhibit "A" and incorporated herein; and Resolution No. 03-37 CONTRACT NO. C21080 WHEREAS, the Operating Agency represents and warrants to the City that the Operating Agency is qualified to provide the Project Services by reason of experience, preparation, organization, staffing, and facilities and that it shall provide the Project Services as set forth in Exhibit A; and WHEREAS, the Operating Agency represents and warrants to the City that it shall provide the Project Services in accordance with the Activity Budget as set forth in Exhibit A. PROJECT SUMMARY: This is a continuing project. This Fair Housing Program has been in existence since 1986, providing services towards affirmatively furthering fair housing laws and obligations under the Federal Fair Housing Act and California State Laws. Fair housing laws prohibit discrimination in the sale, rental or financing of housing on the basis of race, color, national origin, religion, sex, familial status (presence of children), disability, ancestry, marital status, or other arbitrary factors. The Council works towards these goals through education programs to the general public on fair housing rights and responsibilities, training and technical assistance to housing professionals, and enforcement by processing discrimination complaints through screening, investigation, testing and referrals. The Operating Agency shall monitor complaints regarding unfair lending practices, assess lending patterns using Home Mortgage Disclosure Act data. Additionally, the Agency shall work with local lenders and government institutions to provide outreach and information to lower income households regarding available programs and services, including the home buying process, and awareness of predatory lending practices. Finally, the Agency will prepare reports, surveys, testing (e.g., Art of Testing for Discrimination in Housing), etc. or assist the City or representatives, if outside scope of services, as required or needed. CDBG funds will be used for personnel costs (salaries and benefits), non -personnel costs (materials and supplies, printing and copying, advertising, telephone, equipment rental, mileage, and consultants), as well as legal services. XX CDBG funds expended for planning and administrative costs under 570.205 and 570.206, respectively, will be considered to address the national objectives. PROFESSIONAL SERVICES/SUBRECIPIENTS: (describe duties to be performed) Consultants will be used as part of this project, including legal services. No subrecipient agencies will be utilized. 12. SPECIAL CONDITIONS: (City Housing and Development Department use only) 1. Operating Agency must maintain financial source documentation to support CDBG expenditures. 2. Operating Agency shall comply with the City's Accounting and Administrative Handbook, including Section 2.6 and 3.2. 3. Services under this contract will benefit residents of the City of Palm Desert. 4. Operating Agency shall comply with 24 CFR Part 84 and OMB Circular A-122. 5. Consultant contracts must contain required federal provisions and contractual clauses. 6. Operating Agency shall neither discriminate on the basis of religion, nor engage in religious proselytizing, instruction, counseling, or worship services in the provision of services, in accordance with 24 CFR Section 200 (j)(3). 7. Services under this contract shall be free of charge to low and moderate -income persons, as well as available to the general public. 13. BUDGET SUMMARY: The Operating Agency understands that no exnenditures may be incurred until the contract has been fully executed.
