A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, VACATING A STORM DRAIN EASEMENT, DESIGNATED AS
"EASEMENT D," IN THE REMAINDER PARCEL OF TRACT NO. 27882-1
UNDER PROVISIONS OF DIVISION 9, PART 3, CHAPTER 4 OF THE
STREETS & HIGHWAYS CODE OF THE STATE OF CALIFORNIA, AND
ACCEPTING A REPLACEMENT EASEMENT AND AGREEMENT.
WHEREAS, the subject vacation is made pursuant to the requirements of the California
Streets and Highways Code, Division 9, Part 3, Chapter 4; and
WHEREAS, the City Council of the City of Palm Desert considered such matter and finds
from the evidence submitted that the easement described and depicted in Exhibit "A," attached
hereto and made a part of, is unnecessary for present or prospective public purposes;
NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES
HEREBY RESOLVE AS FOLLOWS:
I.
That drainage easement "D" located in the remainder parcel of Tract No. 27882-1 as per
map filed in Book 253, Pages 8 through 12, of maps in the Office of the Country Recorder of
Riverside County, California, be vacated as described and as set forth in Exhibit "A" attached
hereto; and
II.
That the Grant of Easement and Agreement for a replacement storm drain easement
described and depicted in Exhibit "B," attached hereto, be accepted; and
III.
That the City Clerk of the City of Palm Desert, California, shall cause a certified copy of this
resolution and order to be recorded in the Office of the County Recorder of Riverside County,
California and order the replacement easement and agreement to be recorded in said Office of the
County Recorder before or concurrently with this resolution; and
IV.
That from and after the date this resolution is recorded, drainage "easement D" will no
longer constitute a public service easement.
PASSED, APPROVED, and ADOPTED at the regular meeting of the Palm Desert City
Council held on this 11•' day of October 2007, by the following vote, to wit:
AYES: BENSON, FERGUSON, FINERTY, SPIEGEL, and KELLY
NOES: NONE
ABSENT. NONE

GRANT OF EASEMENT AND AGREEMENT
THIS GRANT OF EASEMENT (this "Grant of Easement') is executed as of
October 11 , 2007, by Robert L. Mayer, as Trustee of the Robert L. Mayer Trust of 1982
("Mauer"), in favor of the City of Palm Desert ("C�, with reference to the following facts and
circumstances:
RE-CITALS
A. Mayer is the, owner of certain real property situated in the City, County of
Riverside ("Count I State of California, as more particularly described on Exhibit "C" attached
hereto and incorporated herein by this reference (the "Propert ').
B. Certain underground storm drain improvements (the "Storm Drain
Improvements") currently exist on the Property at the location described by Exhibit "A" and
depicted by Exhibit "B" attached hereto and incorporated herein by this reference.
C. City currently owns and holds an easement for drainage purposes over a portion
of the Property, in a different location than where the Storm Drain Improvements are situated, as
shown and dedicated on Tract Map No. 27882-1 on file in Book 253 Pages 8 through 12,
inclusive, of Maps, records of Riverside County, California (the "Existin Easement").
D. Mayer now desires to grant an easement to the City over the portion of the
Property upon and within which the Storm Drain Improvements are located in order to facilitate
the City's maintenance of the Storm Drain Improvements, with the understanding that the City
will subsequently vacate and abandon the Existing Easement.

NOW, THEREFORE, incorporating the foregoing recitals, and for other fair and valuable
consideration, the receipt and adequacy of which is hereby acknowledged, Mayer hereby agrees
as follows:
1. Granting of Easement. Mayer hereby grants to the City an easement (the
"Replacement Easement") over the portion of the Property described in Exhibit "A" and depicted
on Exhibit "B" attached hereto (the "Easement Area") for the purpose of allowing the City to
use, maintain, repair and reconstruct the Storm Drain Improvements and for related and
incidental drainage purposes, which Replacement Easement includes rights of ingress and egress
over the Property as reasonably necessary to accomplish such purposes, provided that to the
extent feasible, all such ingress and egress shall be limited and confined to the Easement Area.
By its acceptance of this Replacement Easement, the City acknowledges that it has accepted and
owns the Storm Drain Improvements; including the maintenance obligations associated
therewith.
2. Successors and Assigns. This Grant of Easement shall constitute a covenant
which runs with the land and which is binding upon the successors and assigns of Mayer.
3. IN WITNESS WHEREOF, the Mayer has executed this Grant of Easement as of
the date first set forth above.

IN THE CITY OF PALM DESERT, COUNTY OF RIVERSIDE,
STATE OF CALIFORNIA
A 15.00 foot wide easement, lying over, under and across that portion of the remainder parcel of
Tract No. 27882-1, in the City of Palm Desert, County of Riverside, State of California, as per
map filed in Book 253, Pages 8 through 12, of Maps in the office of the County Recorder of said
County more particularly described as follows:
Said easement lies 7.50 feet on each side of the following described centerline;
COMMENCING at the southwesterly corner of Lot 7, of said Tract No. 27882-1, thence along
the southerly line of said Lot 7, North 89°37'30" East, a distance of 7.90 feet to the TRUE
POINT OF BEGINNING;
Thence, South 00°28'17" East, a distance of 2.23 feet, to the beginning of a tangent curve,
concave northeasterly and having a radius of 22.50 feet;
Thence southerly, southeasterly, and easterly along said tangent curve, through a central angle of
90°00'00", an arc distance of 35.34 feet, to a point on a tangent line;

FOR
STORM DRAIN EASEMENT
IN THE CITY OF PALM DESERT, COUNTY OF RIVERSIDE,
STATE OF CALIFORNIA
A 15.00 foot wide easement, lying over, under and across that portion of the remainder parcel of
Tract No. 27882-1, in the City of Palm Desert, County of Riverside, State of California, as per
map filed in Book 253, Pages 8 through 12, of Maps in the office of the County Recorder of said
County more particularly described as follows:
Said easement lies 7.50 feet on each side of the following described centerline;
COMMENCING at the southwesterly corner of Lot 7, of said Tract No. 27882-1, thence along
the southerly line of said Lot 7, North 89°37'30" East, a distance of 7.90 feet to the TRUE
POINT OF BEGINNING;
Thence, South 00°28' 17" East, a distance of 2.23 feet, to the beginning of a tangent curve,
concave northeasterly and having a radius of 22.50 feet;
Thence southerly, southeasterly, and easterly along said tangent curve, through a central angle of
90°00'00", an arc distance of 35.34 feet, to a point on a tangent line;
Thence along said tangent line, North 89°31'43" Fast, a distance of 87.79 feet, to the beginning
of a tangent curve, concave southwesterly and having a radius of 45.00 feet;
Thence easterly and southeasterly along said tangent curve, through a central angle of 25°08'30",
an arc distance of 19.75 feet, to a point on a tangent line;
Thence along said tangent line South 65°19'47" East, a distance of 54.79 feet, to the beginning of
a tangent curve, concave southwesterly and having a radius of 45.00 feet;
Thence southeasterly and southerly along said tangent curve, through a central angle of
64°52'54", an arc distance of 50.96 feet, to a point on a tangent line;
Thence along said tangent line South 00°26'53" East, a distance of 159.17 feet, to the beginning
of a tangent curve, concave northeasterly and having a radius of 45.00 feet;
Thence southerly, southeasterly and easterly along said tangent curve, through a central angle of
89°53'57", an arc distance of 70.61 feet, to a point on a tangent line;
Thence along said tangent line North 89°37'27" East, a distance of 39.71 feet, to the beginning of
a tangent curve, concave southwesterly and having a radius of 45.00 feet;

Thence easterly and southeasterly along said tangent curve, through a central angle of 20°40'20",
an arc distance of 16.24 feet, to the POINT OF TERMINATION, said point also being on the
westerly line of Lot "K" as shown on said Tract No. 27882-1.
The sidelines of the above described easement shall be lengthened or shortened so as to intersect
with the westerly line of said Lot "K".
Subject to: covenants, conditions, restrictions, reservations, easements and right-of-ways of
record, if any.
